The Play's Not the Thing
Forget performing "Who's Afraid of Virginia Wolff" in Denver, or any other play where the characters smoke. Judge Michael A. Martinez refused to exempt theatrical companies from a statewide smoking ban. The ban is so strict that performers can't even light up herbal cigarettes. He ruled that smoking, even as part of a performance, is not expressive behavior and therefore not protected by the First Amendment.
