U.S.A.F. senior airman comes back from Iraq in one piece, gets shot three times by a San Bernardino County sheriff's deputy. An amateur video shows the cop shooting 21-year-old Elio Carrion from a few feet away while Carrion is apparently seated or supine, trying to talk to him, and obeying his orders. The cop tells him to get up, then shoots him—which suggests "Get up" may not have been an order but some kind of tough-guy challenge. Or he may have been jittery after a chase that ended in a crash. In any event, he's a goober who shouldn't be carrying a badge. Ironically, Carrion works as a military policeman.

I’m pretty sure that at some point we’ll be reminded by an irate poster that the cop is innocent until proven guilty, and the burden of proof is on the accusers. And for the purpose of criminal prosecution I agree 100%, but there are actually 2 issues here:

1) Should he retain a position of trust and authority?

2) Should he lose his freedom?

For the first question the burden of proof should most definitely fall on the cop. For the second question the burden of proof should, of course, fall on his accusers. But unless something rather significant comes out, my hunch is that the cop’s accusers will have an easy time meeting that burden. He will, of course, have a chance to prove us wrong, but I’m not holding my breath.

Yes, you’d hope. But who would want to bet against the official Sheriff’s Department investigation coming the well-worn conclusion that the officer acted within the standards of the Sheriff’s Department (which is probably true, in a rather scary sense) for the use of lethal force. They always do. Admittedly it will be interesting to see if they can pull it off in this case, but I don’t doubt they’ll try. I’m always impressed that no matter how egregious the video evidence there is always someone willing to defend the police action as reasonable under the circumstances.

At any rate, I agree with thoreau that we should keep the criminal prosecution standard separate from the willing to trust with the color of authority argument. Personally I think he should be charged with attempted murder, but regardless of the criminal disposition it should be obvious to all that he has no business being in law enforcement.

It is yet one more example of why the best, most convincing, anti-gun control bumper-sticker ever was “If guns are illegal only the cops will have guns.”

Yes. During his time in Reagan’s Justice Department Alito wrote a memo in regard to a case (Tennessee v. Garner) that concerned a claim of excessive force. A fleeing teenage burglary suspect was shot in the head as he was climbing a chainlink fence (as I recall, the amount of money he had stolen was approximately $10-20) and Tennessee claimed that its policy of using deadly force against burglary suspects was constitutional (the policy was found both in statute and in the particular police department’s procedures). The Reagan administration (you know, the whole “choose life” crowd) argued in favor of the state and Alito drafted a memo in that regard. Whether they wrote an amicus brief I can’t recall, but that wouldn’t be surprising coming out of the Solicitor General’s office. Anyway, the Supreme Court struck down the Tennessee practice as a violation of the 4th Amendment and restricted the use of deadly force. Now whether the memo reflects Alito’s true views is another matter, especially in light of his role as a creature of his client and the distance in time from the time of the case (1984 0r 1985). Indeed, as I recall Alito eventually used Garner as a citation in a case upholding a plaintiff’s right to sue in a suit quite similar to Garner in its facts.

One thing you should never do is depend on Jennifer when it comes to legal analysis.

No, he’s not innocent until proven guilty. He is either innocent or guilty regardless of whether anyone puts him on trial or presents a case against him.

Based on the video footage, I would say guilty as hell. Seeing as the guy he shot was a passenger and hadn’t committed any crime, and he shot four times at point-blank range, I’d go with attempted murder. By the time you pull the trigger the third or fourth time, you’re definitely trying to kill the guy.

Amazingly, I feel I have to agree with Captain Holly’s thoughts here– apart from all the other issues, the cop fired 4 shots with a what, 9mm or .40 caliber pistol, from about 3 feet away, and only managed to wound the poor bastard? WTF? Maybe the cop was on meth– I hear that stuff kills.

I used to be fairly sympathetic to cops in post-high-speed chase situations (and other stressful scenarios) who go a little overboard. But more and more incidents like this (and the increasingly senseless use of tazers to subdue grandmas and 5 year olds and everyone in between, the use of SWAT teams to serve every kind of warrant under the sun, etc.) have eroded that sympathy almost completely.

Low, my unauthenticated hear-say came from a client who said……..the news said the video was turned over to the cops who stonewalled until our local TV stations began showing a copy on the news.

I didn’t see the video on TV (saw that tiny little version on some news site) but my guy saw it on the Big Screen and said it was pretty clear to his Red State mind (no bleeding heart, he) that the cop intended to do serious damage and seemed to deliberately set the victim up. His comment to me:

Y’know, my sympathies always used to lean toward the cops in these cases, even if I thought they “overreacted.” You’re a cop: You chase some bad guy, you don’t really know how dangerous he might be, you tell him to stop, but he won’t stop, so he runs like hell, you run like hell, and you finally catch up with him and knock him down. At this point, your adrenaline level must be pretty high. And it’s because the perp provoked you. If he gives you any slightest bit of resistance after he’s downed, you might not be able to take it very calmly. You might overreact.

But damn! Once the perp is down and giving up and following orders, he can’t give up any more than that! At that point, is there anything he can possibly do avoid being beaten?

Check out this other video. On Monday, a guy sped through the St. Louis suburb of Maplewood. The police box in his vehicle, which he abandons and flees on foot. The cops run after him. They catch him and take him down. Then, after he is down, a bunch of cops just start punching him. One cop walks away from the subdued suspect, then walks back and kicks him for no apparent cause.

i’m completely guessing here – i have no experience with tranquilizer guns whatsoever but i’d suspect that such tranquilizers must be measured in specific doses relative to the recipients weight, etc. so one size tranq dart doesn’t fit all which wouldn’t be a problem if the goal was to kill, but as a non-lethal method, it could certainly be ineffective given an improper dosage.

in short, it would take too long to ballpark the weight, measure a dose, put it into the gun and then fire it..over and over and over and over and over again at point blank range.

Even apart from shooting the suspect at the end, most high speed chases are not worthwhile from a cost-benefit analysis, which is why some police forces have strict rules of engagement on such things– fleeing murderers you chase, but not jaywalkers who hop into a car and speed off. In this case it looks like they were chasing the guy because he was speeding. I am not sure how adding another speeding car to the equation increased the overall safety of the situation, especially when the cops can call ahead for backup, scramble a police copter, or resign themselves to another speeder getting away with it.

Except that minorities and poor are often pulled over by the cops on some pretense, brutalized, have their money stolen, and if they aren’t 100% cooperative, they are murdered. OT and perhaps in a sense “paranoid” here, but 10 years ago I donated $25 to a fund for families of slain police officers in response to one of those calls. Did again it for the next couple years also. Funny thing is, in the time since I donated, I’ve been pulled over three, maybe times for speeding and never received a ticket, only a warning. That never happened to me before; I always got the ticket.

Completely disagree that this is true. People who engage in crimminal activity and then flee from the cops are responsible for all inherent risks to that behavior. Cops are not responsbile for attempting to arrest crimminals.

Stevo, from age 15.5 to about age 25 I’ll bet I got pulled over by the cops 200 times. A ton of moving violations, mostly deserved (some not), a billion equipment violations. I think that younger people are considered easy-pickins. They have less resources to fight a ticktet. They’ll probably just pay their ticket. Less paper work and hassle.

a recent ticket i received lets you know that if you pay $50 more for your ticket – then you are just considered “under supervision” – and the violation will not be put on any record (saving you the insurance rate boost). so yes, they really don’t seem to care, it seems to be pretty much about the money.

also, in illinois a ticket really sucks because it’s sop to take your license. your ticket becomes your license. when you mail in your check you have to include a self-addressed stamped envelope to get your license sent back to you through the trustworthy post office.

this is a real headache when all of your credit/debit cards say “ask 4 id” on the back of them.

I live in Chino Hills, near the Chino border, and this incident occured approximately 10 minutes from my home. Chino Hills is theoretically upscale, for its size, but as upscale cities go, it’s not. Chino is not the most upscale city for its size, but parts of it are as nice as Chino Hills, and the bad parts too have counterparts in Chino Hills. Now, property value nonwithstanding, the affluence of a community does not make this crime any less horrendous. For all the would-be, desktop pc, white supremacists, it is ironic that you support the actions of the deputy, who is African-American. I know that a fictional television show has painted Chino in a bad light, but it is not any worse than Chino Hills in any regard, actually it might be safer since Chino PD did not do the firing, a Chino Hills sheriff did. Really, how much better than Chino could Chino Hills be if it can’t afford its own police department and it shares a school district with Chino, which means it also receives little funding. Also, for the geographically ignorant, Chino Hills borders Diamond Bar (which also has as many bad parts as it does good parts, and is part of LA County), Pomona (which, despite being named the murder capital of California last year, has a very affluent neighborhood, Phillips Ranch, as well as several gated communities and is also in the “scary” LA County), Corona (which some argue is the meth capital of the world and is in Riverside county) and Anaheim Hills and Brea (which of course are Orange county, and are really no different than Chino but do have superior public school funding). I must also write in regards to the foolish person who called Chino, via Chino Hills, the “Bluest.” Anyone who lives in Chino or Chino Hills will tell you that the majority of the population is white, heterosexual and christian, the two gigantic Calvary Chapels within 5 miles of each other, among numerous other Lutheran, orthodox and Mormon churches who all voted “Red,” should attest to that. It is a rare occassion that one does not see “W” or “Bush/Cheney” stickers on most cars. Please, do not speak about things you do not know about, unless you mean to demonstrate the potential one person can have in tarnishing the image of an entire group by example. We, in Chino Hills, are used to this police severity. About 3 years ago, a joyriding 17 year-old was shot in the back of the head when it “appeared” that the car he was driving was rolling back towards the squad car, which was on a pretty steep, uphill slope. There are too many other examples to list. It is a sad day when an American soldier is shot in the back, on American soil, on leave from war by an American he was fighting to protect and the population is still questioning whether or not it was justified. I would like to think that ethnicity is not an issue, but reading the prior comments has filled me with doubt and disappointment.
