"Liar, Liar: False Statements and the Freedom of Speech"
I much enjoyed participating in this Federalist Society webinar, which has just been posted; here's the summary:
What can the government do to counter "disinformation" or other statements that it believes to be false? The Supreme Court famously protected some false defamatory statements in New York Times Co. v. Sullivan and extended that holding, in United States v. Alvarez, that the First Amendment prevented the government from punishing a speaker from falsely claiming to have won military honors. Yet other false statements, such as fraud and perjury, may be punished, and recently the question of the government's power to limit false speech has assumed more prominence.
In response to the Capitol attack of January 6, 2021 and President Trump's claims that the 2020 election was stolen, the governor of Washington State proposed a law punishing false speech that was likely to lead to violence. Elsewhere controversies surrounding the truth of COVID-related information have arisen and the Biden Administration's Department of Homeland Security had planned to create a board to counter disinformation. Amid free-speech outcries, the proposal was set aside, but the Administration remains focused on combating disinformation. This program will feature panelists with contrasting views of the government's authority in this field and whether efforts to limit false speech represent a threat to First Amendment values.

Prosecution and punishment for fraud and perjury seem to be well established in the law.
What standard of proof would be required to "prove" that claiming the 2020 election was stolen?
Hey, Eugene. Will anyone be addressing the false statements of the lawyer profession that haul in a $trillion a year and return nothing of value. It is false that minds can be read, that rare accidents can be foreseen, and that standards of behavior can be set by a fictitious character. This is especially true since this character is a thinly disguised Jesus, making that practice illegal in our secular nation. Can you thievin' scumbags please address your own lies?
Then go through the Rules of Evidence, of Criminal Procedure, or Civil Procedure, of Conduct, nothing but ridiculous lies. The biggest lie is that judge decision have any external validation. They are only biases, moods, whims, which side of the bed and hanger. You are a ridiculous profession. You are in utter failure in everything you do. You stink. So the fact that you call yourself a great legal system, that is a lie.
The fact that your lies haul in $trillion makes you a bunko operation. The lawyer hierarchy, to which endowed professorships belong, needs to be hauled in, tried an hour, and sent to prison.
It is a lie, all lawyer decision are garbage without external validation except for enforcement by men with guns. They are the Mafia that have taken control of an empire class government. It is a lie that the national achievements have been supported by the legal system. All have been despite the legal system, not because of it. Our frontier tradition and culture of can do self help and of no legal control has made the US productive.
The panel consists of believers, and it has no dissenters on it. It is a waste of time.

People in this country evidently can’t see the authoritarians’ lies for what they are. I hate to see disinformation go unpunished but really, like Russia who elected Putin and let him amass power, we’re doing it to ourselves.
