It's Frivolous to Sue a Party for Supposedly Not Living Up to Its Name
From last week's decision by Judge Angel Kelley (D. Mass.) in Kersey v. Republican National Committee:
In this closed case, plaintiff George Kersey, who represents himself, argued that the political stance of the Republican National Committee is inconsistent with its name. The Court dismissed the case as frivolous ….
Kersey tried to appeal, and to decide whether he was entitled to, the court had to consider whether to waive the filing fee (based on Kersey's poverty). No, said the court, because "Kersey's appeal is frivolous":
No reasonable person could believe that his claim, which argues for the Republican Party to change its name to better align with its platform, has any legitimate legal basis. The Court previously explained that political parties have the First Amendment right to choose their own names, ideologies, and candidates.
Seems quite correct for me, as to Republicans, Democrats, Libertarians, Peaceniks & Freedomers, and even the Rhinoceroses.

and even the Rhinoceroses
Or the rhinocerouseseses
If political parties could be sued for not keeping their promises, would the Rhinoceros party be liable or not liable?
Plaintiff sought an order renaming the Republican Party to the American Conferderate Policy because Donald Trump took it over. Which is silly, because Donald Trump is a Yankee, born and raised in the Northeast.
I, on the other hand, seek to compel the Democratic Party to support democracy as I see it. I will let the party keep its name as long as it changes its platform. Therefore, my filing fee should be waived.
The error "Policy" for "Party" is in the original handwritten complaint. The extra "r" in "Confederate" is my own typo.
And the Confederate States of America was still a republic.
I stand with the Silly Party.
Seems like the most blatant case of false advertising since the The Neverending Story.
I don't use the word "hero" lightly, but you, sir, are the greatest hero in American history.
I'm looking forward to an order compelling Germany's Pirate Party to live up to its name. Would certainly make politics on the continent more interesting
It sounds to me like George Kersey doesn't understand what the word republic means.
George Kersey will now sue again because an Angel should not be a member of the federal government under separation of church and state principles.
If you want to dunk on mentally ill people with wildly bizarre ideas on law, you don't really need to look past your own comment section.
The court decided correctly.
That does not mean Mr. Kersey is wrong. But even more so, he should go after the democrat party
The notion that either major party actually stands for any coherent set of principles is pretty hilarious.
I prefer the Publican Party, whose slogan is "Keep Calm and Have a Pint".
Presumably the Re-Publican Party's slogan is "have another pint"
Then there's this - and nobody has sued it on the grounds that there are no monsters in it: https://en.wikipedia.org/wiki/Official_Monster_Raving_Loony_Party
When I first read the headline here, I thought of this: https://lawandcrime.com/lawsuit/judge-tosses-lawsuit-accusing-buffalo-wild-wings-of-misrepresenting-meat-in-boneless-wings-but-plaintiffs-vow-to-pursue-the-case/
I enjoyed the comment from Buffalo Wild Wings: “It's true. Our boneless wings are all white meat chicken. Our hamburgers contain no ham. Our buffalo wings are 0% buffalo.”
Buffalo is the name of the BBQ sauce used on the wings.
And to think I used to draw wings on my black powder cartridge match buffalo targets.
