Dissenting last month in the landmark free speech
case Citizens United v. Federal Election Commission,
liberal Supreme Court Justice John Paul Stevens lambasted the
conservative majority for “bypassing or ignoring rules of judicial
restraint.” But as Associate Editor Damon Root writes, if the Court
had followed the misguided, pro-government bias of judicial
restraint, it would have provided zero protection for free
speech.
