Alabama Cops 'Violently' Arrested Two Elderly Women For Taking Care of Feral Cats

In 2022, Wetumpka, Alabama, police violently arrested two elderly women and charged them with a litany of criminal offenses. Their crime? Taking care of stray cats. The pair has now sued the officers, arguing that their arrest and the resulting charges against them were unconstitutional and caused "significant physical and emotional injuries."
According to the complaint, Mary Alston, who was 60 at the time, often worked with Beverly Roberts who was then 84, to "trap-neuter-return" (TNR) feral cats. TNR is a common strategy of limiting stray cat populations by safely capturing cats, having them spayed or neutered by a veterinary clinic, and releasing or putting them up for adoption. According to their complaint, Roberts and Alston took up this practice because "neither the Humane Society nor any other animal rights organization had the resources to conduct TNR in or around the City of Wetumpka."
On June 25, 2022, Alston was setting up a trap for a feral cat on local public property when she saw Wetumpka Mayor Jerry Willis drive past, followed by police vehicles. However, within minutes the three police officers who had been trailing Willis turned around and approached Alston.
According to the complaint, Willis later admitted that after observing Alston, he ordered the police to approach her. Further, the lawsuit alleges that "Willis was angry that Ms. Roberts and Ms. Alston frequently complained, both publicly and to officials at Wetumpka City Hall, that. Willis was failing to enforce laws and ordinances prohibiting the 'chaining' of dogs."
Body camera footage shows one officer telling Alston that someone called about a person feeding feral cats.
"Ya'll got three cop cars because I'm feeding cats?" Alston said to the officer. "Wow, it's unbelievable."
The officers demanded that Alston leave the public property, and then left the scene. However, Shortly after this encounter, Roberts joined Alston. The pair were on public property, and sitting calmly, waiting for a cat they were hoping to trap to arrive. However, the three officers soon returned. This time, the complaint states that they informed Roberts that she would be arrested. When the officers handcuffed Roberts, Alston got out of her car and attempted to speak with the officers.
"The officers ordered Ms. Alston to quit talking and to get in her vehicle. Ms. Alston complied with the officers' demand to get back into her vehicle but continued to try to speak to the officers," the complaint states. In response, one of the officers, Brenden Foster responded by grabbing Ms. Alston, jerking her out of her vehicle by force, and then handcuffing her."
The pair were then taken to a local jail, where they were mistreated further. While in jail, Roberts lost consciousness and hit her head. However, the complaint alleges that an officer who witnessed this did nothing, and she was not given any medical help. When Roberts later asked to make a phone call, she was allegedly told that a call is a "privilege, not a right," which is in violation of Alabama law.
Ultimately, the pair was charged with "criminal trespass, obstructing governmental operations and disorderly conduct," according to the complaint. In December 2022, a municipal Judge found the pair guilty and sentenced them to "10 days in jail, suspended, two years supervised probation, and a $50 fine on each charge," though the charges were later dismissed on appeal.
While their charges were ultimately dismissed, the pair is still suing, arguing that the officers and mayor "directed the unlawful arrest and malicious prosecution of Ms. Roberts and Ms. Alston to retaliate against them for exercising their First Amendment rights to peaceably assemble on public property, engage in expressive conduct…and engage in peaceful political speech."
However, it's unclear whether the pair's suit will be successful. Generous qualified immunity protections prevent police officers from being sued in civil court under most circumstances—meaning that police can count on being able to engage in gross misconduct with little risk of actually facing consequences.

The cats actually ARE the descendants of immigrants. The ancestor of all domestic cats in the world, feral or not, lived in North Africa and the Middle East thousands of years ago. No cat native to the Western Hemisphere has ever been tamed, much less domesticated.
Unfortunately, the Norway rat and the European rock pigeon are also immigrants. Cats hunt and eat the Norway rat and are one of the few things that can keep their populations under control. They don't seem to catch pigeons that much, but raptors such as peregrine falcons do. The peregrine falcons unfortunately almost went extinct thanks to DDT and thanks to the near total ban on DDT we now have something that can control the pigeon pests.

Cops like to threaten "Obstruction of Justice" when they are just harassing regular folks. When I lived in Colorado I looked up the law. To obstruct an officer you had to interposed yourself between the officer and another person he was trying to arrest. I suspect it's similar in other states.
I am glad that I live in New York City. The city government encourages exactly what these women were arrested for doing. My wife and our next door neighbor feed feral cats and did TNR on a bunch of them. Thanks to the feral cats we have no resident rats on our block. NYPD knows that it has more important things to worry about and that is a major reason why NYC has the third lowest homicide rate of all large US cities. (San Jose and San Diego are lower.)
My ex has been feeding and TNR'ing a feral colony in Oceanside for years. Never a problem.

Emma, I know you haven’t yet grown up thinking that Trump orchestrated a coup and QI is like a magic wand but, as usual, it would generally help if you not misinform your readers. If saying a telephone call is a privilege, not a right is a clear violation of Alabama law, then QI may not save anyone/everyone. However, if the suit is that the Mayor directed the arrest and subsequent tomfoolery, it seems like, from the facts presented here, it will get tossed for lack of evidence/standing before QI ever becomes an issue.
That said, kudos on the use of quotes around 'violently' to describe an arrest where no one gets shot, set on fire, punched in the face, choked out, or has and bones broken and/or the most 'violent' things to happen are that someone gets pulled out of a car and everyone does literally nothing while one person, allegedly, faints.

So, from a defense perspective, there's two issues at play here.
1) They're feeding stray cats. No. Don't do that. It's not illegal per se, but I can see the argument for it being stretched into nuisance. And for trespass, if you've been explicitly told not to do that there before (which they had been). The whole reason you never feed a stray cat is because the next night ten more show up - and if the city/county has a previously recognized problem with this, then yea, the women are contributing to it.
2) They're feeding them because they're ostensibly engaged in this "TNR" practice. Now, they're relying pretty heavily on the notion that they're doing this in a public place - but there's 3 counterarguments to that: A) If the ratio of new strays to TNR'd cats is out of whack, then that probably IS a nuisance; B) just because you're on a public lot doesn't mean you can go setting traps on it (which they were expressly told not to the previous summer); and C) one could argue that the practice of TNR is intended to be carried out by Animal Control (or outsourced to the Humane Society, who the women didn't work for), a role they're unilaterally usurping based on their beliefs about the city's efficacy in the job. (Think vigilantes, but in the lamest way possible.)
And distasteful as one might find it - the city might actually be intentionally avoiding TNR approaches to the problem, choosing NOT to allocate resources to it on the belief that euthanasia in shelters a the better solution than whatever the city's proportional share of 2500 neutered cats/day being released as strays. Which the women are interfering with.
Meaning that, from the defendant's perspective, they were likely coming at this from a "Please stop helping" angle. Which the women balked at and continued to do anyway. Which, yea, will probably get you arrested for something. And you'll note that there's nothing in the Complaint about how effective they were in their TNR efforts. Relying exclusively on the lame canards of, effectively, "We were just trying to help" and "Shame on you, Mayor Cat Hater!" and trying to drum up a case for "excessive force" because *eyeroll* everyone thinks their arrest was excessively handled.
And no, I'm not going to address the merits of the arrest itself. I have little pity for those who argue in defense of anything other than just complying with the directions of cops, even if the cops are 100% in the wrong, and saving the fight for afterwards.
Confrontations with police are never wanted and inherently dangerous. Those who escalate them (yes, even little old cat ladies), rather than do everything in their power to help de-escalate them, don't get to claim clean hands.
Best case scenario, some shut up and go away money. More likely, the suit gets bounced.
