Defense attorneys are expected to argue that the prosecution should be penalized for leaks

CENTENNIAL — The man accused of killing 12 people in the Aurora movie theater shooting is due Monday in court, where his attorneys are expected to argue prosecutors should be penalized for information leaks.

Among the items pending before the judge is a motion for sanctions against the prosecution filed by attorneys for James Holmes. The attorneys argue that information disclosed anonymously to certain media organizations about a notebook Holmes mailed his psychiatristviolated the gag orderin the case. As part of a hearing on the motion, Holmes' attorneys have said they hope to call witnesses to figure out who leaked the information.
