Castle America: Peter Brimelow Responds to N.Y. A.G.'s Allegations
I wrote in January about a New York trial court decision that allowed the New York Attorney General's office to subpoena VDARE's records related to alleged financial self-dealing by nonprofit directors; I quoted extensively from the decision. Peter Brimelow of VDARE has written up a response to the Attorney General's allegations, and I'm glad to pass it along as a counterpoint to the court decision. I've also updated the original post to link to the response.

There are 50 states, each with an Attorney General with authority to oversee corporations — why is Letitia James always in the news?
It’s this group. It’s Trump. It’s the NRA. All in this one state…
And the other question that comes to mind is why don’t they just dissolve the corporation and form a new one? If she won’t let it move out of NY then kill it. Donate it’s assets to the new one and be done with it.
But it does seem like there are two different sets of laws in this country. While I’m not happy with what the NRA did, don’t tell me that there aren’t left-leaning 501c3s doing the same things…

To be clear, we members have been telling the NRA leadership to move out of NY for years, decades even. You didn’t have to be a genius to know that the NRA was eventually going to come under legal attack by NY, and that being incorporated there would be a dangerous weakness when that happened. They refused to listen.
I wouldn’t be shocked if something similar was going on with VDARE.
I gather changing your “domicile” state is a fairly complex operation, and I gather it’s even more fraught for non-profits, and the state you’re leaving can really make things tough.
I’d speculate that the process would risk the current leadership losing their grip on the organization. Considering that the current NRA leadership went to great lengths to insulate themselves against another member uprising such as happened in Cincinnati, (I was there in Philly when the did it! Pissed me off so much I went out and tore the NRA sticker off my truck, and I haven’t donated a cent to them since.) they’d be highly reluctant to take that risk, the membership would replace them in a heartbeat if we could.

The VDARE Foundation was registered in New York State in 1999, a less Politically Correct time. It is perfectly normal for 501(c)(3) charities to be registered in states other than those in which they have a physical presence [Particularly since the WV site was purchased relatively recently in response to localities of previous attempts to hold events causing cancellations by refusing to provide police protection.] However, New York State has to give its consent for a 501(c)(3) to leave its jurisdiction. (And may retain jurisdiction even after that.)”
What is a “counterpoint” to a court decision where you’ve lost? And why should anyone care?
Well, it’s a response to what the judge said, what the other side said that the judge accepted as accurate for purposes of the decision, or both. And I’m generally happy to allow people to respond — sometimes a decision may indeed be erroneous or incomplete in significant ways, and it can be useful to see the arguments that so assert.
