Yeah, O'Keefe is such a great expositional "journalist" - he lost a lot of credibility with me, when Glenn Beck proved how O'Keefe selectively edited his videos involving the NPR people.
To be clear: I think the government should not fund NPR at all. But the editing of the videos was disingenuous, misleading and fraudulent. They purposely tried to make it look like the NPR guy said things in a different context than he actually said them.
That is the biggest bunch of bull shit, the editing had nothing to do with what was going on, it only made the NPR people look more stupid. Why did all those people get fired or resign form NPR. No there is intense envy form reporters that should have been able to expose NPR and ACORN. Many want NPR around so they can work there. If nothing attempted to stand in his way, closing Gitmo would not be that laudable an accomplishment.
If you read those reports, what you find is a bunch of people that are obviously dangerous but whom it is also very difficult to win a court case against. So what do you do? The easy answer is to just turn them loose. But that was never a political option. The day someone Obama let go from GUITMO kills American citizens is probably the end of the Democratic Party.
The entire GUITMO task force was nothing but one long on the job training exercise for the Obama administration. Through they learned that Bush created GUITMO not out of some evil intent but as a least lousy of a set of horrible options.
Personally, I found the whole push to close the base a PR stunt. The focus wasn't the procedures but the place. Closing it, the detainees were going to be moved elsewhere, and operations would continue there.
But if you're going to make such a big deal about it on the campaign trail and then completely reverse position once in power, before you were either woefully naive, lying or both.
My problem is don't blame the failure to close it on opposition you knew was there. If everyone agreed it should be closed then doing so would be easy.
It was a total PR stunt And if you are not going to close it, why not give an honest answer why? Don't you owe that to your supporters? If he got up and said "look, I thought we could close it but now that I know the whole situation, it is clear we can't and here is why", you could at least respect his honestly. As it is, he is basically telling his supporters to fuck off.

If you don't believe me, go read the reports. But there is no way any politician is going to let them go. So what do you do? The answer is have military commissions with loser rules of evidence but are fundementally fair and ensure we keep the right people. But no, we can't do that. So instead we just keep people forever without any due process. Civil libertarians because of their total refusal to face reality and desire to live in a fantasy world where the federal government releases KSM to prove it is better than the terrorists have done a lot to create this situation. They should have bought on to military commissions from the start as the best of a set of bad options. But instead they fought them and now we have people stuck in jail with no due process for decades.

A significant part of the Congress' objection to US-based trials for Gitmo suspects has nothing to do with the possibility of acquittal: they explicitly state that they're afraid terrorists will try to attack the trial sites.
So that means that you're siding with people who are too afraid to do the one thing they're actually Constitutionally charged with doing: provide a secure environment for the functioning of the courts of the United States.
Frankly, I'm baffled we didn't rendition these guys to some place like Russia or Egypt with the implicit understanding that they suffer some sort of accident. We close GITMO, the prisoners get disappeared to some horribly brutal hole, and we wash our hands of the whole mess.

John, they probably could have if the Bush admin didn't try to rewrite military tribunals for his own ends. The tribuanal process as it had been was not enough to get convictions, the Bush admin watered the the process down to something less of a military tribunal.
Why not just treat them as POWs and hold them until hostilities have ceased? It would still basically amount to indefinite detention unless peace was negotiated with the Taliban and Al Qaeda was defeated
