Is It Time to Abolish Three Strikes?

The Return, which debuts tonight on PBS, is a documentary that follows the journeys of several former California prison inmates as they re-enter the world after serving decades behind bars under Three Strikes sentencing. Three Strikes passed in 1994 in the state and requires a mandatory sentence of 25 years to life for a third felony conviction. California voters modified the law in 2012 by passing Prop 36, which allowed for the resentencing and release of convicts whose third strike was a non-violent, non-serious offense. Since then, the courts have released more than 1,500 California inmates from prison.
Reason TV's Zach Weissmueller sat down with Katie Galloway, who is one of the film's two directors, and Kevin Bilal Chatman, one of the film's subjects, who served 11 years for dealing drugs to an undercover police officer. Under Three Strikes, Chatman faced life in prison but was resentenced after the passage of Prop 36.
Galloway and Chatman discuss the role that Three Strikes has played in overincarceration, what "tough on crime" laws get wrong, the surprising politics of prison sentencing reform, the difficulties of transitioning from prison to civilian life, and what other states can learn from California's experiment in resentencing.

If felonies were limited to things like rape and murder, as in serious crimes with actual victims, then I might be inclined to agree with Three Strikes type legislation. However...

Actually, the vast majority of cases are still state cases. States can be just as unreasonable and excessive as the feds.

I have NO PROBLEM with 3 strike rules, provided they are for "real" crimes, defined as crimes with an actual victim whose rights have been violated.
Once, sure, a mistake. Twice, okay, a mistake and maybe you were caught up some inadequacy of the system. 3x? You're a shitbag fucking criminal with no place in society.
I'd be a lot more OK with the 3 strikes laws if the only felonies were serious crimes with real victims. But I still think it would be better if it were an option in sentencing, not an automatic thing. Better to leave open an avenue to avoid unjust sentencing, even if such cases are very rare. I don't think any mandatory minimum sentences are a good idea.
I agree with that. Every case based upon the particular circumstances.
But I'm ALL FOR progressively increasing sentences (to include throwing away the key) based upon the accused's likelihood of continuing to harming others. Some people are, in fact, unfixable.

I am with FDA on this one. It is really a stretch to argue that there are not people who have proven to be irredeemable.
If the question is one of demarcation, well that is the point of leaving it up to a judge instead of a mandatory three strikes rule.

As you pointed out, burglaries have victims whose property rights have been violated.
I recently read an article on some site that detailed how a judge was trading much lighter sentences for favors (donations). The argument was that mandatory minimum sentencing would make it harder for judges to do such a thing. If I can find the article I'll post the link here.

Actually, that was a pretty mild take for the extreme sarcasm version. I am quite certain you could drum up a large number of people with much more extreme views than that.
Three strikes laws come from the same place as laws mandating harsher penalties for crack than for powder cocaine. They are demands from members of beleaguered communities for help.
The drug dealers they're talking about aren't like the neo-hippie college roommate you buy drugs from--they're generally gang based, with all the joy that entails.
Now, the pendulum has swung, and a new generation of activists sees inmates only by color, and creates injustice out of something their predecessors demanded.

Activists aren't "creating" injustice here. There is actual injustice happening. If these drug dealers are violent criminals, then convict them for the violent crimes they commit.
The three strikes laws were definitely at the behest of community activists, among others. There were definitely cries of racism over drugs and violent crimes in minority communities. There were also scared suburbanites who did not want to see their children impacted by violent gang culture. The three strikes laws were in response to a perception of a revolving door prison system. Whether it was true or not is another matter, but the operating narrative for the entire country at the time was that criminals were getting off on technicalities, serving short prison senses and getting probation only to return to the streets and reoffend.
Fast forward to a world where people are getting life sentences for a minor shoplifting conviction. One-size-fits-all is definitely a problem. But we removed discretion from the system in response to the notion that discretion was being abused.
In California, shoplifting less than $900 is not even a felony.
And of course, the stores have stopped trying to prevent it due to liability.

the idea behind "Three Strikes" is that there's a limit on how much violent crime society will tolerate from a person,before they're declared unfit to be loose in society,and imprisoned for the rest of their life. NO MORE endless pages of crimes committed,and the criminal still being let back into society,just to commit more crime. if they didn't learn from the first two incarcerations,the 3rd time,they go in permanently. they've proven they can't live in civilized society
