How to Homebrew Your Own Caffeinated Alcoholic Beverage or, "Vodka redbull (suck it FDA)"

Reason fan and YouTuber flashadney has created the public-service announcement in the wake of the FDA's ban on caffeinated alcoholic beverages such as, in the immortal words of Sen. Charles Schumer (D-N.Y.), "Four Loko, Joose, and some of the other ones."
Flashadney may not have the prose chops of the father of microbrewing, Fred Eckhardt, but his point is sharply made in a scant 37 seconds.
Here's two Reason.tv vids well worth watching. Up first, it's Four Loko vs. Joose in Buzz Bowl I (spoiler alert: they both lose to Chuck Schumer's crushing blitz of pettifoggery). And then it's time for Beer: An American Revolution.

Well, fair enough... although, my video has an attractive female in daylight and if you skip to the end, the part where she actually makes the homebrew Four Loko is probably only about 37 seconds. That's gotta count for something, right?

I haven't followed the Four Loko nonsense at all. As I understand it, the controversy surrounds the addition of caffiene to alcoholic beverages.
Would someone kindly explain to me how this is any different than the "Dessert Coffees" flavored with liqueurs that one can buy in just about any restaurant?
(Other than the fact that college kids drink Four Loko and yuppie wannabees drink the "Dessert Coffees".)
I got in an argument with a friend of mine over this point. She complained that the government always waits for too long before banning things like four loko when banning a product should be the default until it is proven to be safe.
Unfortunately she was buying red bull to mix with Jaeger when she was making this argument.

I want to come out with an open source recipe, like open soda and open beer. I want to incorporate some version that uses Ilex vomitora a highly caffeinated holly plant and perhaps a version that includes coca and/or khat leaves.
Want to add that there has been similar bs going on with alcoholic beverages that contain poppy seeds and hemp seeds, some products are totally ok, while other product manufacturers have been harassed by the government.
Is Irish Coffee also illegal in USA ?

@NotSure has it right. Reason should produce a clip with two elderly couples, sitting around a finished dinner table in a brew-pub, drinking their Irish Coffee out of those Irish Coffee mugs, complaining about 4Loco and Joose.
While I agree with you, the difference is one has coffee added to alcohol, the other has caffeince added to alcohol. There are plenty of beers with coffee added that are still legal.
Its a stupid distinction, but still a distinction.
Vodka+Red Bull is a much better example than Irish Coffee.
So someone just needs to mix high-caffeine coffee and alcohol in a can and sell it, merely to further expose the FDA's douchbaggery when it is banned.

Four Loko WAS made in PA, its no longer made.
