Marchetti v. United States, 390 U.S. 39 (decided January 29, 1968) protects James Marchetti, who was prosecuted for willfully failing to register and pay an occupational tax for accepting wagers.
The protection of the right against self-incrimination applies.
The question is not whether petitioner holds a "right" to violate state law, but whether, having done so, he may be compelled to give evidence against himself.
Chief Justice Warren dissented. Warren was more liable to be concerned when "vice" crimes were involved, including obscenity.
