If You Can Find Your Way Out of ObamaCare's Bureaucratic Maze, Send the Rest of Us a Map
In 2014, millions of individuals across the country are projected to begin receiving health insurance subsidies. But the process of determining who gets those subsidies, and how much an individual is entitled to, is going to be enormously complicated. For a sense of just how complicated, see health care consultant Roger Collier, who lays out the basic steps. The short version? It's a multipart mess, even when it goes well. And there will probably be a lot of boundary cases in which the process becomes even more confusing. What happens when individuals fill out the application forms wrong? Or too close to the deadline? Or when information gets lost in the multiple mandatory paper shuffles between agencies?
If you followed the political process of passing the health care law, though, this shouldn't come as a surprise. Because of the messy politics that helped create it, we ended up with a lot of policy mess in the legislation. Collier notes that the how-to-get-a-subsidy section accounts for about 25 pages in the bill's 2,000 pages. In addition to subsidies for private insurance, states managing the exchanges will also have to determine Medicaid eligibility, and whether (and how) to kick a subsidy applicant over to the newly expanded low-income health insurance program. It's not for no reason that states are publicly fretting over the technical complexity of building the health insurance exchanges.
I know that critics of the law have focused a fair amount of attention on the simple fact that most of the legislators voting for the law didn't read it (though given the use of frequently-inscrutable legislative language, I'm not sure how much good that would have done). I know that Nancy Pelosi's declaration that we'll have to pass the law to find out what's in it has become a mantra for those opposed. But even still, I suspect folks are underestimating the bureaucratic complexity involved in both the implementation stage and the eventual ongoing management of the subsidies, the insurer regulations, the Medicaid program, and the rest of the bureaucratic apparatus. As the Congressional Research Service reported over the summer, the law is so byzantine that it is impossible to estimate the number of new bureaucratic entities that will end up being created by the law. It's a bureaucratic black hole: Who knows how deep it goes, or where it leads? As we go forward, this will likely make things difficult for state officials in charge of running the non-federal parts of the program. And it will probably result in numerous complications for some number of the individuals who end up on the exchanges. It's yet another area of the current health care system that the new law has taken and arguably made worse. For many folks, health insurance is already a serious headache to deal with. But the PPACA just adds new layers of bureaucracy to the system.

Whaddaya know? Millions of Canadians already receive free health insurance. To receive actual health care, however, millions have to leave their country.
Maybe it doesn't need to be repealed. Maybe it will just collapse under the weight of its own nonsense, as no one will be able to figure out to implement anything.
Yeah, I wonder if the law will have the unintended consequence of helping create a shadow health care industry consisting of cash-only payment, medical tourism, etc. that will serve people who are, you know, in need of some more-than-hypothetical health care.

My health insurance is paid for entirely by my employer. I wonder if Obamacare will take that into account (if I still have the same job in 2014, which hopefully I won't) or if I'll get a subsidy anyway. FREE MONEY!
More likely your employer will throw the entire expense on the government and return the value to the shareholders. People argue that employees factor in healthcare for compensation, but none of the employers who are talking about dumping their employee health plans are talking about 20% raises (or 18% after payroll tax).

The problem here is so simple really. It started when someone decided that there was a 'War on Terror'. This would be similar to a 'War on Sniping' or a 'War on Pincer Manuevers'. The US went to war against a tactic.
In WW2 we were at war with Nazism and Fascism--and we fought the supporters of those ideologies at home, and abroad.
We have avoided even the appearance of being engaged with the ideology that is fighting us now.
We are at war with Islam.
Islam is a faith, but it is a faith designed as a political system, a faith designed as a world conquering ideology.

And we did not hide from what we were fighting against.

If you think Obamacare is nuts. then you should see what the genius' in government propose as "significant use" for electronic records for the stimulus $ of $44,000 per doctor doled out over 5 years.
It is total rubbish and has nothing to do with patient care. Such as reporting all details about immunizations to health authorities (no more flu shots in my office!) and having a patient portal so that patients can make appointments directly bypassing my staff. Hell will freeze over first before I allow anyone to have access or control of my appointment book.
We use an electronic record suitable for my specialty. However none of them communicate with one another.
Nextgen does not talk with Allscripts nor eClinicalworks etc etc etc. Total expense for no use.
As an international observer, I'm really not at all surprised at this.
If you wanted to avoid bureaucratic conundrums like the one you highlighted, then what would have needed to happen was the Democrats widely consulting on the healthcare law from Jan 2009 to about Dec 2009, then letting it work its way through the various congressional committees for about 24-36 months before finally coming up with a cross-party solution to the various niggles. If this were the case, then 'Obamacare' would be passed into law some time around March 2012.
However the permanent campaign (which derives from the micro-cosmically small legislative sessions the US congress has) renders this process impossible.
So basically the Democrats had to write a law made mostly of off-the-shelf proposals from think tanks, get it through the house and senate in the face of enormous opposition, making really nasty compromises along the way (eg Cornhusker kickback). All the while fox news is going "SOCIALISM!!! THE END IS NIGH!! THE CONSTITUTION FORBIDS IT!!! OBAMA'S GOING TO KILL YOUR GRANDPARENTS", making Democrats lock down into 'bunker mode', making them deaf to reasonable criticism.
I still think Obamacare will do America a world of good. But we could have had a better law passed, 75-25 in the senate. If it hadn't been a central platform of the republican political strategy to oppose any healthcare reform, moderates like Orrin Hatch, Chuck Grassley, Susan Collins, Olympia Snowe would have helped temper the excesses of, say, Bernie Sanders.

Right, this is the same group who cannot something as simple as getting a letter across town without losing 3.5 BILLION in one quarter.
With something as complex as this losing TRILLIONS will be easy.
In addition to just the maze of bureaucratic processes, what is overseen in Obamacare is the intense turf wars that will be resulting between the 200+ federal agencies and scores of state agencies as they vie for power, influence and budgets. Like the administration in DC has ruled that $800+ million of funds will not be released to Texas for its education program unless they commit to maintaining the higher level of education spend for the next 3 years. Like highway funds will not be released unless NYC changes all its road name signs to first capital, rest lower case.
In the context of health care, it will be the people who will suffer as these turf wars wage and are re-waged with every change in political equations.
