Police Shooting in China Draws Ire, Campus Police Shooting in Alabama Blamed on LSD
A motorcycle chase in Wenxian County, Henan, China's third most populous province, ended with police shooting the suspected thief four times, but while police claim they shot after the thief brandished a brick from short distance, witnesses telling their stories on the Internet say the cops shot the man in a ditch from a long distance. China has laws about these kinds of things you know. From the Chinese Communist Party-owned Global Times:
"Whatever the man did, it shouldn't have cost him his life," the Weibo user said, reflecting an opinion that was shared by many netizens who asked under what circumstances the police are permitted to use deadly force.
"China has strict regulations on the use of firearms by police," Liu Tao, a criminal professor from Chinese People's Public Security University, told the Global Times. As a rule, Chinese police on patrol do not carry firearms but their use is allowed if a violent suspect flees arrest, breaks out of prison, or threatens the life of another.
"People may have different interpretations of the regulation," said Liu, "It would be difficult to judge afterwards whether the situation was only borderline dangerous. However, smashing someone on the head with a brick could kill."
Li, 47, is a senior officer and was honored as the county's outstanding police officer in May.
Meanwhile, a naked University of South Alabama student was shot by a campus police officer over the weekend. The cops blame LSD, and someone could be charged with the student's murder. From the local NBC affiliate:
Investigators say Collar was under the influence of LSD and had attacked a couple of people prior to his violent encounter with a USA campus police officer…
They say after that, he returned to his dorm, stripped off all of his clothes, then went up to a couple of different cars and actually assaulted people inside. Authorities say one female victim reported Collar tried to bite her arm…
The Mobile County Sheriff's Office plans to release video showing the incident - first showing it to Collar's family - then likely it will be released to the media Thursday.
Sheriff Sam Cochran says he had some doubts about the story, but when he saw the video it became more evident how this all happened.
The video will only be shown to members of the media, it will not be broadcast to the public.
The shooting happened just out of the view of the camera.The Mobile County Sheriff's Office is looking into who gave Collar the LSD and murder charges could be brought on to those persons if they are charged.

In China, cops rarely carry guns, but seem to be excellent shots.
Compare and contrast to US cops.
In LA, they go through ammo by the truckload. They shot at a guy with a cellphone on the 101 over a hundred times, and only hit him 5 or 6.
That beats the Tuscon (Pima County) SWAT team. They managed to squeeze off over 70 rounds at Jose Guerena a short distance away in a narrow hallway, hitting him 22 times. Only 2 in the torso though. They were able to hold the paramedics off for over an hour though, so no need to worry about their bad aim.

And I have to say, that was some bad acid. I've been around my fair share of people on LSD, and violence, hell, physical exertion, of any kind is just not part of the program.

the fact that he is unarmed is not, and never has been dispositive - whether it's a cop ro a "civilian" as the sanderson shooting (just one of tons of "civilian" self defense shootings i have shown) below also shows.
and it is UNfortunate for the cop that the shooting happened out of view of the camera, since it would most likely benefit him.

King County prosecutors will not file murder charges against a pizza-delivery driver who fatally shot a University of Washington student.
Prosecutors say the driver acted in self-defense,although Chief Criminal Deputy Prosecutor Mark Larson faulted the driver's decision to fire a legally registered weapon at 19-year-old James Sanderson.
"This tragic case illustrates some of the problems that occur when handguns are used pro-actively in self-defense," he wrote in a Sept. 12 letter to Sanderson's parents.

"The fact that James was a peaceful young man acting erratically due to LSD intoxication cannot be considered as these facts were unknown to (the driver) or anyone else at the scene of the shooting," wrote Larson.
in the above , like ANY self defense shooting, again, the things to be considered are the facts and circumstances known to the user of force, and whether his actions based upon those factors fit the "reasonable person standard". what is ENTIRELY irrelevant are other facts and circs, no matter how compelling, as Larson's quote demonstrates and as even a brief study of UOF case law demonstrates.
anyway, it's a good example of a "civilian" shooting an unarmed civilian in self defense - entirely and not even remotely questionable as justified, however entirely tragic
note to college students: if you are going to take LSD, don't be a horse's ass
A supposedly trained police officer should be held to a higher standard than a pizza delivery guy, not the same standard, and definitely not a lower standard.
Not having the benefit of any facts other than some text, there's no way to judge his actions. But in the generic case: pulling a gun and threatening to shoot an empty-handed naked person who is acting wild is not good police work in my book. It directly creates a life-or-death situation out of a cuts-and-bruises situation.
