Democratic-Appointed Judges Begin to Take Senior Status
The letters to the President began on January 20, 2021.
Prior to the inauguration, I wrote about the prospects of Democratic-appointed federal judges taking senior status. Now, barely a week after the inauguration, the first batch of senior status notifications have trickled in.
Ninety minutes after the inauguration, Judge Victoria Roberts (EDMI) wrote to President Biden that she will take senior status on February 24. According to my calculations, Judge Roberts became eligible for senior status in 2016 when she turned 65 and accumulated 18 years of service. That date was probably too late for President Obama to replace her. But now, the Clinton appointee can be replaced by President Biden.
On January 21, Judge William Alsup (NDCA) wrote to President Biden. He said "I feel it is time for me to 'go senior.'" And he assumed senior status immediately. Why is now the right time? According to my calculations, Judge Alsup became eligible for senior status in 2012 when he turned 67, and accumulated 13 years of service. Judge Alsup hung on for the entirety of the second Obama administration, and all of the Trump administration. (I was very critical of Judge Alsup's DACA ruling back in 2018).
I'm sure there are others. I'm keeping track for a forthcoming paper.

I sincerely look forward to reading whatever your project produces. I enjoy thinking about this topic and agree with the sentiment that jurists shouldn't be talking to reporters. Period.
But I trust, in addition to cataloging all the conveniently timed departures from jurists appointed by a democrat, you'll do the same regarding similar occasions that occurred the past four years among republican appointed judges. It'll be easy, you can start with Edith Clement and Ed Prado from the Fif. And don't forget Michael Kanne on CA7, who I believe you flagged in a previous post. I guess we'll have to stay tuned to see how long he holds on after he psyched out the previous administration.
Both by historical accident and irresponsible senatorial gaming, Republican Presidents have had an outsized control over the federal judiciary. I can’t blame Democrat-friendly judges for doing all they can to counteract that trend.
We can be sure, though, that Biden, having been elected as a moderate, will not take advantage of this opportunity to set things aright.
And Democrats have an outsized control over America due to the importation of tens of millions of mestizos, Haitians, Somalis, Arabs, and other dregs. What's your point?

What would "set[ting] things right" entail, in your view?
Leaning on all older judges to take senior status and appointing 40-year-old hard-left judges in their place.
Why did they wait until now? Aren’t judges supposed to be non-partisan and merely apply the law?
Totally not because they’re unprincipled partisan hacks and activists who decide who they want to win the case and then look for justifications in case law to support the decisions they already made.
I think they figured out what to do from Justice Kennedy's retirement.

I suppose there might be some value in getting more precise statistics about a practice everyone knows exists, and which almost nobody thinks illegitimate. Not much, but some.
