Why should an employer be prevented from settling on whatever collectively bargained terms he wants? If he doesn't want the workplace to require union dues for non-unionized members, he should take that up during bargaining. Or hell, drop the union altogether.
The point is, a collective bargaining decision is reached through free will by the employer. Which means the terms are nobody's business. He can negotiate however he wants, and concede whatever he wants. It's his business.

You continue to intentionally ignore the correct premise. No one here has an objection to freely associating and collectively bargaining. They have an objection to government mandating that employers MUST bargain with said group.

They're like lawyers -- they're supposed to play dirty. In cases where employers are legally hamstrung and are robbed of their ability to negotiate freely, yes there is a problem. In cases where both parties play hardball and push each other around? Eh, that's how it's supposed to work.
Employers should have the freedom to handle it however they want, but they aren't entitled to an easy or simple process.

I heard Nina Totenberg talking about this case on my morning drive.
Seems to me a valid beef - the things that nutty lady did traditionally are covered under the state's police power, and should be considered along the lines of an assault and battery, or attemped maiming or whatever.
But not a federal offense. It certainly appears the prosecutor is misusing the statute in this case.

Why are the lazy congress critters taking time off when there are pressing fiscal matters, namely the debt ceiling, or are they hoping voters have forgotten about that? Moreover, why is a partial government shutdown bad? Essential government functions will still be in effect, and continuing resolutions, for the most part, make it easier to track government expenditures.
The fact that they're not coming back for a week tells me that a shutdown is nearly 100% certain to happen at this point. Obama and the democrats perversely WANT it to happen because they have convinced themselves it will be a replay of Clinton vs. Gingrich, and they're gambling on it.

Yeah, if you're trying to make the argument that it isn't just about money, that the union workers aren't much better off than other people, and that if Walker gets his way, bureaucrats will be eating dogfood on the streets, bringing a bunch of unionized multimillionaires seems counterproductive. But, people are probably more swayed by the celebrity factor than by logic.

The only reason I pointed this out is to counteract the myth of a "government shutdown". Now, what is listed as "essential" and what I think is "essential" (read: government does way too much) is certainly open for debate.
I'd be happy if Congress adjourned for a couple years and only the above stuff got done -- and the "non-essential" government workers all got fired and had to look for a real job.
That provides a handy list of who shouldn't be fired immediately, doesn't it?

What actually happens is that all the employes who stayed home while the government was shutdown get to come back and get paid for all the days they were off as soon as the new funds are voted.
