While it is a moot point because SCOTUS ruled it an unconstitutional use of the commerce clause (a fact that would have been interesting to have included), the economic impact today isn't on women purporting to have been raped (even though the DA refuses to bring charges) but on the men falsely accused and subjected to kangaroo kourt proceedings.
Twenty years ago, what position did the ACLU take on this case? As I recall, once upon a time that organization would defend the rights of the accused to the presumption of innocence. Now they are demanding that academic administrators continue to deny due process
In 1994, the ACLU was concerned about the civil rights issues -- but by 2005 they were in support of it.
