The Brothel King: Dennis Hof on Prostitution, Spitzer and Weiner, Wild West Libertarianism, and "Pimpin' for Paul"
"Nevada's the last of the live and let live states," says Dennis Hof, the self-described "Brothel King" and owner and proprieter of Nevada's Moonlite Bunny Ranch, made famous as the setting for the HBO documentary series, Cathouse (2005-2008). "I don't care if you smoke weed. Don't bother me because I have a safe full of guns and I'm in the sex business."
Reason TV's Zach Weissmueller sat down with Hof in his brothel for a wide-ranging interview about sex, prostitution, black markets, politics, and more.
Hof acquired the Moonlite Bunny Ranch in 1992 and systematically pushed it into the public eye through a blend of showmanship, attention-seeking, and media outreach he calls the "PT Barnum/Andy Kaufman" school of marketing and publicity. In fact, he claims that Andy Kaufman gave him the initial idea to buy the Bunny Ranch when they partied there together in the late '70s.
"In about '78, Kaufman said, 'Dennis, let's buy this place and make it our den,'" says Hof (1:30).
Since then, Hof has gone on to acquire six more brothels, giving him a huge share of a national market that only includes 17 total brothels. This is because Nevada is the only state in the U.S. that has legalized prostitution, and only in counties with populations of less than 400,000. This, of course, rules out Clark County, where Las Vegas is located.
"It's illegal in Las Vegas, and look what you've got," says Hof. "You've got 2,000 girls a month being arrested. Lots of guys being arrested, lives being ruined… Las Vegas is the sexual cesspool of America." (24:20)
He also points to the remarkably high rate of HIV infection among prostitutes in Las Vegas. By contrast, he says, under the state's regime of mandatory STD testing, there has never been a documented case of HIV among licensed workers in Nevada's brothels.

I agree with you. Legalizing prostitution in a few select places and run by a few select cronies is worse than criminalization. At least criminalization doesn't create a government protected monopoly.

You raise some important points, Maggie, and I had similar concerns going into the interview.
I raised this objection with Hof at around the 21:39 mark. Not saying you'll be satisfied with his answers, but make sure to take a look nonetheless.
Totally not blaming you, Zach; I just resent the poster boy for crony capitalism representing himself as a champion of the industry while lying about the small entrepreneurs.

Which brings up a different problem in regards to legalizing this. Just like with marriage and pot, too many people see "legal" as requiring a license, certificate, or some other bureaucratic bullshit that makes it not really legal at all.
Freedom means asking permission and obeying orders.
So to be free to do something, one must first get permission in the form of a permit or license, and then obey regulations pertaining to that permit or license.
Anything else would be chaos and anarchy.

It's funny how folks equate Anarchy with chaos. Oh no, if there weren't government and taxation armed individuals will be running around stealing half of everyone's income!!! If someone came in your house, robbed you of half your things and threatened you and your family with violence if you didn't pay up every week..... that would be chaotic. Yet those same folks don't complain about government which does this on a daily basis.
It's not perfect, but it's got to be at least a little bit better than sending them all to jail.
Read the comment that Maggie McNeil links to above. What the "Nevada" system is, is letting a few people get rich providing the service legally but sill leave a huge black market because the legal brothels will never meet the demand.
Of course there has never been a confirmed case of HIV, all of the hookers who are engaged in the kind of conduct that will give you HIV never work for the legal whore houses. All Hof is saying is "we only get high class hookers at my legal establishment".

I will add, if HIV positive was a reason for a state solution, then why not test everybody whether they like it or not? Loads of non-prostitutes have it too, you know.
Everyone drives a car, but I could see where you might want professional drivers to be a bit more safe.
Like I say below, if you had a licensing system that amounted to a state certification that the hooker didn't have an STD, that would work. But that wouldn't allow this guy to get rich using the government to go after his competitors.

Everyone does not drive, and nobody should be required a government license to drive.
If you want to drive my truck, you have to demonstrate to my satisfaction that you can do it properly, no matter what sort of paperwork you got from your DMV buddies.
Besides, someone still needs to demonstrate to me that the DL has any value whatsoever. A majority of vehicle accidents are caused by licensed drivers. If only they were held to pay for their damage with some other threat beyond "we will take your license" that is not needed at all to actually start and operate any vehicle anyway.

The problem with prostitution is that there are so many women who do it alone. How does one know they are safe? The government giving a bill of health in the form of a license would give people a way of knowing. That would do some good. And the harm of granting a license is pretty small.
Indeed, you wouldn't need to make it a crime to be a hooker without a license. You would just provide the license as a way hookers could show their customers they are safe.

There already is such a thing; it's called a "review board". Any escort who gave somebody an STI would find herself totally without business almost overnight. We already have STI rates literally a tiny fraction of the general population (some studies say 1% or less of the sexually active gen-pop rate); it's hard to imagine how it could get any lower by requiring women to be on a "please harass me" list.

If you can't even admit that there is anything the government could do effectively or even try to mention a reason why it wouldn't work in this case, even though it has in others, then you are a fanatic.
This is why no one listens to Libertarians and thinks they are kooks. When you response to "hey, lets just make it so any woman who wants to can take a monthly STD test and get a license to be a prostitute" is "God lord I am done" like it is no different or better than full on criminalization, no one outside the believer hive is going to listen to anything you have to say or think you are anything but a nut.

With legalization, there is plenty of incentive to make sure the product is safe. This can be something as simple as a guy like Hof making sure his girls are healthy, that they have regular access to a doctor, etc. Doesn't have to be a govt bureaucracy.

Licenses don't do that. You couldn't prevent disease transmission with a license, anymore than prevent bad food because of twice a year restaurant inspections.
State licenses limit the number of people in a [profession and generate revenue for the state, and that's all.
If Obamacare doesn't already require testing for HIV as part of an annual physical, I'm sure at some point it will.

All good right up until about 21:57 when he showed that he's only about freedom for women when they are barred from independently competing against him. But, he's right when he says that many women who advocate decriminalization/legalization do not want any regulation of their profession even though they argue that regulation is necessary for other professions. Add they get really touchy about having that contradiction pointed out to them.
The bottom line for adult women is that they should have the right to decide on what terms they are willing to have sex. If their business creates a parking problem or violates the terms of their lease, that's an independent issue that should be resolved as it would be with any other business.
