Shedeur Sanders Fan Sues NFL for Emotional Distress Over Sanders' Late Draft Pick
Can you sue over that? Why, yes you can! ... But can you win? Not so much.
From Doe v. NFL (M.D. Ga.), filed yesterday:
That claim, I'm pretty confident, is going nowhere. (Claims for "intentional infliction of emotional distress" based on extreme and outrageous conduct are indeed viable in some situations, but they require highly egregious conduct, generally targeted at the particular plaintiff.)
Doe also alleges violations of the Sherman Antitrust Act ("The collusion among NFL teams to influence the drafting process and the subsequent low selection of Shedeur Sanders constitutes a conspiracy to restrain trade and limit competition within the league") and federal antidiscrimination law ("The decisions made regarding Sanders may have been influenced by racial discrimination, violating his rights as a player").
But of course he doesn't have standing to challenge alleged harms to Sanders. And Doe also claims that "The NFL may have engaged in unfair practices by misrepresenting the nature of the drafting process and the qualifications of players," which is too vague to analyze.
Plaintiff seeks a "formal acknowledgment from the NFL regarding the emotional distress caused by their actions and statements," a "retraction of the slanderous statements made about Shedeur Sanders, along with an apology," "[i]mplementation of fairer practices in the drafting process," and $100M in punitive damages "for the harm caused to [Doe] and the impact of the NFL's actions on his emotional well-being."
Plaintiff states that he's unable to pay the filing fees, so the court will screen it to determine (among other things) whether it's "frivolous," which is to say "it lacks an arguable basis either in law or in fact." I expect the court to indeed promptly dismiss it as frivolous.
UPDATE: Prof. Andy Geronimo (Case Western) Tweets: "Not sure it's [intentional infliction of emotional distress] to see your favorite college player fall to the fifth round of the draft, but a claim that you now have to be a Cleveland Browns fan is [plausible]."

I am all for open access to courts but nonsense like this needs to have monetary sanctions imposed.
Since the court can dismiss the action as frivolous at any time it would seem sensible to first unmask the guy, to make it easier to detect a possible pattern of abuse of the courts.
Um, although he captioned the complaint with "John Doe" and also signed the complaint that way, he also included his address, telephone number, and email address in the signature block. Googling will reveal his real name, if any of you care enough to try. (I did so, but I will not post the answer here.) Rocket scientist this guy isn't.

The bigger question is why are we still auctioning off young strong black men in the public square? Granted, it's not just black men, but that shouldn't matter.
When I graduated from college, I got to choose whom I worked for, nobody told me "you are now owned by company X, work for them or don't use your major".
I suppose the desire of the masses for entertainment is more important that basic individual economic freedom.
It's entertainment. Like music and Hollywood, these people all sing for their supper.
As everybody knows, college football players major in football.
Well only 70-80% of the draftees are Black men,but no matter lets just limit the draft to white men to even the playing field.
But its not going to work to their advantage:
"Every NFL undrafted free agent is required to sign a three-year contract with league-minimum salaries in each season."
What kind or ambulance chaser would even take this case?

Why am I unsurprised at that revelation?
When my sister and I were young, we would ask as to any of the wrongs we suffered, real or imagined, whether we could sue, and my father, who was a lawyer, would explain that you can always sue, but you may not win.
I have learned, as an adult, that there are family dinner conversations that do not revolve around calling out imprecision in other family members' comments, but that seems weird to me.
Don't even get me started on how late I was drafted.

Truth is stranger than fiction because fiction has to sound plausible. But I don't think even truth can cover that possibility.

I'm pretty sure it is not, and I don't think he's entitled to proceed as a John Doe. But the case may well be dismissed as frivolous even before the court considers that question.
"may well" seems like an understatement.
What is this plaintiff's name on these comment threads? His lawsuit makes as much sense as much of what ipse dixit assertions are propounded here.

I sometimes think that if a frivolous lawsuit is really, really, really funny, it ought get an offset against any sanctions for the entertainment value it provides the judges.
Let’s just say this wasn’t one of those suits.
