As ICE Agents Hide Their Faces, ICE Attorneys Are Hiding Their Names in Immigration Courts

Immigration and Customs Enforcement (ICE) has faced criticisms recently for agents wearing masks to conceal their identities while making immigration-related arrests. Now, immigration judges are withholding the names of lawyers representing ICE from public record, The Intercept revealed this week.
"We're not really doing names publicly," said Judge ShaSha Xu, an immigration judge in New York City, during an immigration hearing in late June, reports The Intercept. But only the names of the attorneys representing ICE were omitted, shocking the two lawyers representing immigrants in the courtroom. One immigrant's attorney pushed back, stating the record would be incomplete without the ICE lawyer's name. But Xu refused to provide a name, citing privacy concerns. Both immigrant attorneys were directed to send a private and confidential message to the ICE attorney via the Webex platform used for the proceeding. In another case in July, Judge James McCarthy, also a New York immigration judge, referred to the ICE attorney as merely "Department" with no objections.
Immigration courts are part of the executive branch and differ from courts run by the judiciary in important ways. Immigration judges and attorneys representing the government are employed by the Justice Department and the Department of Homeland Security (DHS), respectively—raising concerns over their susceptibility to political pressure. While immigrants have a right to due process under the Fifth Amendment, their rights are limited in comparison to those in criminal court. Immigrants have no right to a court-appointed attorney, except in rare cases, and must represent themselves unless they hire an attorney. Immigration courts are also less transparent than county, state, or federal courts; procedural rules block the public—and immigrants—from accessing legal filings and valuable case law of previous immigration hearings.
But even with a reputation for lacking transparency, the New York immigration judges' actions are unprecedented. "I've never heard of someone in open court not being identified," Elissa Steglich, a law professor and co-director of the Immigration Clinic at the University of Texas at Austin, told The Intercept. "Not identifying an attorney for the government means if there are unethical or professional concerns regarding [DHS], the individual cannot be held accountable. And it makes the judge appear partial to the government."
"It's up to the judges whether or not they want to [withhold an ICE attorney's name]," Judge Shirley Lazare-Raphael, a New York immigration judge, told The Intercept. She's heard that some ICE attorneys believe it is "dangerous to state their names publicly."
Since President Donald Trump took office, pressure to deport immigrants has escalated, bringing many due process concerns to the forefront. While much of the focus has remained on masked ICE agents indiscriminately arresting noncitizens to meet the Trump administration's quota of 3,000 immigration-related arrests per day, pressure has also been mounting within the immigration court system to process more deportations, quicker. New immigration protocols have resulted in a record-high 11,000 asylum cases closed in April, with a denial rate of 80 percent—up from 62 percent over the last six months. Once asylum is denied, those without another legal means to stay in the United States are deported.
Although no formal rule or directive has been put in place to hide ICE attorneys' names from the public, favoring state actors' privacy concerns over the rights of the American people to hold their government accountable will only degrade the public's trust.

ICE agents are being doxxed. And cops wearing masks isn’t unusual. 25 years ago a bunch of them were running around busting some perps right outside my office window. All of them wearing ski masks with badges hanging around their necks.
But the left always has to pretend following decades old laws and olive procedures is somehow new and illegal. Of course, they have to lie. It’s all they have.
What's going on is resistance to federal enforcement immigration (I understand objections about the feds forcing the states/cities to help them do the feds job) that includes Democrats encouraging and funding anti-ICE protestors and encouraging violence against ICE.
It means people in government have put targets on the backs of ICE agents. Imagine being one.
In a normal world, people in government follow the law, or get it changed rather than encouraging violence to get their way. And state and local officials are usually happy to get rid of criminal aliens because it's safer for the community.
Imagine people trying to enforce the law and are under a wave of violence against them not wanting their identities known to protect themselves and their families. Unthinkable.
Nothing says 'Land of the Free' like masked federal agents grabbing suspects off the street, denying the detainees attorneys, and trying them in a kangaroo court while hiding the identity of the prosecuting attorneys. That's something you expect in Russia or Iran. Now it's normal here in the U.S., and Trump defenders are lovin' it like a McDonalds commercial.

I back the blue when they’re right. In this case, as you very well know, the cop didn’t know she was unarmed and from his vantage point he couldn’t see the crowd. He just saw someone crawling through a smashed barricade while hearing chaos on the police radio. So based upon what he knew based upon what he could see and hear, he did what he thought was right.
As long as the cop feels he acted correctly shooting into a crowd he supports them.

I'm sorry, but after the Prarieland terrorist attack on July 4th, I cannot fault any ICE agent for fearing for their lives. After all, an armed terrorist group showed up, fired multiple times, thankfully only wounded one officer, while painting their logos and then running off.
And the media actively hid and covered for them.
It's that last part that should shake you all to the bone. The left would react to a murderer assassinating cops by putting them as a saint next to Mangione, and they still don't think they are the party of political violence.

Also today, in Khalli v. Joyce, a federal district court (Judge Farbiarz) ordered the Trump Administration to direct an immigration judge to proceed in a certain way and to vacate its decision even though Congress established exclusive jurisdiction for appeals to the Board of Immigration and then to the circuit court.
So, there are all types of irregular proceedings going on in our courts. Illegal aliens are getting more due process than most American citizens do and it's all at the tax-payer's expense.

People who are in the country illegally are by definition in the country illegally and should be subject to deportation for the very simple fact that they are in the country illegally. It does not matter the length of time that they have been in the country illegally, if they are had a productive life living in the country illegally, if they have had children while illegally living in the country, or if they are violent criminals. The simple fact is that they are illegally in the country.
Legal immigrants are people who are in the country through the legal process and are not subject to deportation unless the violate the terms of them being in the country legally.
We like the vast majority of the world live in a nation state. Nation states have borders. A border is how a nation state controls who is allowed to enter their country. Countries have laws and rules that people must follow to be able to legally enter into that country. If a person violates or does not follow the laws or rules and enter in the country, then they are entering into the country illegally.
While a world without borders may be a desirable and lofty goal, it's not practical or workable in the near future. Many things need to change before it would be possible.
If this is your goal, then your focus should be on reforming the process for people to come into the country legally, not through allowing people who are in the country illegally to remain. If there were zero people entering the country illegally and everyone entering the country were following the laws and rules, then over time the laws and rules would naturally evolve towards your goal.
The assumption is that other countries would do likewise. More likely, there would be blocks of countries that would cooperate with each other. In reality, we will have all passed before the world will be ready for this. For your goal to ever have even a remote chance to work, illegal immigration needs to stop and legal immigration need to be reformed and streamlined.
Masks or no masks are a deflection and avoidance of the truth and hard facts.
Your last paragraph is funny. The illegal immigrants getting deported aren't American citizens needing to hold anyone accountable. There has been a exponential increase of attacks and assaults in immigration enforcement officers and people who support enforcing immigration law. To think those same people attacking law enforcement and other citizens wouldn't attack immigration lawyers is pure incompetence. Why not write an article about the considerable increase in attacks on those who support enforcing immigration law necessitating the need for anonymity?
I'll go ahead and bet that if conservatives decide to open fire on the ATF or other such agencies, Reason would have few problems utterly condemning it.
