Prosecutor Fani Willis Touts the Value of Cash, but What About the Rest of Us?

Unfortunately, Willis’s Fulton County includes assets seized from non-prosecutors in its budget.

District Attorney Fani Willis of Fulton County, Georgia | Alyssa Pointer/TNS/Newscom
( Alyssa Pointer/TNS/Newscom)

It's quite a turn when a prosecutor defends the use of cash for financial transactions. After years of authorities treating mere possession of physical money as sketchy and grounds for seizure, this week a law enforcement official claimed there's nothing to see in her alleged cash reimbursements to her boyfriend for an enviable lifestyle arguably funded by the taxpayers. Either Fani Willis and company were right in the past and she should be subject to scrutiny for anonymous transactions, or she's right today and she and her colleagues owe the rest of us a pass on our taste for financial anonymity.

If you haven't kept up on the details, Fani Willis is the Fulton County district attorney overseeing the Georgia election interference case, which has been described as potentially the strongest and most consequential case against former (and maybe future) president Donald Trump. At least, it was described that way until defense attorneys revealed that Nathan Wade, a special prosecutor in the case, is unqualified for the job, was romantically involved with Willis, and is being paid much more than any of his colleagues (around $654,000 in all)—money from which Willis seemingly benefited in the form of expensive vacations and other pleasures of life with Wade.

She Reimbursed Everything in Cash. Of Course.

Well, she benefited unless she reimbursed Wade for her share. Whether or not she did is among the issues raised in a hearing investigating her alleged misconduct in the case.

"I didn't ever make him produce receipts to me," Willis said in response to questions about the couple's significant expenses. "Whatever he told me it was, I gave him the money back."

"You gave him cash before you ever went on the trip?" she was asked to clarify about one vacation.

"Mmm-hmm," Willis replied.

But she not only had no receipts, she also had no ATM slips or evidence the cash existed. It supposedly came from a substantial stash she kept at home on her father's urging.

Dad's Advice and 'Printed Freedom'

"I was trained, and most Black folks, they hide cash or they keep cash, and I was trained you always keep some cash," her father, John Floyd, confirmed. "I gave my daughter her first cash box and told her, 'Always keep some cash.'"

That's great advice. Cash is essential in emergencies, useful when electronic payments systems are down, and (importantly for this case) it's private and anonymous. When central-bank types floated the idea of abolishing physical money in favor of digital currency a decade ago, prominent German economist Lars Feld retorted that cash is "printed freedom" which helps people escape state control.

But that anonymity, which Fani Willis cited as the reason she had no evidence that she'd compensated Wade for his expenses, is exactly why government officials so despise its use by mere mortals.

Governments Hate Cash

"It just was not credible," CNN legal analyst Michael Moore, a former United States Attorney, commented of Willis's testimony about "things as nebulous as cash payments so there's no way to track it." He added: "It reminded me of watching a criminal defendant take the stand."

Cash is increasingly assumed by officialdom to be nefarious in and of itself.

"Cash can play a role in criminal activities such as money laundering and allow for tax evasion," notes Investopedia. "Since 2016, global policies have been implemented to thwart the use of cash in favor of digital currency transactions."

The mere presence of physical money triggers official suspicion and the urge to confiscate.

"It's the presence of paper legal tender—U.S. currency—that underlies nearly all of the thousands of police interactions we reviewed," The Greenville News reported in a 2020 story on civil asset forfeiture, under which money and valuables are seized, often with no charges brought against their owners.

Like Fani Willis, CNN's Moore is from Georgia and served there at both the state and federal level, so his attitude is illuminating. Georgia gets a D- grade from the Institute for Justice (I.J.) for its forfeiture laws.

"Across 15 states for which we have reliable property data for 2018,38 currency—primarily cash—predominates, accounting for an average of nearly 70% of forfeited property," I.J. revealed in the 2020 report, Policing for Profit. Georgia was among those states and "between 2015 and 2018, Georgia law enforcement agencies forfeited more than $51 million under state law. Between 2000 and 2019, they generated an additional $388 million from federal equitable sharing, for a total of at least $439 million in forfeiture revenue."

The 2023 budget for Fani Willis's Fulton County government includes Fund 442, Federal Equitable Sharing, for "proceeds of liquidated seized assets from asset forfeitures."

Willis may have taken her father's excellent advice about keeping cash on-hand. But her office is among those putting the screws to members of the public who abide by similar counsel and rely on physical money for its utility and anonymity. To keep large amounts of cash in Fulton County, Georgia, is to risk its seizure by the authorities. Yet Willis (assuming we believe her) does much business in cash.

If Prosecutors Get To Benefit, So Do We

So, which is it? Was the Fani Willis of the past, along with most of her profession, correct in considering cash to be inherently sketchy and evidence of some sort of criminal activity? If so, the court should view her claims of cash transactions as suspicious in themselves, just as she would treat regular people.

Or is the Fani Willis of last week correct that using cash is just good sense and evidence of homey wisdom handed down through the family? If that's the case, her office should have been treating people with the same light touch she hopes to receive.

The powers-that-be should abide by the same policies they inflict on the rest of us. If they want the freedom and privacy inherent in using cash, they can't keep it as a private privilege; we all get to benefit.

My sentiments are with John Floyd and Lars Feld on this. Cash is freedom and we should always keep some on hand. If that applies to Fani Willis, it must apply to everybody.

One big issue with this; it wasn't her cash, it was the taxpayer's so anonymity doesn't come into play when the assets aren't your own. So while I get you trying to link to civil forfeiture and authorities' disdain for cash, this more falls under embezzlement. I don't think a service tech employed by a company should be able to use the "dad told me to defense" if they steal cash payments to the company for services rendered.

"One big issue with this; it wasn’t her cash, it was the taxpayer’s so anonymity doesn’t come into play when the assets aren’t your own."

Because she and her "buddy" were public employees? Or what? Please explain... Unless you REALLY mean to say that wages paid to public employees don't really belong to them? What if I sell a hamburger to a public employee, does the cash I get for the hamburger now REALLY belong to me, or not? WHERE (and how and when) does this magic take place?

    2. Quo Usque Tandem   1 year ago

Right; the source of this untraceable cash she apparently used for her own personal pleasure seems to be missing from this story.

I believe malfeasance is the crime that has been subsumed by “my Daddy told me to.”

"Right; the source of this untraceable cash she apparently used for her own personal pleasure seems to be missing from this story."

Quoting from the story, it becomes obvious to me that a diligent reader CAN find this information QUICKLY! Unless they do NOT want to find it, because reasons!!

Boyfriends and girlfriends can spend money that they have earned, on each other. If one used tax money for one to get unreasonably high wages for the other, that can be an issue. How does that, though, in ANY manner, give EITHER one of them an incentive to screw over Your Precious Trumpy-Pooo? This is all just a "Look over THERE!!!" shit-show to distract us all, while Trump prepares for attempt #2 to steal honest elections and destroy peaceful transfers of power!

Learn to READ!!! THIS is where the money came from, straight from the article!

"...until defense attorneys revealed that Nathan Wade, a special prosecutor in the case, is unqualified for the job, was romantically involved with Willis, and is being paid much more than any of his colleagues (around $654,000 in all)—money from which Willis seemingly benefited in the form of expensive vacations and other pleasures of life with Wade."

This is known as “kickbacks” in commercial contexts and “bribery” in official misconduct contexts. If she uses her official influence to get her boyfriend hired and then he spends his own income money on vacations and expensive dinners and clothing and jewelry on her then that is a criminal offense. What’s missing here is the proof that she paid him back – bank transactions matching the expenses for both him and her – that would exonerate her from the bribery charge. That would NOT exonerate her from the influence peddling charge.

          1. SQRLSY One   1 year ago (edited)

MWAocdoc, thanks for your reasoned and data-driven response… All too rare around here! I do believe you are completely correct.

Now as far as is concerned, what is the REASONABLE thing to do in this case… In view of just HOW God-awfully LONG it takes for matters to go through the courts… Letting Trump slide too long, by repeatedly nit-picking at prosecutors (short of severe things like taking bribes), means that we could be looking at EPISODE NUMBER TWO of Trump trying to steal an election! This matter should be resolved QUICKLY… FAR before He is back in power, calling in His Proud Boys (who are “standing by”) to help him out! Speed is of the essence; justice delayed can be justice denied!

“You go to war with the army that you have”. Current set of prosecutors, while not perfect, are “up to speed”, one can assume. Changing horses in the middle of a raging river is dangerous! Getting NEW prosecutors up to speed would take a while! Judgment calls to be sure, here… This is “IMHO”.

Prosecute the prosecutor(s) later, as time permits, as a separate issue. And it IS a separate issue!

Thanks again for a thoughtful input!

            1. MWAocdoc   1 year ago

The reasonable course of action would have been not to charge Trump with a crime in the first place, but that ship has sailed. The next best course at this point would be to remove both prosecutors from the case and have a new prosecutor or district attorney start over again. Tainted prosecutions just feed into Trump's - and his supporters' - persecution for partisan reasons narrative. The judge obviously cannot toss the charges out of court because there seems to be a reasonable basis under Georgia law, but the Georgia law itself is unconstitutionally broad and vague.

              1. Sevo   1 year ago

"...Tainted prosecutions just feed into Trump’s – and his supporters’ – persecution for partisan reasons narrative..."

That became reality, rather than a "narrative", some time back.

                1. MWAocdoc   1 year ago

Almost all "narratives" have some basis in fact or kernel of truth at their heart. The people who float narratives themselves do not insist on proof but seem to base their narratives on "personal truth" or lived experience which, by definition, would have to be accepted or rejected solely upon faith. If it feels true to you then their narratives have succeeded.

In a free country, it isn't the function of the legal system to prevent someone from running for office. This case is a blatant abuse of the legal system to interfere in the 2024 election, not through a verdict, but through taking up Trump's time. (Even if Trump were to be found guilty, he could still become president and serve his term.)

Fani Willis is corrupt and incompetent. She needs to be removed from the legal profession.

As usual, SQRLSY, you take the totalitarian, police-state position.

"In a free country, it isn’t the function of the legal system to prevent someone from running for office."

Tell that to the Arnie Governator Schwarzenegger, who can't run for POTUS, 'cause he wasn't born here. WHERE are the endless crocodile tears for HIM? ... The rules are the rules, bitches! You don't LIKE them? Have the rules changed! That's how the game is played!

Tell that to the Arnie Governator Schwarzenegger, who can’t run for POTUS, ’cause he wasn’t born here.

You have your branches of government confused. Schwarzenegger isn’t prevented from running for president by the legal system, but by the legislature. And the legislature is prohibited from laws targeting specific individuals.

The rules are the rules, bitches! You don’t LIKE them? Have the rules changed! That’s how the game is played!

Fani Willis and the administration are breaking the rules and abusing their power, turning the US into a police state. Yes, I don’t like that, as should anybody who hates police states.

Of course, you love police states, SQRLSY.

Simple (SIMPLE!!!) question for you and fellow Trump-humpers:

Two prosecutors were boyfriend-girlfriend in the past. HOW does that have ANYTHING to do with Poor Precious Trumpy-Pooo NOT being able to get a fair trial?

Twat next, Georgia appoints new prosecutors... And Trump lawyers... WAIT for shit now... Discover that ONE OF THEM GOT CAUGHT RED-HANDED FOR SPEEDING!!! (Or maybe unauthorized nose-picking, or Devote Trumpaloos knows twat-ever shit might be!)

                    1. NOYB2   1 year ago (edited)

                      Thank you for asking.

Two prosecutors were boyfriend-girlfriend in the past.

You are mischaracterizing the case. Fani Willis wasn’t just sleeping with another prosecutor, she used this case to hire her lover, pay him far in excess of what his experience justifies, and then possibly received kickbacks.

HOW does that have ANYTHING to do with Poor Precious Trumpy-Pooo NOT being able to get a fair trial?

It means that Fani Willis has a personal financial interest in prosecuting this case; that is prosecutorial misconduct.

The charges are obviously preposterous to begin with, and Trump will likely be found not guilty. However, the process itself (the prosecution itself) is the punishment. And the prosecution itself is an attempt to manipulate the 2024 election. The timing alone tells you that.

Simple (SIMPLE!!!) question for you and fellow Trump-humpers

I don't particularly like Trump and I didn't vote for him. I simply despise fascists, like much of the Democratic party. And you.

                    2. SQRLSY One   1 year ago

"It means that Fani Willis has a personal financial interest in prosecuting this case; that is prosecutorial misconduct."

All prosecutors earn their pay by prosecuting. Did you know THAT?

Now HOW does her past carryings-on with her ex-boyfriend have ANYTHING to do with her being unfair to Poor Abused Trumpy-Pooo for extra, un-earned pay, or for any other reason not related to "justice" and "the law"? You did NOT answer the question in ANY way!

If they kick her off of the case, and replace her, and Trump's lawyers dig up A SPEEDING TICKET on the new prosecutor, will you (Noy-Boy-Toy-Boy) and Fellow Trumpaloos cry endlessly about THAT ass well?

                    3. NOYB2   1 year ago

All prosecutors earn their pay by prosecuting. Did you know THAT?

Prosecutors receive a salary regardless of whether they prosecute people or not. Fani Willis above and beyond that used a specific legal case to enrich her lover. That is different from a salary.

You did NOT answer the question in ANY way!

I did: Fani Willis has a personal financial interest in specifically prosecuting this case, above and beyond her salary.

If they kick her off of the case, and replace her, and Trump’s lawyers dig up A SPEEDING TICKET on the new prosecutor, will you (Noy-Boy-Toy-Boy) and Fellow Trumpaloos cry endlessly about THAT ass well?

She isn't being kicked off the case for being a bad person, she is being kicked off the case for having a specific, articulable conflict of interest.

                    4. SQRLSY One   1 year ago

"Prosecutors receive a salary regardless of whether they prosecute people or not. Fani Willis above and beyond that used a specific legal case to enrich her lover. That is different from a salary."

They aren't lovers any more. As if that matters anyway... And I want to see how long you can be a prosecutor without supporting or conducting prosectuions!

"she is being kicked off the case for having a specific, articulable conflict of interest."

HOW does her having a lover or ex-lover of ANY kind have ANYTHING to do with being fair or not being fair (playing by the rules) to Trump? If her lover was Trump's spiteful Trump-hating ex, NOW you would have a case! Can you clearly state WHY she and-or her ex-lover should be assumed to NOT be able to play by the rules vis-a-vis Trump specifically? What does her hanky-panky have to do with Trump? Would a speeding ticket disqualify her ass ass well? Twat if she picks her nose in a gross manner?

                    5. NOYB2   1 year ago

HOW does her having a lover or ex-lover of ANY kind have ANYTHING to do with being fair or not being fair (playing by the rules) to Trump?

It has nothing to do with it.

What does have something to do with the case is that she funneled taxpayer funds to her lover by appointing him to be lead prosecutor.

Would a speeding ticket disqualify her ass ass well?

                      No.

In court she said she accumulated her thousands thousands in cash by getting cash back every time she used her credit/debit cards, you know a $20 bill here, a $50 bill there - it adds up!

Apparently she is unaware of ATMs, so that's how she got cash... I'd love to see the judge demand her credit card statements!

If I lived in Fannon county and the cops found $10,000 or $15,000 in cash in my apartment, they'd seize it - no matter what my black daddy told me, his black daughter.

Right now, Fani Willis is not on trial; the judge is merely determining whether to kick here off this legal case. He can do that merely for the appearance of impropriety.

When she goes on trial (for corruption, bribery, kickbacks, and/or tax evasion), as she likely will within a year, she will have to prove that it is was her personal cash, obtained from legitimate sources, like everybody else would have to in the same situation. Those are the standards in our legal system.

I'll grant that her claims are suspiciously convenient but the point of the article is that the police think the same thing about the claims of people traveling with their life's savings that they're taking to invest in a truck or other business asset.

      1. A Thinking Mind   1 year ago

The article is pretending she's being somewhat honest in order to springboard the conversation onto a different point. But the bigger take-away from her testimony isn't about the usefulness of having cash, but the fact that she's clearly full of shit and the cash is an obvious lie.

        1. Rossami   1 year ago

No, the article is pretending that she's innocent until proven guilty.

I'm not saying that she is innocent - but her guilt has not yet been proven. And until it is, her use of cash is no more (or less) suspicious than anyone else's use of cash.

          1. BYODB   1 year ago

Or, to put it into prosecutor language, the cash is suspicious by default when it's a lowly peon but it's totally normal and not at all suspicious when it's a prosecutor using it.

In short, it's a defense of a double standard.

Ethically you're right, but when you only apply that ethic to the people specifically stealing cash from the electorate it's not a moral good.

            3. CE   1 year ago

I would assume the opposite. When a public official makes large cash payments to someone, corruption is more likely than not.
When a private individual makes cash payments, it could be for any number of reasons.

          2. A Thinking Mind   1 year ago

No, the article is pretending that she’s innocent until proven guilty.

            Well, a few things:

            1) There's nothing wrong with following the proceedings and coming to conclusions about what is true and is untrue. In fact, juries have to determine whether they believe or disbelieve every individual witness. So it's perfectly fair to listen to testimony in full and find that it's almost certainly bullshit.

            2) She's not on trial. She's not accused of any crime, per se. She's facing disqualification for perhaps having a conflict in the interests of justice. And the ethical standard for both judges and prosecutors, as officers of the state, is that the mere appearance of impropriety can be disqualifying. So they shouldn't even need to prove that she's definitely conflicted, but that she's either probably or likely conflicted based on irregularities.

Given that, there's no journalism ethical standard that requires you to accept her testimony on its face. If what she's saying is ridiculous, illogical, and seemingly fabricated for the purposes of bamboozling an evidentiary hearing, you can report on that. But this article clearly chooses to side-step the main thrust of her testimony in order to advance a tertiary argument about the value of cash.

          3. Gaear Grimsrud   1 year ago

Even if she is telling the truth, without a receipt from Wade we don't know if she actually paid the full amount due. She claims he gave her a number and she peeled off the bills. Under the circumstances she was at the very least flirting with ethics violations and criminal charges. I'm cool with cash transactions but if the IRS questions an expense I'm claiming and I tell them some guy gave me a verbal bill and I peeled off a pile of C notes they're going to hand me a bill for the taxes and the penalty.

            1. A Thinking Mind   1 year ago

At the very least it means Wade is committing some kind of tax fraud. For one, he uses his business card to pay for everything, personal and professional expenses, so he has to rely on his accountant to sort out his personal and business expenses. But then, if Fani is repaying him in part or in full for all these expenses, that's unreported cash income.

Which, hey, fuck the IRS, sure. I'm happy about that. Except that it's just a convenient excuse to cover for the fact that she's actually not repaying him in cash because this story is bullshit.

              1. Sevo   1 year ago

If the IRS hasn't yet been weaponized against Trump, it's certain an agent is listening to this 'unreported cash income' claim, and that man will have to do some explaining to the agent.

The article isn’t a court of law. She’s an obvious liar. But yes, in court that has to be proven.

            1. YehoshuaK   1 year ago

She's almost certainly lying, yes. But also we can point out the hypocrisy of her claim, which is what this article does.

          5. NOYB2   1 year ago

She hasn't been charged with a crime, so innocence and guilt are irrelevant.

Right now, what is being decided is whether she can remain as a prosecutor on this case based on whether she appears to be impartial and motivated by the law, rather than personal gain. Even the appearance of a conflict of interest is sufficient to kick her off.

Her criminal prosecution will (hopefully) be a separate court case.

        2. BYODB   1 year ago

Yes, it's a tortured comparison to make a point tangential to the actual case in question.

I'm not going to cry a river when a prosecutor gets caught up in their own horseshit nonsense with cash payments. They've fucked over citizens for much less and I see no reason to stand on principle in defense of the people who specifically created and benefit from asset forfeiture schemes. If she gets a pass, it means only the rich and well connected get a pass and the rest of us get fucked regardless.

In essence, if it's good for the goose it must therefore be good for the gander.

And not to put too fine a point on it, it seems prosecutors offices are right that cash is often used in the commission of a crime exactly as it was in this particular case. That doesn't mean all cash is related to crime, merely that crime is usually related to cash. That connection doesn't go both ways no matter how prosecutors wish it did.

          1. Ersatz   1 year ago

If we want to continue to have cash as an option in our society we will have to flesh out what misuses we can live with and which ones we cant. I think a good start would be to deny all public officials from dog catcher to the prez use of anything but e-dollars or US govt credit cards for anything that touches public business.

THEN you can start trying to catch the 2nd tier money launderers [big name govt officials comprising the 1st tier, of course] and drug dealers.

          2. A Thinking Mind   1 year ago

it seems prosecutors offices are right that cash is often used in the commission of a crime exactly as it was in this particular case.

See, this is the problem with making a tangential argument. The most likely thing to conclude from her testimony is that THERE WAS NO CASH. She's making up the existence of cash in order to pretend she wasn't getting a financial benefit. She wasn't committing crimes, but she was using the authority of her office to extract a financial benefit by paying her paramour who was then taking her on trips. She was not repaying him in cash, and there's no evidence that she's holding significant amounts of cash (she's already denied that you'll ever see a cash withdrawal from an ATM if you looked at her bank records). Her boyfriend says he never deposited any cash himself.

She actually told a much more brazenly and easily disproven lie on the stand. She mentioned she'd visited DC at least a few times, and was asked if she'd ever visited the White House. She said no. And yet, there's a record of her in the White House visitors log from 2023. She tells lies.

            1. Gaear Grimsrud   1 year ago

She claims that she withdrew 50k from her retirement account to finance her election and kept part in cash. This would automatically produce a paper trail. Assuming that the money came from an IRA or 401k she would have to claim the income on her 1040. And the cash amount would show up on her banking records. If she's claiming that she ran a political campaign on a cash basis and does not have receipts she may very well be in violation of election law. Nothing about this story passes the smell test.

The most likely thing to conclude from her testimony is that THERE WAS NO CASH.

Yeah, that's my takeaway as well in that it's a thin excuse that she has no evidence for. It's essentially a lie.

However, it's amusing that even if it were true it's still pretty bad. It's more interesting to ponder the ramifications if it were true than talk about how it's an obvious lie, I suppose.

      2. NOYB2   1 year ago

Willis isn't on trial yet; the court is merely determining whether to keep her on as prosecutor. Merely the appearance of impropriety is sufficient for the court to kick her out. Ditto for the bar association. That's why the court doesn't need to dig into the veracity of her cash scheme.

An actual trial for the kickback scheme will look different, and she will have to prove that she paid Wade back and where the money she paid him back with came from.

Duh. All taxpayer money is the property of the state. And can be spent by state officials as they see fit.

You got a problem with that?

    8. ravenshrike   1 year ago

The best part is that her explanation of how she withdrew the cash with no paper trail was the $50 cashback option at Publix. This means for a single $4000+ trip, and she took multiple, she withdrew the maximum amount of cashback possible 80+ times. The phrase beggars belief comes to mind.

    9. DavidCayJohnston   1 year ago

You are wrong as a matter of law, and as a matter of economics, .

It was her cash. The taxpayers paid her for her services just like any other employer. Once the services are performed, the payment to the worker is the workers money, not the taxpayers, or anyone else.

It's surprising to read this sort of socialistic crap at this website.

      1. Jefferson Paul   1 year ago

You obviously haven't studied this. The problem is not that she used her own money to go on a vacation (or several, totaling tens of thousands of dollars). It's that she appointed her boyfriend to be the prosecutor in this case, awarded him a salary much higher than is customary, and then he took her on these expensive vacations. That is seen as a kickback.

Her excuse is that she reimbursed him for her half of the vacations, so it wasn't a kickback. She claims she reimbursed him with cash, so there isn't any paper trail of her paying for her half of the lavish vacations. If/when she's charged for doing this, she will need to provide some evidence that she did, in fact, pay her boyfriend for her half of the vacations.

You joke, but couldn't that be a valid defense for Fani? She says she keeps a lot of cash so have her show them it. It wouldn't prove she paid back Wade but it would lend credibility if she shows that she does keep that kind of money on hand.

      1. NOYB2   1 year ago

        Fani isn't on trial yet.

And, no, that is probably not a "valid defense". In her position, as a public servant, it's not sufficient to say "I paid him back with cash", she needs to be able to document it.

        1. Pear Satirical   1 year ago

Well what I'm saying is if they raid her home and find a bunch of cash in it it would bolster her claim that she had the money.

          1. NOYB2   1 year ago (edited)

In order to raid her home, they would have to establish probable cause as part of some investigation into her wrongdoing. We aren’t at that point yet.

Furthermore “I paid him the money back out of my cash” is relevant in the case of the Trump court case, but it is likely irrelevant for anything criminal she would be investigated for and charged with.

Most likely, she would be charged with corruption, campaign finance violations, and tax evasion. For all of those “I paid him back” is irrelevant. Rather, she would have to document the source of any cash they found. That is, for any actual criminal case against her, it would be better if they didn't find large sums of cash at her home.

    3. NOYB2   1 year ago

She isn't on trial yet. Right now, the court is merely trying to determine whether she should stay on as prosecutor.

She may go on trial for the kickback scheme, tax evasion, campaign finance violations, and other crimes later. At that point, they will look into her financials in much more detail.

  3. JesseAz   1 year ago

    Yeah. Nobody believes her.

Amazing how often we get temperament and criticism of testimony here such as with Kavanaugh, but oddly missing.

Wade also had no evidence of ever depositing said cash. Used a business account, so how was this paid back?

    1. NOYB2   1 year ago

It's also irrelevant. If she paid him back, she ought to have gotten a receipt.

            1. defaultdotxbe   1 year ago

Is that the standard we should be holding prosecutors to? Should they allowed to take bribes too, so long as it's not directly related to one of their cases?

Should we abandon all rules of professional ethics because no one is a "perfect angel?"

Trump will get his trial, preferably with a prosecutor who does a better of job of keeping their nose clean. But of course that doesn't excuse her malfeasance, unless of course all's fair in pursuit of orange man bad.

Hell, replacing her beau with someone more qualified will probably work *against* Trump, since, you know, they'll actually be able to do the job of assisting the prosecution. But of course you can't see that because you only see orange man bad.

Ironically, even if Trump were found to be guilty in Georgia, it wouldn’t matter: he can still be elected and serve as president.

The Georgia case is a propaganda operation, not a legal operation.

None of the criminal or civil cases would result in Trump being taken off the ballot.

The only way to take him off the ballot would be if he was determined, by due process in a federal court, to have engaged in treason or insurrection.

The story isn’t that she repaid her boyfriend in cash. The story is that she was telling an obvious lie about the cash.

Yes, keeping some cash handy is a good thing. I usually hang onto a few hundred at a time. Who keeps 6 months’ worth of expenses in cash? And you’ll never see them making cash withdrawals from ATMs, she says she overpays at the supermarket to get cash back. How could she ever stockpile enough cash doing that, if she’s actively using it to repay debts?

Like, having 6 months worth of expenses in your savings is just sound financial planning. You hang onto those for emergencies. But ideally you’ve got it in some interest-bearing account. And you’re not going into those savings for paying off a trip to Aruba or Belize. If she’s saving cash for emergencies she’s not using them to find her lavish vacations.

Keep in mind her father testified that he had been watching the trial, knew what she said, and even had Fani with him while he was being prepped to testify. It’s an obvious case of aligning his testimony to match hers. In order to cover for her. And Fani was involved in it-she used her father as an alibi to cover for the fictional cash she was paying. It’s all transparent corruption, here.

    1. Quicktown Brix   1 year ago (edited)

Like, having 6 months worth of expenses in your savings is just sound financial planning. You hang onto those for emergencies.

Everybody knows if you horde cash, you have to keep rotating it so it doesn’t pass its expiration date. I mean you can’t merely keep it for emergencies. You might as well pay your boyfriend back for lavish trips he bought with the ridiculously high salary that you gave him. What’s so hard to believe about that?

      1. A Thinking Mind   1 year ago

It's just funny how she had to keep altering the story such to make it unverifiable. "So did you make withdrawals from your bank?" Nope, she did not. You won't find any cash withdrawals to line up with her supposed payments to her boyfriend. Sometimes she overpays at the supermarket to get some cash back, but unfortunately, that's hidden from any attempt to corroborate that she's got cash.

"So where did the cash come from if you didn't withdraw it from an ATM?"

"My blood and tears." Apparently she just makes money with her own blood and tears. Seems like she's a counterfeiter.

The closest we got to an explanation of how she had over $5K in cash that she definitely gave to her boyfriend is that she withdrew some cash during her first campaign for DA. I don't know why she needed to fund her own campaign with cash-was she hiring people off the street to make signs for her? But that's the closest she came to an explanation for where she was actually producing the cash that you can't find any evidence she ever took out of a bank.

        1. Super Scary   1 year ago (edited)

“Sometimes she overpays at the supermarket to get some cash back, but unfortunately, that’s hidden from any attempt to corroborate that she’s got cash.”

She said she used Publix cashback, the max being 50 bucks. This means for a single $4000 trip, she went to Publix 80 times, or made multiple transactions at once taking out the max cashback. I'm pretty sure the latter would get your card locked for fraudulent activity at most banks.

Many years ago I had a business that produced a fair amount of cash. Mysteriously not all of it ended up on the balance sheet. But cash is not easy to spend in significant amounts. You can't pay your mortgage with it. You can't pay your taxes with it. You probably can't pay your utilities with it. Great to have around but you still need money in the bank.

        1. EISTAU Gree-Vance   1 year ago (edited)

You can pay your mortgage and utilities with money orders that you can get at the grocery store service counter with cash, so paying bills that way is doable.

In a world where everything is digital and even old boomers dont keep this much cash on hand, this not-that-old lady just happens to do most of her transactions in large amounts of cash.

Oh and also, many of those transactions are shady AF, and would be the sort that it would be real handy if no one could track. These two things are probably in no way related, im sure

She also was obviously violating the rules of sequestration. Witnesses are supposed to be banned from watching the proceedings in order to prevent them aligning their testimony to what has already been testified to.

However, while lawyers were 20 minutes into an argument before the judge about whether sufficient evidence had been presented in order to call Fani as a witness, she strolls into the courtroom and says she's going to testify. She clearly knew what was going on before she entered the room because she canceled the motion to quash.

        1) How could she have known that she was definitely going to be the next witness instead of Terrence Bradley, Wade's divorce attorney? He had previously been called and one of the goals of the defense was to get Wade to pierce an argument of attorney-client privilege to get Bradley to answer questions.

        2) How did she know that they were still arguing to quash when she walked in? They were 20 minutes into an argument about whether she would be forced to testify, and for all she knew, the judge might have already declined the motion to quash by the time she entered. But she knew exactly what the conversations was about, seemingly.

        3) Her testimony demonstrated a suspicious knowledge of things other people had testified to. In particular, there was her explaining a conversation she had with Wade in a conference room at the DA's office after the affidavit had been filed. Wade testified he'd talked with her in a conference room about the affidavit (which hints that they might have colluded in figure out how to align their testimony). It was a bit suspicious to me how she jumped on the phrase, "The conference room," as if that's the only time she's ever used the conference room, and knew exactly the meeting it was referencing. And according to her, there was no "conversation," he just showed it to her and then she went on an angry rant.

        4) Her father openly admitted he's been watching the trial, following the trial, reading about the trial. He admitted that when he was prepped to testify, Fani was in the room with him. It's obvious collusion between witnesses who want to get their stories straight.

        1. Sevo   1 year ago

Looks like the judge is more than willing to turn control of the case over to the defendant.
They both need to be sacked, and she should go directly to jail.

        2. Gaear Grimsrud   1 year ago

Wade clearly set up the conspiracy and she essentially confirmed his testimony. His claims were pretty ridiculous. He claimed that clients paid his law firm in cash frequently. He claimed that he used a single credit card for all business and personal expenses and let his accountant figure it out. This is straightforward commingling of funds which while probably not illegal is a stupid way to run a business. All of this cash coming and going to and from the two of them should be easy to track except they claim that they don't do cash deposits or withdrawals. If Wade's clients are paying in cash and it's not being deposited the IRS might have some questions. Again, this whole story is transparently bullshit.

So no Roundup today? Must be a federal holiday of some kind the rest of us don't get off.

Considering that it is Presidents' Day, here are some candidates for Worst Of All Time (WOAT):

    https://www.zerohedge.com/political/who-woat-president

On this Presidents Day weekend, as we honor our chief executives of past and present, the only category that makes sense is president of the United States. There are, after all, only 45 of them.

We can eliminate certain presidents who so briefly held office as to be more forgettable than awful. Zachary Taylor was in office for a mere year and a half, which was a lifetime compared to the tenures of William Henry Harrison (he delivered the longest inaugural address in history, only to serve the shortest period of time in office, 31 days) and James Garfield (199 days).

So, the rule is that they must have served one full term to be WOAT-eligible. That eliminates a number of attractive candidates, like Warren Harding, Millard Fillmore, Chester Arthur, and John Tyler. It also technically cuts out Andrew Johnson, but he accomplished so much bad in his less-than-one full term that we’re allowing his inclusion.

    * Franklin Pierce: One of a number of pre–Civil War compromisers, Pierce was passionate about adding new slave states to the Union and also signed into law the Kansas–Nebraska Act, which allowed residents of new states to decide whether to allow slavery, and the Fugitive Slave Act. Although from New Hampshire, he was a Jackson Democrat who even proposed at one point annexing Cuba as another slave state. Even while enlisting a pretty good author to write his campaign bio — his buddy Nathaniel Hawthorne — he failed to be renominated by his party for the 1856 race.

    * Jimmy Carter: It says something about one’s presidency when one is called the best ex-president of history. From killer rabbits to Billy Beer, from his “crisis in confidence” speech — known as the malaise speech — to the Iran embassy crisis and the aborted desert rescue, the presidency of the man from Plains was marked with risibility and retreat.

    * Andrew Johnson: On the plus side, while president, the Tennessean did resist fellow Southerners who tried to undo the results of the Civil War. Also, after leaving office, Johnson broke the political mold by showing humility and returning to public life in a lesser capacity (like John Quincy Adams) by serving in the U.S. Senate. But he was a political oaf and made numerous tone-deaf mistakes, showing indifference to the plight of newly emancipated blacks to the point of opposing the 14th Amendment. Plus, he was impeached — which is, contrary to some current spin, still a bad thing — and survived removal by all of one vote. Seems to have been not very popular with his peers.

    * Lyndon B. Johnson: Another of the Johnson boys, Lyndon did as much damage internationally as he did domestically. Ike gave us steadiness; JFK gave us Camelot; LBJ ratcheted up Vietnam to its height. As Bill Murray said in Stripes, when it comes to war, we’re 10 and one, and LBJ is pretty much responsible for the one. He also followed up the New Deal with the Great Society, which nobody thinks is so great anymore.

    * James Buchanan: History has not been kind to James Buchanan, as close to a consensus No. 1 pick as you can get. Think of him as a gopher ball served up to Abraham Lincoln; he is the Ray McLean to Lincoln’s Vince Lombardi, the Mike Shula to Lincoln’s Nick Saban. Even before becoming president in 1856, he was a tergiversator with no equal, supporting measures that perpetuated North–South division, like the Kansas–Nebraska Act, and, in his inaugural address, encouraging the Dred Scott decision. Once in office, his hands went perpetually numb from his sitting on them.

    * Barack Obama: No such list would be complete without the president who vowed to “fundamentally change America” even though most of America pretty much liked America the way it was. As an African American, he also had the opportunity to heal — or at least radically improve — race relations in America but opted to play the same old racial grievance game.

    Go Woke, go broke.

    https://www.spiked-online.com/2024/02/19/disney-a-billion-dollar-casualty-of-woke/

The Walt Disney Company is in deep trouble. Its last four high-profile releases bombed at the box office, losing over $1 billion between them. Once Hollywood’s most successful film studio, Disney was dethroned last year by Universal Pictures.

The reason for Disney’s decline? It has gone woke, to an almost comical degree.

Viewing figures and box-office sales spell this out clearly. Audiences are growing sick of the woke slop that Disney has been serving them. They are tired with scripts that are weighed down by clunky political messaging. They are fed up with storylines being mangled to fit ‘progressive’ narratives. They are irked by Disney’s desire to lecture them instead of entertain them.

Practically all new Disney films place a huge emphasis on this kind of diversity casting. Karey Burke, president of Disney’s General Entertainment Content division, said in a leaked video in 2022 that she wants 50 per cent of all Disney characters to be either LGBT or from an ethnic-minority background. Disney Television Animation executive producer Latoya Raveneau has similarly said she is ‘adding queerness’ wherever she can to the shows she oversees.

No one is against diverse characters. Like any other character, they just need to be compelling and have depth. But all too often, their inclusion in Disney productions feels more like a tick-box exercise to meet Karey Burke’s quota.

Disney’s preoccupation with diversity can often feel like an attempt to distract from its otherwise pedestrian output. Its 2023 live-action remake of The Little Mermaid, in which black actress Halle Bailey was cast as Ariel, is another case in point. Although some might have seen this blockbuster remake as a sad day for redhead representation, most members of the public were distinctly unbothered by the prospect of a black Ariel.

Although Disney was hailed in the media for its ‘inspirational’ choice of casting, The Little Mermaid performed worse than expected when it hit screens in 2023, barely breaking even. No amount of diversity hype can make up for a dull film.

Time and again, Disney has gone out of its way to alienate and insult the core fanbases of its franchises. After Disney acquired Lucasfilm studios in 2012, Star Wars fans feared the franchise was about to be given a feminist, progressive makeover. Disney executive Kathleen Kennedy was even pictured wearing a t-shirt saying ‘The Force is Female’. Whatever that means.

The woes facing Disney illustrate the powerful hold wokeness now has on big corporations. It’s as if Disney’s leaders felt compelled to toe the line on the identitarian agenda. They were prepared to trash the company’s reputation and alienate its fans, seemingly just to signal their allegiance to this new elite ideology.

    1. A Thinking Mind   1 year ago

Audiences are growing sick of the woke slop that Disney has been serving them. They are tired with scripts that are weighed down by clunky political messaging.

I'd say what has been deadlier isn't the overt political messaging, it's the implicit biases being demonstrated. These things aren't out and out stated.

For example, the Girl-Boss standard. There's nothing intrinsically wrong with adding more female superheroes into the universe. The problem is that, due to identity politics, they refuse to show that female characters can be flawed. Ironman was a heroic character many people identified with, but he faced a ton of adversity because he couldn't do everything, he had personality flaws. His arrogance wasn't treated as deserved, it was a failing that affected his personal and professional life.

They wanted to find a female character to replace Ironman as the central hero, so they looked to Carol Danvers. She has the same quippy personality and arrogance, self-righteousness, except in her case it's not a flaw. It's deserved arrogance because she's always shown to be right. She doesn't have personality flaws, and she's so powerful that there's never any adversity for her-there's never a possibility of her losing a fight. She never has to run away to regroup, she never has to rethink how she's pursuing her goals.

And this prevalent in basically every other female character they've introduced. None of them have to question whether they're doing the right thing, or if they're going to be able to overcome the obstacles in front of them. This makes for some really boring stories. Only men, seemingly, can face challenges they might not be able to overcome, but women can just achieve anything without adversity.

      1. BYODB   1 year ago

Agreed. Their 'female and minority' characters aren't a problem in and of themselves it's rather their slavish devotion to tropes that's the problem.

Disney has a real problem with the mary sue trope. Their female characters are perfect and incapable of error most if not all of the time. Captain Marvel in particular suffers massively from this trope, not to mention that Brie plays the role dead faced with very little emotion.

They say that's an intentional choice because of her alien background or something, but lets be honest it just isn't very interesting to watch and it's a poor ass excuse for what could otherwise be an interesting character.

Her performance reminds me of Kurt Russel in Soldier, and that is not a very good movie or a particularly good performance by Russel despite the fact that he is a notably pretty good actor. Perhaps Brie is a pretty good actor too, and it's simply the role as written by Disney that is a shit job.

        1. A Thinking Mind   1 year ago

Soldier is a fucking masterpiece compared to anything Disney/Marvel have released lately. Russel's performance in that is kind of engaging if you're really looking at the character. Plus, it allows him to be masculine and competent, while still having to face extreme odds and adversity. It's perhaps a pretty cliche action story with the standard beats, but that's so much better than Disney's refusal to tell anything approaching a story with their latest releases.

          1. BYODB   1 year ago

Yeah, Soldier is a competently done film and is a solid B movie which makes it that much more pathetic that Disney can't make something better.

It must just be that hard to find a director that has any competency whatsoever these days, but then I already know the primary thing they're looking for is 'black woman' and any skill they may or may not have in film making is purely secondary.

This has been obvious for a while with the newer films. They hire a director with maybe a handful of credits on indie projects that are notably not very good movies on their own, nor are they particularly competent films. Hiring someone like that then throwing 400 million dollars at them is insane.

        2. InsaneTrollLogic   1 year ago

Agreed, and a female lead is not bad in and of itself either. The Wonder Woman movie back in 2017 is a good contrast. She's not perfect, makes mistakes, and grows during the course of the film. As it was, it became the tenth highest grossing film of that year.

          1. Outlaw Josey Wales   1 year ago

It was interesting that they sacrificed the male character at the end though.

            1. A Thinking Mind   1 year ago

Meh. He was competent and heroic and sacrificed himself to save the day. And he wasn’t going to be alive for future releases since the film was set in World War I. Might as well complain that Captain America sacrificed himself during his movie.

      2. Mike Parsons   1 year ago

"And this prevalent in basically every other female character they’ve introduced. None of them have to question whether they’re doing the right thing, or if they’re going to be able to overcome the obstacles in front of them."

And importantly, they are often doing things that are objectively terrible or if they showed a man doing it, there would be shreeking enough to shatter ear drums. Tons of examples of this in newer Disney Marvel and Star Wars stuff. But ya, its not just that they are always assumed to be righteous and good while doing superhero business, they are not held to any sort of standard of decency when they do really horrible shit.

Somewhat tangential, but on the "its ok when women do it" or what I call 'revenge writing', that new True Detective has the strong, stoic, super awesome black/indigenous woman (who from scene 1 you can tell is going to be stoic girl boss), riding some dude and at some point he apparently gets uncomfortable (I dont know why they wrote this in, it makes no sense other than to show she is powerful) and she starts fucking him harder until she finishes and then gets off him, treats him like shit, uses his toothbrush which he clearly hates and is disgusted by, and then leaves.

Just for 1 second, imagine flipping the sexes here and the mass outcry about glorifying rape scenes on TV. The whole "its ok when a Mary Sue does it" thing rampant in their writing.

      a group of self-styled experts

In other words, people picked because they hate one side and favor the other. Let's take a look at this "Presidential Greatness Project" and this hit piece.

Ronald Reagan, George W. Bush, and Trump were more likely to be ranked higher by conservatives or Republicans, with Reagan being ranked an average of 5th by Republicans respondents, Bush 19th, and Trump 41st. Among Democrat respondents, Reagan was rated an average of 18th, Bush 33rd, and Trump 45th.

A similar partisan divide was noticeable for Barack Obama and President Biden, who ranked an average of 6th and 13th, respectively, among Democrat respondents and 15th and 30th by Republicans. Bill Clinton, a Democrat, was ranked higher by Republican respondents (10th) than he was by Democrats (12th).

Very odd that Biden would rank 14 out of 45. Let's look into the creator of this "report", Brandon Rottinghaus. He's a tenured professor at the University of Houston, in other words, cloistered within an ivory tower, and most likely a Democrat.

      http://www.brandonrottinghaus.com/biography.html

Brandon Rottinghaus, a native of Dallas, Texas, holds a Ph.D. in political science from Northwestern University. His teaching and research interests center on Texas politics, public opinion, and executive and legislative relations. He is the author of several books, dozens of academic journals, and editor and contributor to multiple edited volumes. Most recently he the is author of the book Inside Texas Politics and Inside American Government (both Oxford University Press). He has provided commentary on national and Texas politics in hundreds of media outlets. He is the co-host of Party Politics, a podcast and show on PBS/TV8 on Houston Public Media.

      Yep, piled higher and deeper.

Biden took office in a time of crisis - economic disaster, Covid, insurrection and civil unrest then improved all the above.

        But 14?

        Nahh Way too high.

Trump took office with a robust economy and no crisis and left office in crisis.

        Worst ever?

I would still put Bush the Lesser below him.

"... a 2020 story on civil asset forfeiture, under which money and valuables are seized, often with no charges brought against their owners."

Indeed, it's the "anonymity" of cash seized by law enforcement that makes it so difficult to prove that officials personally profited from the seizures. The most impressive case recently was the seizure of the contents of dozens safe deposit boxes in California. No one will EVER know what was stolen in that unconstitutional and illegal raid, since it's the word of the owners against the word - and accounting skills - of the jack-booted thugs.

'Either Fani Willis and company were right in the past and she should be subject to scrutiny for anonymous transactions, or she's right today and she and her colleagues owe the rest of us a pass on our taste for financial anonymity.'

Hey, in an equitable justice system based on living foundational documents, we can have both--and both can apply in the same case to the same person.

    Learn to cognitive dissonance.

    1. MWAocdoc   1 year ago

Except that you don't seem to be a member of a protected class under Federal law, so only "Black folks" who were taught by their fathers to keep cash in case of Ku Klux Klan lynch mob emergencies can use that excuse. Everyone else is suspicious in the eyes of the law and subject to unconstitutional search and seizure without probable cause or due process. Sez right here in the Code of Federal Regulations!

If You Care About Climate Change, Then You Care About the Farm Bill

With the upcoming reauthorization of the Farm Bill, we have a chance to shift the U.S. agricultural system from a climate problem to a climate solution.

Now they get to farm without using fertilizers. Yay Joe!

I saw her testimony as laughable and defies Reason.

She didn’t do herself any favors by taking the stand. She looked like a lawyer who was trying to weasel out of the claims against her. Hence she chose not to retake the stand.

I don’t like Trump in the least. But to “get him” at all costs is a dangerous thing for the justice system. Lawfare is a 2 edged sword . The fact that she ran for office on a platform of getting Trump should be a disqualification.

Surely there are never Trumper DAs and AGs who would investigate and prosecute his alleged crimes. Where are they? Aside from the kangaroo court that was the Jan. 6 hearings.

    1. Sevo   1 year ago

Which DA wants to point to a record of convicting Trump for a late library book return?
And BTW, on record, he seems to be the best POTUS we've had for the last century regardless of adolescent focus on personaliy.

Never fear! There will be an Ivy League Presidency in xer future as they are all seeking to fill those positions with Strong Black Women who are not ashamed to play the race card while administering a university campus. Or perhaps there is room in the Biden Administration for xer – maybe the Department of Justice? Or maybe the Dems will just throw xer under the bus now that xhe has served their purpose in the culture wars against The Deplorables.

Mr. Tucille should get out more often in black communities and poor white communities. Keeping cash at home is common and widespread, especially among black households for sound, historical reasons.

There is nothing illegal about using cash per se.

    1. NOYB2   1 year ago

There is nothing illegal about using cash per se.

No, but there is something illegal about using your official position to hire unqualified lovers at exaggerated rates, period. Cash has nothing to do with it.

On top of that, she may have received kickbacks from her lover in the form of joint vacations etc. Her defense is that she paid him back, meaning she may only be guilty of the underlying crime but not the kickback accusations.

In any case, you are free to use cash. But you will often have to document cash transfers with paperwork, like receipts etc. In addition, many cash transactions are taxable and reportable.

      1. Sevo   1 year ago

"...In any case, you are free to use cash. But you will often have to document cash transfers with paperwork, like receipts etc. In addition, many cash transactions are taxable and reportable..."

This is the point. If you are claiming to be a responsible steward of tax-payer funds, you need to be able to prove that.
Wanna use cash to buy some dope? Fine. Wanna use cash to launder taxpayer money? Ooops.

    2. Vernon Depner   1 year ago (edited)

But Willis refuses to say where the cash came from, and admits to using it in ways that are irregular for an official on the public payroll. That creates an appearance of illegality that demands investigation.
