Almost 1pm our time here on the left coast!
Alaska?
Cuz here in California, it's 2.
"Alaska: The Other Left Coast"
Public school dropout, can't tell time on them anlog clocks
What means "analog"?
/my kids
I still gots my wristwatch with analog display and no numbers. I is so so old.
People still wear watches?!?
/me
"Who really cares what time it is."
Analog and digital timepieces have different uses. For a wristwatch or a wall clock that you will be looking at all day, analog is better, because it gives you a sense of the passage of time through the day. For an alarm clock, digital is better, since there's only one precise time you're interested in, namely, when the damn thing goes off. It's the difference between a line and a point.
Analog is also better for counting things such as heart beats, rounds fired, etc.
OT, I've still never figured out how an Austrian became the German Chancellor, despite reading Shirer's "Rise and Fall" twice.
Hmm.
Does that count as a Godwin?
Triumph of the Will.
+nice!
He enlisted in the German Army in WWI.
I vaguely recall him having a little trouble becoming a German citizen, even so.
Well, sure. Would you want to let Hitler in the country?
But his beautiful art!!
You know who else was an artist?
Oh, wait...
Does it work like that?
Ah, it is so nice to see a casino owner getting stung by the "If I just throw in another chunk of money, I can win it all back" trap.

FBI gives man fake bomb, arrests him for bomb plot.
LOL! They fall for it EVERY time! LOL!
I've heard so many of these stories that I've concluded the threat of a terrorist attack is vastly exaggerated. If it isn't then how come the feds have to keep making up crimes like this? Are there no real terrorists in the US with real bombs? As the article notes, they themselves admit "the public was never in any danger."
And your point is ...?
It's a legit jobs program for federal law enforcement agents.
Here's a funny thing.
"WASHINGTON (AP) ? A northern Virginia landlord says he thought a Moroccan man arrested in an alleged suicide bombing plot in Washington was suspicious and called police a year and a half ago.
http://news.yahoo.com/landlord.....31871.html
except they may or may not be making up crimes. this is a valid and imo substantially beneficial method of investigation, ASSUMING IT IS DONE properly w/o entrapment etc.
similar to cops setting up decoy cars and when bad guys steal them, they get arrested - no pursuit (since the cars can be remotely turned off), etc
i don't know enough of the facts of the case to know if it was ENTRAPMENT or legitimate. if the former, bad. if the latter GOOD
cops do this with murder for hire, too
informant contacts cops says spouse is in the market for hitman to kill the other spouse
cop acts undercover (and usually entirely on video/audio so that it can be CERTAIN no entrapment is used) and spouse hires hitman
that's certainly much better than allowing the person to hire an actual hitman and going through with the offense (not to mention that hitman won't testify unless given immunity) or doing nothing, since generally speaking, you can't arrest UNTIL the overt act (iow hiring the hitman and exchanging money happens).
this is GOOD law enforcement. i want more of it
i don't want it for drug stuff, because i don't want the drug war in general. and such stings are sadly used in drug enforcement too
but given a real crime, it's a great technique
the ESSENCE of the law is intent.
if the person intends to buy a bomb to blow some shit up, and they believe the fake bomb they are buying is a bomb and they buy it - fuckign prosecute that piece of shit and i hope they get a loooong sentence given due process and a fair trial
it's NO diferent than the example of the man who attempts to kill somebody by shooting at what he thinks is the body under a sleeping bag, but in fact it's just pillows
it's still attempted murder
there's a time and a place for reactive police work, but ceteris paribus, i'd rather cops prevent victimization while bringing the criminals to justice
beats drawing chalk lines
""similar to cops setting up decoy cars and when bad guys steal them, they get arrested - no pursuit (since the cars can be remotely turned off), etc""
It's often not similar to that. A more apt example would be if a cop talks a guy into stealing the decoy car and tell him where the car is and gives him a ride to the car.
Many of the terrorist cases, maybe not this one, the gov talks the person into doing something they were not actually going to do. When you leave a decoy car the thief is rarely coaxed into going there and taking the car. You really get a thief that did it on his own.
if he was COAXED into it, it is BY DEFINITION entrapment
i said, assuming it was done properly and he WASN"T entrapped, it's good police work
the ESSENCE of the law is intent.
That hasn't been true for quite some time.
it's true for most crimes, STRICT liability offenses excluded
ATTEMPT crimes, etc. generally are largely dependent on both an INTENT (iow mens rea) and an overt act towards the completion of what the suspect intends to do
it's true for most crimes, STRICT liability offenses excluded
ATTEMPT crimes, etc. generally are largely dependent on both an INTENT (iow mens rea) and an overt act towards the completion of what the suspect intends to do
Culpability, not mens rea, is the standard for most crimes now. That is not including, as you mentioned, strict liability offenses. Mens rea is on the way out, and has been for some time.
http://www.law.upenn.edu/fac/p.....aentry.pdf
http://www.youtube.com/watch?v=WrjwaqZfjIY
you must have a mens rea as well as an actus reus for a crime to be committed
Someone must have been out of the loop for the last 20 years or so. Most new federal laws specifically discount means rea as a factor, and there are just as many which take old laws and remove mens rea from them. The states are doing the same. Texas for example.
I mean, what's the point in making everyone a criminal if you have to prove that they knew what they did was a crime? Ignorance of the law is no excuse, right(unless you're a cop, of course)?
setting aside your bogus "but the cops but the cops" rubbish aside, coeus IS correct. many crimes, especially on the federal level are NOW "strict liability". no intent needed.
however, in this type of crime, intent is needed.
regardless, the facts are this
i want cops doing this kind of investigation. this is good proactive police work. it works towards harm reduction (iow not waiting for the guy to buy the bomb and blow people up AND THEN investigate), it takes scumbags off the street.
however, such investigations must be done with great awareness of the case law surrounding entrapment
i worked undercover a long time. i am VERY aware of what is and isn't entrapment
coaxing somebody is (essentially) entrapping them
i also prefer when these cases have the undercover use audio/video because then it makes the facts clear, and the entrapment defense can't be used, if they do the investigation right, since there won't BE entrapment if they do it right, and the evidence will be plain as day on tape for the jury to see
i can also state with complete confidence that if an undercover fed or anybody else tried to sell me some kind of bomb, i would not say "cool, i want it!"
it's pretty difficult to entrap somebody not otherwise disposed to it, to purchase a bomb
fwiw, i have heard some (nimrod) attorneys claim that cop decoy cars ARE entrapment when they are left with the engine running , keys in ignition
this ignores the fact that people NOT disposed to steal a car are not going to be overwhelmed with scumbag criminal intent merely because they see a sweet car with the keys in the ignition, engine running
fwiw, a fair %age of autotheft cases i take involve people who left their keys in the ignition. iow, it recreates a real situation. i've seen dozens of cars with the engines running outside stores, etc. and never once felt disposed to steal it. nobody but a criminal would
in cases like this undercover op, the details are KEY as to whether it's entrapment or not.
i can say that the entire time i was undercover, i made over 150 cases, and nobody even ATTEMPTED the entrapment defense, let alone successfully used it.
there were many situations where i did NOT make a specific case/buy the gunz/drugz whatever because i thought it COULD be construed as entrapment and better safe than sorry.
avoiding even the appearance of impropriety is a goal for a good cop
setting aside your bogus "but the cops but the cops" rubbish aside, coeus IS correct.
Cool. Lets just dismiss uncomfortable facts like the plain language results of qualified immunity as bogus. Anything else you'd like to dismiss out of hand?
Hey dunphy, you misplaced all your caps.
So you want to explain to us all how that Police Captain in FL got off after handing out the pictures of the CHL holders, a crime, by claiming he was ignorant of the law? If ignorance of the law is no excuse how come this motherfucker is not in a jail cell? Fuck You and Die in a Fire with your Progeny!
Makes you wonder how they missed that one plot where 20 (or more) actual terrorists were taking flight lessons but not all that interested in learning how to land, even though FBI agents in at least 2 major cities had noticed something was amiss.
19 journalists have quit their jobs in order to work for Obama.
Clearly they were cryogenically frozen on November 3, 2008 so they would still have the youthful energy of the original Obama campaign. Anyone who has read the news in the last four years couldn't possibly lend affirmative support to Obama.
Whhhat?
Huuuh?
Hello?
Look what he did for Michigan! With my help!
What was the question?
OOOOBBBAAAMMAAAAA!!! ::orgasms::
Dana Goldstein at Slate's Double X blog on why homeschooling is incompatible with liberal and progressive values.
http://www.slate.com/articles/.....ives_.html
Must...resist....do....not....read....late Friday....
You'll be drinking soon enough anyway.
If I bash my head against this brick wall hard enough, will I be able to forget that dribble? Ugh.
Duh.
Jesus Christ!:
Nor can we allow homeschoolers to believe their choice impacts only their own offspring. Although the national school-reform debate is fixated on standardized testing and "teacher quality"?indeed, the uptick in secular homeschooling may be, in part, a backlash against this narrow education agenda?a growing body of research suggests "peer effects" have a large impact on student achievement. Low-income kids earn higher test scores when they attend school alongside middle-class kids, while the test scores of privileged children are impervious to the influence of less-privileged peers. So when college-educated parents pull their kids out of public schools, whether for private school or homeschooling, they make it harder for less-advantaged children to thrive.
Shorter psycho:
WHO CAN THEY CHEAT OFF OF NOW?!
Low-income kids earn higher test scores when they attend school alongside middle-class kids, while the test scores of privileged children are impervious to the influence of less-privileged peers.
Maybe because the school curriculum is dumbed down, masking easier academic work with higher test scores?
It often makes kids more intelligent. That's pretty much the antithesis of progressive education.
Why are they arguing for home schooling?
Oh my fucking Dog. That shit is beyond retarded.
It is nice when so-called "progressives" show their true colors, isn't it? Emphasis of collective society over the individual. Slavering worship of the state. The branding of anyone who doesn't agree as stupid, and possibly dangerous.
"Low-income kids earn higher test scores when they attend school alongside middle-class kids, while the test scores of privileged children are impervious to the influence of less-privileged peers. So when college-educated parents pull their kids out of public schools, whether for private school or homeschooling, they make it harder for less-advantaged children to thrive.
Of course, no one wants to sacrifice his own child's education in order to better serve someone else's kid. But here's the great thing about attending racially and socioeconomically integrated schools: It helps children become better grown-ups. Research by Columbia University sociologist Amy Stuart Wells found that adult graduates of integrated high schools shared a commitment to diversity, to understanding and bridging cultural differences, and to appreciating 'the humanness of individuals across racial lines.'"
See, people? It's YOUR FAULT when poor kids don't do well. You need to keep your kids in government schools for the sake of kids who are not yours. Never mind how much better YOUR kids might do away from the mind-numbing, soul-killing drudgery of government education, which is precisely geared to the abilities of the average to low performers. To hell with YOUR kids and what they need.
Ignoring the specious, and quite annoying, confusion of correlation vs. causation there, those paragraphs are still fucking stupid enough to make me want to punch holes in my walls.
It's great that kids who suffer in government schools K-12 have a commitment to diversity, I guess; diversity is just another stupid liberal buzzword, as far as I'm concerned. But how is that more fucking important that actually getting a quality education or learning a skill? Doesn't being a good grown-up also entail acquiring knowledge, wisdom, and skill, not only in your chosen profession, but regarding life in general? Why are an awareness of diversity and cultural sensitivity the supreme criteria here?
Probably because Dana Goldstein and other progressives are fools, I think. Notice that she actually mentions that other people may not be willing to sacrifice their own children's well-being, but fails to address the issue. She can't. Her entire argument rests on utilitarianism and the sacrifice of the individual to benefit the collective. If some smart kids are disadvantaged along the way, so be it. Better everybody be the same than some be better than others at anything. Collectivist garbage.
I really shouldn't have read that. It's too early to start drinking.

Time to make it official and GET PAID, BABY!
OM, MSNBC is blatantly, without reservation, and quite proudly, the Obama Network. "Journalists" don't even fucking pretend anymore. Same with Faux News on the other side of the aisle, except they are somewhat less retarded.
I know you know that. It just felt good to say it.
It's a fucking hopeless case. The Internet is our best bet for actual journalism. Plenty of retards, sure, but at least it's still mostly free.

I would have been shocked had DeWine not jumped ship for Santorum. He's as douchy as they come.
New poll puts Scott Brown 10 points ahead of Elizabeth Warren, finds Bay State independents and voters in general find him more likeable.
http://www.latimes.com/news/po...../politics+(L.A.+Times+-+Politics)
No great feat in itself. The dirty and smelly local wino that rants about the fall of man is more likable than Elizabeth Warren.
to be fair, we have some great winos around here
I really really really hope she loses. Brown is a mushy-moderate, but at least he's not a socialist.
even if Obama wins, a Warren loss would be worth the salty tears.

The undercover cops in the school: how is that not fucking entrapment?
Also, those pigs are an even higher level of scum than usual. Wow, you have a dangerous job, seducing and entrapping 18 year old boys and fucking up their lives. True heroes.
Seriously. That bitch is nothing short of a psychopath.
Agreed, an incompetent psychopath who couldn't even find someone who was actually selling drugs.
No one along the path this case took in the criminal justice system looked at this and said, "We've gone too far. This is senseless." No judge, no prosecutor, no supervisor?
Gotta keep those stats up, I guess.
I wonder why we get no respect?
This is obviously the legislature's fault. I mean, the cops were just doing their jobs, right?
Right!
For the children!
And the poor kid who was the honor student didn't even SMOKE pot.
So freaking despicable.

Yeah, I missed that in my initial read through of the headlines. That is some serious bullshit. The 25 female cop is evil as fuck.

Yeah, that whole eight-years-shy-of-35 thing is going to make it tough.
ageists.
Ageist!
(and who names their kid PETA?)
I'd like to point out that as a natural-born citizen who turned 35 last year, I am qualified to be president and will be voting for myself this year.
It's either you or Gary Johnson Joe M, but I can't make the decision until the coke I'm gonna do in the voting booth hits me (straight ticket Libertarian party to help keep them operational in my state for future elections).
I'm going SMOD all the way. SMOD 2012!
You sound like me in two cycles.
Yes, you cannot take office if you are under 35, but the courts have affirmed people's right to be on the ballot. The thing is she knows she's not going to win. It's to get out a different perspective (like the abolitionists running as the Liberty Party in the 1850s). After all, you're de facto disqualified if you don't raise $500 million anyway.
"Party for Socialism and Liberation"
My contradict-o-meter just exploded.
That's why I'm for the Guns and Dope Party:

OMG!! I am so ditching the libertarian party this election. I LOVE guns and dope. (Not together of course, that would be stupid.)
"From the 1930s, there was a strong labor movement"
Holy fuck. I'm guessing that, in her mind, there wasn't a labor movement until the unions became institutionalized and union leaders assumed control. It's like Hillary's comment that the civil rights movement didn't amount to much until LBJ got involved.
State socialists are a funny bunch.
Hee, hee, hee. I'm running for president. Hee, hee, hee. *bats eyes*
Obama has a 27 year-old daughter?
The party for socialism AND liberation? How do they plan to get both?

That is truly fucking crazy. Anybody involved should be out of a job.
All a police officer has to do is just park nearby and he can pull over and cite each and every person who checks their cell phone for the time as they approach for the newest fad crime, distracted driving.
It's a cash cow, I tells ya!
Don't like it? Call your legislator.
That's the correct line for an apologist, isn't it?
Agreed, an incompetent psychopath who couldn't even find someone who was actually selling drugs.

I took the day off, noodling around with my new Akai MINIAK synth and Focusrite recording interface. Hurrah. The cool think about the Miniak is the ability to sound like a bit like the analog (read Moog, ARP, etc) synths of the 70s. Good, if you're in a Tangerine Dream mood.
Time seems to fly when you're trying to multi-track, find the best sounds, and come up with a lead piece that's half-decent.

Didn't Digidesign buy the Focusrite name? I don't think Focusrite has had anything to do with Focusrite in decades.

Will people ever learn to handle neighborhood disputes themselves. The modern militarized cop is in no disposition to do so peacefully. Note the irony of the cop once being arrested for threatening his neighbors with a pistol while drunk, much less threatening than the claim against Loxas, the man Scottsdale Police Officer James Peters murdered. Of course, there is likely another more nefarious reason that an unarmed man was murdered. More than a few stories involving 'sovereign citizens' being harassed are of recent vintage.
Note the irony of the cop once being arrested for threatening his neighbors with a pistol while drunk, much less threatening than the claim against Loxas, the man Scottsdale Police Officer James Peters murdered.
And it was lowered to disorderly conduct. But this one time a cop got a 20% longer sentence than the average, so it's all even.
I'm honestly more psyched about this than anything else about the near future.
I really hope in 10-15 years driverless cars will be the norm. Imagine how awesome it would be to pop open a beer and watch a movie, take a nap, do some work or read a book instead of crawling through rush hour. It will be good for the environment and save gas money, as cars can drive at the optimal efficiency levels. Drunk driving, human error, etc. will be a thing of the past. No more speeding tickets. Divorced couples with joint custody would never have to see each other, as their car can drive their kids to the others' house and return home on its own. You can completely redesign the interior of the car to maximize comfort. A family could spend road trips playing board games and video games instead of watching the road. Cars would communicate with each other, minimizing the number of wrecks. It will revolutionize the way we think about what is for many of us a big hassle today (as fun as driving can be).
They will still pull you over for no reason and draw your blood, though. Too much revenue comes in that way to stop.
are you butthurt, because like another poster here you were legitimately tried and convicted for a DUI you admittedly committed?
i'm still waiting for the law that lets me pull people over for no reason to draw blood
Uh, DUI checkpoints?
Oh, right you did say "draw blood." So I guess technically it's not what you were lookimg for. It is still a practice that lets leos pull people over for no reason.
When you refuse to submit to the breathalyzer at the DUI checkpoint, they can force you to go to the station where blood will be drawn. So yes, that law does allow them to stop you for no reason and draw blood.
Sorry, dunphy. You're wrong...again.
Awesome new metal!
My better half has a bad NPR jones, so I got to hear part of Science Friday today. It seem that this awesome new (sorta) metal may be a good candidate to replace iron in rebar applications due to it's better corrosion resistance and lack of tendency to expand.

My question is: How did the jackboot who shot the jackboot who was struggling with the supervisor jackboot, know which jackboot was the right jackboot to shoot?
