Californians Are Revolting Against the Lockdown
Small business owners and sheriffs are leading the revolt against Governor Gavin Newsom's stay-at-home orders, which they say are unscientific and ineffective.
HD DownloadCalifornia Gov. Gavin Newsom has imposed some of the most stringent COVID-19 restrictions in America, and some Golden State residents are starting to revolt.
Newsom's "dictatorial attitude toward California residents while dining in luxury, traveling, and keeping his business open and his kids in private school is very telling about his attitude towards California residents, his feelings about the virus, and it is extremely hypocritical," said Riverside County Sheriff Chad Bianco in a December 4 video announcing that his department wouldn't be enforcing the governor's latest order.
Sheriffs in Los Angeles County, El Dorado County, Orange County, and even the governor's home county of Sacramento, have also said they will not enforce aspects of the lockdown order.
Bianco says county sheriffs are acting within their legal authority.
"We're constitutional officers. Some of the sheriffs believe that it's a constitutional violation," says Bianco. "As a law enforcement officer, we're given very broad discretion on enforcement….We don't have to arrest just because there is a law."
On December 3, Newsom's stay-at-home order barred in-person dining of any kind at restaurants where hospital ICU capacity has fallen below 15 percent, as it has in four out of five California regions. But there's no evidence that the shutdown has stemmed the growth in cases, hospital admissions, or fatalities
Several restaurants in Riverside County are defying the ban, including Marla's Cocina and Cantina in the city of Beaumont.
"I've been playing by the rules way too long….It's getting to a point of ridiculousness," says owner Diego Rose, who says he tried converting the restaurant to takeout-only in March and began losing money every day of operation.
"At that point, you have to make a decision. Do you shut your doors and lose all your inventory and let your staff go in hopes that somebody along the way knew what they were talking about?" says Rose.
California's order to stop outdoor dining has generated outrage, controversy, and legal challenges. A county judge invalidated L.A. County's outdoor dining ban on the grounds that there's a lack of scientific evidence to justify it.
Rose is even permitting his customers to dine inside, though he's spaced out the tables and installed extra ventilation. He also spent about $35,000 converting a previously indoor space into an open-air patio and keeps the restaurant doors open whenever possible.
"At this point with this shutdown, we really have just kind of decided…we are at this point, no longer bending. We're allowing that bending to occur with the individuals," says Rose. "You don't like it, don't come."
He says he's received visits from the health department, alcohol and beverage control, and angry citizens over the past several months, and he's faced threats of fines because his patio isn't COVID-compliant. Yet he remains committed to staying open and was emboldened by Sheriff Bianco's public statements.
But California is reaching record levels of COVID infections. A new, more easily transmissible strain has appeared in the state. And in several California counties, hospitals are completely out of ICU capacity. Yet Bianco says the responsibility doesn't rest with him.
"Making someone wear a mask or close their business has absolutely nothing to do with someone that is overweight, diabetic, unhealthy heart-wise, possibly cancer going through treatments with a weak immune system, then going out into public and putting themselves at risk. That wasn't my fault and nothing to do with me," says Bianco. "But no one wants to take personal responsibility. It's better if you blame someone else."
There is little evidence that in-person dining, particularly outdoors, is a major source of COVID-19 spread, a fact that state health director Mark Ghaly appeared to admit in a December 8 press briefing.
The ban "really has to do with keeping people at home, not a comment on the relative safety of outdoor dining," said Ghaly.
Research out of New York City found that 74 percent of COVID spread happens in households.
Rose, who once worked as an emergency room nurse, says that the responsibility for stopping the spread of COVID to the vulnerable doesn't rest with law enforcement or business owners.
"Every individual has to keep and maintain the amount of risk they're willing to assume. And that's inherent to the individual," says Rose.
California's stay-at-home order prohibiting restaurants in counties with available ICU capacity below 15 percent remains in effect.
A judge in San Diego county ruled that restaurants there can remain open pending a ruling in an ongoing lawsuit, and San Bernardino County has filed suit against the governor in the state's Supreme Court to keep its businesses open.
Rose says he hopes more restaurants ignore the order and reopen.
"I'm not worried about my business as much as I'm worried about my country. If I have nothing to open back up to what's the point?" says Rose. "I hope more and more people get on that kind of a bandwagon to protect each other's rights….We have to do something."

There a more than a dozen parallel universes to compare CA with. By doing regression analysis of infection rates per 1 million population to find the correlation between restriction introduction you can determine restriction's effectiveness. In all European countries the only restriction with a strong correlation is limiting gatherings to 10 or less. Mask mandates have almost no effect on stemming infection rates (2%).

Those ICU capacity figures smell to me. I can easily imagine that hospitals never build excess capacity of any sort, especially the expensive ICU variety, and that they always try to keep as many patients as they can, because patients are revenue and excess capacity is, by definition, excess and unused. Flattening the curve kept normal patients away who were not replaced by COVID patients, and left hospitals with fewer overall patients, reducing hospital revenue. I bet they learned and now keep as many patients as they can, boosting revenue, and leading to false figures of ICU capacity.
How elastic is hospital capacity? How easily can they keep patients a little longer in easy times because there are fewer emergency patients waiting for their resources, and kick them out a little sooner in rough times when the rush of emergency patients needs the resources more?
More elastic than you might expect, though the supply-side elasticity will not show up in these measurements (we spun up a ton of new ICU beds in the spring, but they were unofficial and shuttered after the peak). But the incentives are such that we try to get patients out ASAP since that increases margins, so the excess capacity through improved throughput is pretty minimal.
Missing part of your analysis: COVID patients as a rule greatly outstay their benchmark ALOS, so the reimbursements rarely come close to covering costs.
At a high level, acute care is an arbitrage game. This is one of the reasons why everyone scrambles for surgical cases - much easier to predict outcomes and get patients out the door. Medical cases are more likely to be... stubborn.

The problem here is that for the most part the hospitals stopped building ICU’s and went all in for outpatient and urgent care. In the largest medical center in the world, 5 major hospital groups crammed in here mine was the only one to add ICU space, barely. And that was only because we expanded into OB in a big way so we needed more NICU beds. As you have noted, there just isn’t a lot of money in ICU’s. For us the big money makers are Pharmacy first, then Radiology and then outpatient clinical and urgent care. We had been seeing good returns on minor and day surgery but that was for the most part shutdown last spring.
The Feds are paying for COVID care; that is a huge incentive to classify a patient as a COVID patient even if COVID isn't why the patient is getting hospital care.
The bed numbers are based on the excess beds after normal capacity. In the end, a 0% capacity is still fucking serious, as 0% excess beds is equivalent to 0% total beds, but the metric is still not total beds.
As much as I hate Newsom, the hospital capacity numbers are very serious in this state. Which is incredibly ironic because the state spent the past twenty years consolidating hospitals and closing down local hospitals. Not as a deliberate policy, but as a side effect of state and national health care policy. When only big centralized hospital systems can exist under the cronyist healthcare system then only big centralized hospital systems can exist.
For example, my home county has had no new hospitals or hospital expansions in my lifetime. But my local hometown hospital is gone, and several other local hospitals are gone. Only two hospitals remain, and they are no larger than they used to be. Meaning most people get airlifted out of county. Which makes our county capacity numbers look extremely dire. They are dire, but it's not the fault of the virus, it's the fault of the system that allowed for zero excess capacity.
Even in the big city where I now live, there are two major hospitals that have been shuttered for a decade or more. There is a new hospital near me, but it was a replacement for an older hospital that has been torn down. When I was hospitalized for a minor stroke two years ago, I literally got the last non-ICU bed in the hospital.

While I am pissed at the irresponsible attitudes that the Riverside County Sherrif promotes, like the fact that law enforcement in Riverside often don’t wear masks, I agree with his pushback over the closing of businesses. The whole situation is messed up. I’ve seen local businesses go under in droves. Real people losing their livelihood. But that doesn’t mean we all get stupid either, which also doesn’t help the businesses. This polarization of politics brings out the worst from both sides. Plus, the younger generation are still going to parties, so this crap is going to keep spreading.
I can't say for sure, but I strongly suspect that if more young people had gone to parties, concerts, clubs, etc. this past summer, things would be less bad now. If the lockdowns and stuff had any effect it was just to delay spread, not stop it.
Which is ironic, since that was the original intent behind "flattening the curve", except now they have disowned that to the point of calling everyone who says that a Trumpian skeptic science denier.
The politics is media driven. As the media changes its narrative the politicians change the rules to match.
At first it was a two week shelter in place. Which is technically still in place in California. Then it was three months to flatten the curve. In both cases we succeeded. He slows the spread and flattened the curve. But every new uptick caused new media panic and it kept getting extended and locked down tighter. California is not the third strictest state (after New York and Hawaii) yet it has the highest numbers. The highest infection rate in the state is fucking Lassen County. Huh? It's got a population density of zilch. Why? Probably because of the high security prison there, plus a single tiny hospital to skew the bed count.
We're never getting out of this because there is literally no criteria or metric to get out. Newsom will keep stuff locked down until he gets bounced from office. Which is two more years. He's drunk with arbitrary rule.

And that's statewide, due to OSHPD changes to the seismic requirements for acute care facilities. Pretty much every hospital in the state has been rebuilt in the last 10 years, and many non-compliant buildings have been abandoned for lack of funding to tear them down. Just for perspective, an acute care tower costs in the hundreds of millions.
It's part of how we keep the cost of healthcare under control.
In CA in the last 20 years hospitals closed for two reasons 1) high percentage of unreimbursed care 2) the facilities didn't meet seismic resistance standards & the owner of the facility couldn't economically justify the millions to upgrade or replace. If the facility was built before 1980 it was not feasible to strengthen.
Newsom, yesterday, told hospitals in CA that they would be taking in COVID patients if they had free beds. Mercy hospital in Redding received their first patients yesterday. This may suck for my mother-in-law, since it seems likely her heart procedure, since it is deemed not-immediately-life-threatening to go without, will likely be postponed indefinitely. Such is life in the "Golden State."
hospitals are built with minimal number of dedicated ICU beds, but a;ways have spaces available, normally used for other types of care, that are readily convertible to ICU spaces at minimal cost and time. So the Gabbling Nuisance is almost certainly counting ony standard dedicated ICE spaces, not easily/quickly availble ICE stand-in spaces that are fullly funcitonal when needed.
Furthe,r I'mnnot certain California are doing this, but I know for a fact that in the two states north of that one that the bed counts are rigged.... friend of mine is a nurse at a large hospital in a major ciity north of California. SHE tells me that fully one fourth of availble beds are taken up by... HOMELESS who ended up in hospital for whatever reason, but doe to policies in place, cannot be released, even though fully healted of their admittable issue, but since they don't have a "real place" to which to return, cannot be just allowed to walk out the door. So taxpayers in those two states are footing thb ill for homeless to remain in hospital long after a "homed" patient woud treturn home. She is furious about it, knowing those people can easily walk out of the hospital and reutrn to whatever life status they had before admission to hospital. And SHE has to take care of them when needy patients need her time and care. elcome to politics, honey......
Apparently, Newsom has decided to extend the ICU bed emergency northward in the state by mandating the acceptance of cases from the overloaded southern regions to the north, which will overload those area hospitals as well. Thus, an emergency in LA becomes one in Eureka.
Too bad for Newsom that he has not got even the thin veil of authority to send them to Nevada, Arizona, or Oregon.

Here in the People's Republic of NJ, our People's Duma passed a bill to help restaurants stay open. The bill would have allowed bars and restaurants to use portions of their sidewalks and parking lots for dining. The bill passed unanimously.
Phuckhead Phil Murphy veto'ed the bill, causing even more misery to our small businesses. This man is a phucking incompetent. Even worse, the People's Duma will not attempt an override.

Combine the eastern halves of WA and OR together with the northern 1/3 of CA into one more flyover state. It will be reliably Democratic within a decade.
About half the residents are middle to right. But the insane gerrymandering and districting means very few of them get to live in middle to right districts. Hence the supermajority.

They're starting to come back, but not because of anything the Republicans have done, but because the Democrats shifted to radical Wokism. Words like Latinx really piss them off. They're shifting to Republicans, but the party is still dying.
Still dying because they've completely lost the youth vote. That's what you get when you have fifty years of Democrat run public schools in charge of your children. How about 10 months? California's been in lockdown since March. The USA has 50 states, with probably 10 different levels of lockdown, none of which show much correlation to the case counts or death rates.
This is a very poorly researched article. Have you ever heard of mathematics? Take a look at the difference in covid rates and hospitalizations in compliant vs. non-compliant (Republican-leaning) counties. You simply should not be writing on this topic if you cannot do basic math and science. Of course people are upset. And of course outdoor dining is a problem. Of course we are about to get a much more transmissible virus. Of course you don't care if you die in a parking lot.

The mathematics is regression analysis to find correlations between restrictions & infections. Comparing hospitalizations per 1 million population can't logically be used to compare states; because, there is no logic in hypothesizing that any restriction effects hospitalizations rates. The only thing that can logically effect hospitalization rate is demographics.
P.S. Red states typically have lower infection rates than places like LA LA County, NY or NJ.
I was in La Jolla over the Christmas to see family and was delighted to see restaurants pushing back against the Newsom's inane dictates. Had a great dinner at the UTC mall and quiet breakfast on the patio in La Jolla. Appreciative of the owners, managers, and staff and tipped 50% at both locations!

Everyone gets infected outside. But the transmission rate is higher in the house because everyone stays there longer and no one wears masks inside.
In normal times Californians would be stuck in traffic for 3,4 hours going to work and coming home. The kids would be spending 8 hours at schools or learning academies, away from the adults, malls and beaches.
Lockdown basically says "Now all 38 million of you, including Latinos in stacked urban zones, must all stay at home all day, but here are like 3 places you can still go to if you wear masks. But we won't actually make you wear masks that actually work. Yeah keep on wearing that thin ass blue masks"

The masks are to prevent you from flinging your spit in ppls faces while you talk to them, the face masks prevent you from getting spit in your eyes and face from other ppl and prevent you the same way masks do, the hospital grade masks actually protect the wearer
Regardless this is a consequence of democracy, democracy will always try to take precautions because ppl are generally cautious, I mean obviously good to have an opinion but come on make a consistent argument then maybe ppl would take you more seriously and you will get a better outcome through civil processes

Science has determined that transmission rates are higher indoors. Home is indoors. Lockdown prevent family units from being spread out throughout the time of day and herds them to the locations where they can go with masks.

I remember when SARS-Cov2 was first being discussed in late January and early February 2020 (in the early days before anyone knew about the fraudulent and incompetent Covid actors' responses) people like Chris Martenson were concerned because, historically, even a normal flu season causes many hospitals in many places to run out of ICU capacity. Hospitals simply often operate with ICUs at capacity in normal times. Fortunately, since Covid, people no longer contract flu illness. 😉 It's all Covid! 😉 So ICU bed availability is still about the same as usual.
That evidence would be pretty easy to obtain in the UK which is sequencing a large number of tests. After identifying ths infected with the new strain one must then measure the rate of shedding live virus. Comparing that distribution with the distribution from people infected with the original strain would give you the rate of incresed transmissibility.

Based on recent statistics (1 Jan, 2021), CA has the states' fourth highest COVID-19 per capita hospitalization rate. More ominous, we have the HIGHEST percent of COVID-19 patients occupying our hospitals (32.9%).
But wait. For months, CA has had among the most stringent lockdown regulations in America. Shouldn't that Draconian lockdown have resulted in much lower COVID-19 figures for CA compared to the other less restrictive states?
Shouldn't frequently criticized Florida, which has far fewer mandates, have had worse results? FL has a much older, more vulnerable population than CA -- 15% older, on average. FL has a significantly higher population density than CA -- 51% denser.
Plus CA people are healthier than Floridians. CA has VERY low obesity and smoking rates. California is the fourth best state on obesity (Florida is 17th), and second best state on smoking (Florida is 20th).
Yet in spite of all these CA advantages, the Golden State per capita COVID-19 hospitalization rate is 81% higher than FL. In CA, the percent of hospital beds now occupied by COVID-19 patients is 2.4 times higher than FL.
Remember, the lockdown states are supposedly driven by science. The less restrictive states (mostly GOP controlled) are supposedly ignoring the scientific facts, needlessly killing people. It seems to me that progressive pundits -- champions of (PC) science -- got it backwards.
IMHO, the leaders of the oppressive states are driven by the overwhelming compunction to be in charge -- to solve the COVID-19 with endless (and ever more harsh) lockdown restrictions. Especially so in Democrat states where the governors assign themselves unlimited dictatorial powers.
