Stay indoors request lifted, suspect still at-large

The "stay indoors" request for parts of Boston has been lifted and public transit service has been restored after a day spent on "lockdown" while police searched for the Marathon bombing suspect, who remains at-large. Tonight's home games for the Bruins and the Red Sox, however, remain cancelled.
The day's exercise could cost up to $333 million in lost business, according to BusinessWeek, which also notes that the Dunkin Donuts stayed open per request from law enforcement.
President Obama visited Boston for an interfaith prayer service, telling the city it was the wrong one to pick for a bombing. Boston last faced a shut down like today's when props from an Adult Swim marketing campaign were mistaken for bombs in 2007.

They're claiming exigent circumstances, which the Supreme Court has generally allowed them to get away with. IIRC, though, they can only search for the suspect and nothing else. Anything not connected with the exigent circumstance pretty much has to be ignored.

Apparently I am the only one here who thinks you are all giving Dunphy undeserved grief on this. It seemed clear to me that he was talking about the most recent events, and not slighting the bombing victims.
And if the death of cops touches him more because he's a cop, yeah, so what? The people of Boston are probably more upset at the deaths of Bostonians, too. Marathon runners might also be especially upset, but that doesn't mean they think runners are more worthy of life than non-runners. That sort of "the connection to me makes it seem worse" thing is natural, and not necessarily evidence of inhumanity.
The problem is that marathon runners don't have a reputation of holding themselves in a caste above the rest of the society and are deserving of extra rights and privileges.
I'd say that people who participate in sports are often exactly that way, though I grant that most of that is at the professional level.
But it's also true that people whose jobs often expose them to danger (cops, soldiers, firefighters) and/or high stress (ER personnel) are often very bonded by the experience and thus are considered "special" by themselves and others. I'm not arguing in favor of codifying or abusing that status, but it exists for a reason, and so seems unobjectionable in and of itself.
It's different though when they make themselves into a caste, which is what happens with the police and more first responders.
Like I said, that can be a problem, but I see no evidence that Dunphy was doing that in his comment that set off this brouhaha.

Your comparison with Brazilians is a good one, although I thought Latin (as long as its used as short for Latin American) was ok, as its a broader term? Portuguese is just as Latin as Spanish. Although I can see why even that could get annoying when many people assume Brazilians are just like another country of Spanish-speaking Latin Americans, which obviously isn't the case.

Apatheist, Belize is not considered a part of Latin America. The Spanish claimed it, but never settled, and then the British took it from them. Spanish is still widely spoken there, however. Suriname and Guyana are definitely not, as they speak Dutch and English and (to my knowledge) were never even nominally part of the Spanish Empire.

Actually, Haiti and French Guiana are technically considered part of Latin America. I didn't know this myself until recently, but it makes sense for consistency sake. I guess the reason Brazil is thought of as Latin American more than those places is a) It's much larger and more famous b) Portuguese is more similar to Spanish than French is c) the racial mix in Brazil is more similar to the average mix in the Spanish Americas (though still significantly different from most Spanish-speaking LA countries) than those places. And of course most people don't even know French Guiana exists.

In this case, it's CUSTODIAL and INTERROGATION, so it's gotta be one of those case law exceptions like with the live devices. I'm CERTAIN the order came down from an AUSA. FBI doesn't make these decisions on their own. They do what the US ATTorney recommends.

Leaving aside the "public safety" exception, the remedy for a failure to advise a suspect of his rights to counsel and to remain silent (Miranda) prior to custodial interrogation would only result in the statement so obtained being ruled inadmissible against the suspect in a criminal proceeding. Normally any evidence derived as a result of that violation would also be inadmissible (Wong Sun) though that protection has been watered down (Patane) if the "confession" is voluntary. Patane is a horrible decision, IMHO.

Guys, the lack of a Miranda warning really isn't as important as you think. They don't need a confession to convict this guy 20 times over. They do need him to talk to find out if he has other devices hidden that pose a risk to public safety, or if he had accomplices.
They won't be able to use non-Miranda testimony against him, and he can decide not to talk without the warning. Until they disappear him for some extra persuasion I can't get too worked up about it.

People didn't necessarily disagree with me, they just didn't seem to concerned if some vigilantism took place first (either by LEO or non-LEO), citing the nature of hit actions.

Naturally, MHP stops him and says they need to go to commercial. But before they do, the woman next to Matt says that low-income housing built the American middle class.

I'd be curious to hear how comfortable you'd be to either prosecute or defend this case, given all of the evidence that's been available to the public so far, but nothing more. On the defense side, the main question is: can you hypothesize any possible story the guy might tell you, where you'd honestly believe that it was a plausible series of events? And on the prosecution side, what points can you identify, where you'd wish you had more direct evidence.
I stipulate that you have to stick to publicly-known facts here, and not whatever else the FBI may have that we don't know about, because it's the dynamics of the court of public opinion that I'm interested in analyzing. Regardless of the actual facts, there is a certain inertia, where no matter what proof to the contrary you came up with, the average person would be likely to reject it, based only on the fact that he's already made up his mind by this point in time.
So far, I can only come up with one basic scenrario that I find to be plausible, given the actual data points we have, and though I would consider it highly unlikely, it is not entirely far-fetched. The only risk to this kind of speculation is that your truther types are liable to read it, and run with it, but no big deal, because in its absence, they'll just come up with something else, anyway.

If the government could fake the events of the last week, they can fake anything, or are impossible to defeat in any case. Working to "expose" them would be pointless.
The ONLY way to be a Truther about this that would have any remote chance or being both plausible and actionable (actionable in the sense that "exposing" the secret would actually have some point, because it doesn't require an all-powerful conspiracy to be behind it) would be to say that the guys were CIA operatives and that the death photo of the older brother is photoshopped. That way you can concede that events happened exactly as the state says they did, with the only difference being that the Tsarvievs were agent provocateurs working for the CIA, to justify the passage of CISPA and Patriot Act part Whatever and domestic use of drones yadda yadda yadda.
I'm not talking about a conspiracy, but only about a possible story where you have a guy who's not actually guilty of the marathon bombing. In other words, it's not truthers I'm thinking about, but rather people who would jump to declare the suspect as enemy combatant and such, and want to try him behind closed doors.
And the series of events I am thinking about is much different than what you write above. Basically, it's just this: what is the likelihood that there are, within the population of that region, two brothers who a) are into playing with guns and illicit explosives, b) attended the marathon, but c) did not do the marathon bombing. Say there is such a pair. Upon seeing pictures of themselves in the FBI briefing, they realize that they've just found themselves in deep trouble. They could try and turn themselves in, but who is going to believe their story? So they decide to try and bolt, and everything plays out from there as it did.
Not likely, but also not impossible. And more importantly, involving absolutely no conspiracy. And I am not putting that forth as an actual alternate explanation, it's just a thought experiment pertaining to hard evidence vs. reasonable doubt.
The only plausible "Truther" angle is that these guys were an FBI sting gone wrong. That is, the FBI put them up to it hoping to make an arrest and then fucked up and didn't arrest them before the bomb went off.

I would happily do either. From the prosecution side, you have their actions after being confronted, which clearly show conscience of guilty. They also reportedly bragged about it. We have pictures of them at the scene. That is a pretty easy case to make.
From the defense side, you blame everything on the dead brother. You say he planted the bombs and that you were afraid of him and just along for the ride. It probably wouldn't get you acquitted. But it would be the best chance you would have at saving him from the death penalty.
Definitely, there are an awful lot of angles the kid could claim, especially with the brother being out of the picture. What he'd posted to twitter doesn't fit the cold-blooded killer profile to my reading, and it's pretty uniform among acquaintances that they don't see him being capable of doing it. I don't really see that angle coming out with the brother. You have the pictures of the suspect literally at the scene of the crime, but that fact is incongruous with a lot of these other things. So I think a defense could easily be made that he was operating under coercion beforehand, and then, basically, shock-induced suspension of reality afterward. To what degree that would be exonerating, who knows, but there's just too much room for me to be able to think as some people are at the moment. Just for example, here's something that was posted in the off-topic section of forum I deal with regularly in the course of doing business (basically, it's a forum of architects), which I found to be pretty disturbing:

So here, we have a person who proposes to literally blow a person's legs off. Perhaps if pressed, he would retract that and go with something more reasonable, say the death penalty. But in either case, my question would be the same: given the evidence he has, which he himself must regard as being sufficient, given that he made the statement, would he actually, personally, trigger that detonator, or pull that lever?
And if not, could he offer a cogent explanation as to why? I have a line of reasoning that says, basically, if you want to have this justice system, people somehow need to be made to feel the full weight of exactly what it is that they're doing, and that generally don't, since they are allowed to delegate the responsibility, shuffling the dirty work off onto some nameless and unseen state agent.
I guess this is probably one of the more convincing arguments in favor of the jury system, since while it is still very indirect, at least each person might be made to consider such things in very concrete terms, at least sometime in their lives. I have other problems with that, but they'd be off-topic here.

People are brought up on charges, tried, and a voluntary-participation vote is taken, which determines the verdict. The main condition for voting, though, is this: the responsibility of actually executing the verdict falls on a person randomly selected from among the pool of those who chose to vote.
It's kind of interesting to work through the various motivations present, from whether you will vote, to how the possibility that you might be chosen affects the vote you make.

Concerning the house-to-house searches in Watertown. I'm sure this has already been discussed, but does anyone know in what fashion the searches conducted?
1. Were the searches "knock and talks", and the homeowners voluntarily allowed (or disallowed) the police to come inside?
2. Did LE enter residences regardless of the homeowners' wishes (either by force or intimidation), even though they had no legal authority to do so?
3. Or did the powers that be deem the searches legal and mandatory?
I don't agree with American's racial views, essentially white nationalism, but I think that he is absolutely right on the subject of women. Throughout my life I have seen that there is a subset of men, maybe ten percent, who know how to get a lot of ass. Looks are an important part, of course, but aren't the major factor. It is attitude that matters. I won't say its simply "being an asshole" rather, it is being a specific type of asshole, the aloof confident alpha. This makes a lot of sense from an evolutionary standpoint. Women want a dominant man, a man with status, a man who knows how to fuck a lot of women. This instinct has historically been suppressed by civilization, but in SWPLand, it is aloud to roam free. That doesn't mean game will work on every single woman, but it will work on most women, and game is all about numbers, options.
