Brickbat: I Spy

European Union lawmakers say the European Media Freedom Act will give reporters greater protections. But a draft of the measure includes provisions allowing governments to insert spyware into the electronic devices of journalists if they are suspected of communicating with criminals or imperiling national security. The drive to include that provision was led by the government of France.

To be fair, this allows them to openly introduce the results in court and avoid the tedium of parallel construction. They're already inserting the spyware.

The high utility and food prices are part of it for sure. The deindustrialization Germany is currently experiencing due to the lack of affordable energy is another cause of the shift.
Convicted criminals often have restrictions when they leave prison. Would insertion of spyware into any device they have be appropriate for them? (provided they are still under some restrictions)
I think so. Particularly if their crimes were of the type that involved electronic communications - soliciting underage sex, conspiring to blow up buildings, etc.
No, they are not appropriate. Nor are any of the other "restrictions" applied after they have served their sentence. When your sentence is done, you are presumed to have fully paid your debt to society and are supposed to be allowed back in. This "let's punish them forever" attitude perpetuates the very problems that society is trying to fix.
But if prisoners are presumed to have some kind of agency, does that not allow them to contract with the government for replacing custodial time with supervised time? If I were given the choice of 10 years in jail or 5 years in jail and 5 years of supervision, I would choose the 5+5.
If you want to negotiate that as part of your plea deal at or before the time of sentencing, that's on you. (I could argue that the inherent power imbalance makes your "consent" in such a situation questionable and therefore the enforceability of the contract also in question but that's a separate issue.) That, however, has little to nothing to do with the scenario above where the restrictions are imposed outside of individualized sentencing and too-often retroactive.
I have heard of retroactive restrictions only in the case of sex offender registries, and I detest them.
Failing to restore other rights, such as voting and guns, are imposed on all ex-prisoners, and I detest them too. Heck, I think prisoners should be allowed to vote.
I have heard of prisoners who refuse early release on probation because they can't stand the idea of supervised release.
Democrats are taking notes.
