Reason Writers Around Town: Shikha Dalmia on Ayn Rand and GOP Restrictionists
Last week was Ayn Rand's birthday, the Russian emigre who did more to restore the faith of Americans in America than any contemporary figure, regardless of where one stands on her philosophical ideas. But Reason Foundation Senior Analyst Shikha Dalmia notes in her latest column, if anyone from the current field of GOP candidates had been president then, Rand would have likely been booted out of the country. Why? Because Rand lied and bent every rule to gain entry into the United States.
What this shows is just how intellectually and morally bankrupt the restrictionist case is. Writes Dalmia:
The restrictionist rhetoric is so out of whack with ordinary common sense that most people instinctively recoil from it. They sense that visa violations are victimless crimes that won't usher in anarchy if not zealously prosecuted. Murder is always and everywhere wrong; no one needs the government to make it so. That's not the case with an act like crossing the border, which is legal under one set of policies and illegal under another. Cubans escaping political oppression, for example, become legal the minute they set foot on American soil. But Mexicans fleeing economic oppression should be regarded as criminals forever?

EXACTLY, Shikha. Which is why, as President, I will ensure we install microchips in every Illegal Immigrant to ensure that if they fail to leave this great sovereign nation within 1 week, their heads will explode. Some of my colleagues have criticized this plan, saying my "1-week" timeframe was giving every Mexican a free American vacation. Well, I am a compassionate conservative, and believe that to be fair to all, we should give all the chance to not have their heads explode at any unpredictable moment. Plus, flying bits of skull could possibly harm American babies. A week should give them plenty of time to run through the desert. We are a kind people, but also a firm one. Firm in our knowledge of our Sovereign Sovereigness, which can only be violated after filing many forms, and paying many fees, and then waiting indefinitely. Becoming American is a privilege, and people need to do things the right way, which is our way, which I might not be able to fully explain or understand, but which I am assured protects our nation from hordes of lepers and Sharia law looming outside our borders.

This is why nationality should be solely determined by values, not place of birth. (Although I'm unsure of how such a system would ever be put into place.)Those that want what the US has to offer should be allowed to enter easily, while those that don't could move to Europe (or anywhere else) just as easily. That way, you wouldn't have to radically change a country to fit your needs. Like a welfare state? Move when your 18. Like capitalism? Come to America. Like totalitarianism? Move to North Korea. It's unfair that some people are stuck with miserable lives can't leave a dictatorship because of an accident of birth, yet people who clearly don't enjoy living here can't leave either.
I think as the information age and globalism move forward we will work our way towards something like this. It's just going to take a few generations to do it.

Interestingly, this also touches on what is to me one of the most potentially dangerous elements of Rand's ethical system (and one which I intuitively agree with, but have never really explored all the way down the pile of turtles):
Her position that once force is used or threatened against you unjustly, there are no moral limits on how you can respond.
For example:
If the Soviets are oppressing you, and if the process of applying for a visa might stop you from escaping that oppression, you're entitled to lie.
It's important to note this. Rand lying to gain entry to the US and residence here is not, under Rand's system, an ethical lapse. It's not hypocrisy. It's not making the best compromise possible out of a difficult situation. It's a moral entitlement.
I'm not sure about where that takes you ethically. For example, it may ultimately suffer from a variety of the Proudhonistic fallacy. I'm still thinking it through.

If true oppression gives people the right to overthrow the authorities by force, why wouldn't it give you the right to lie to them?
I suspect Rand's criticism of hippies protesting capitalism wasn't based on the idea that people don't have a right to fight their oppressors. It was based on the idea that capitalism isn't really oppression; to the contrary...
Fluffy, here's why I don't think that scenario is an ethical lapse:
A government that requires a visa for entry to the territory it controls is aggressing against a traveler. So long as she buys a ticket to take her somewhere, her journey is not an ethical lapse.
Now, if the scenario was that Ayn Rand killed some innocent - say Armand Hammer's mistress - to assume her identity in order to sneak past the border guards, that would be a more appropriate scenario to examine.
The question is would Ayn Rand condone that?

The question of whether it's okay to lie for the selfish reason of keeping your freedom is still an open one, but I'm not sure Rand would have had to lie to the U.S. back then. She may have told them the truth.
Ayn Rand was probably immoral at some points in here life. Whatever. Lying for selfish reasons isn't inherently immoral. It isn't forcing something upon someone either, because they have the option to require proof. And any belief based upon someone else's claim without proof is merely an assumption, which is the fault of the one doing the assuming.

It's a horrible policy - although it's better, I guess, than a policy that restricts Jews as much as they restrict Goyem. And if they allowed anyone who wanted to to settle within the territory, I would be singing their praises.
All the right of return means in that a Jewish person gets citizenship upon entering Israel. A non-Jew can apply for residency and then naturalization, just like many other countries. Furthermore, unlike the United States, Israel has a guest worker program.
So there is a restrictionist policy toward non-Jews since not all get approved

In 1925, when Rand immigrated to the U.S., the rules and procedures and circumstances were different, and elected officials acted accordingly. A more fitting scenario would be: "If Ayn Rand immigrated to the U.S. in 2013, and Ron Gingtorum were President..." Not that anyone could possibly know if it would be "likely" that Rand would be "booted out of the country." How many of the millions of illegals who have established de facto residence have been "booted" out? Last time I looked, they're still here and not likely to go back home anytime soon.

Speaking of restrictionism, has anybody seen that ad from a group that calls itself "FAIR" (for Federation For American Immigration Reform) where they argue that less legal immigration would be good for the country because it would boost employment?
I was telling my wife after seeing that ad: "These people are still living in the 18th Century, before Adam Smith."
I suggest that each of them adopt the existence of a hermit; in precluding the possibility of any outside source of production, this is absolutely guaranteed to provide each with full employment. I furthermore encourage each of them to eschew the use of shovels and plows in favor of spoons and butter-knives, thus rendering each of them even more fully employed.
