Brickbat: Overhang Oversight

Dozens of businesses in San Francisco's Chinatown have been threatened with fines for gates and awnings that have been in place for decades. Why, after all these years, have city building inspectors taken notice of these alleged code violations? They say they have received a rash of anonymous reports about them. City awning permits can cost up to $3,000.

Common law says if you don't enforce a law for decades its no longer enforcable and will not stand in court. US Constitution also says no ex post facto laws. The city/county can make them take them down under the new ordinance, but they can't punish them for having them in the first place.
But we're talking SF here, they don't give a shit about rule of law, they operate under the principle of rule of special people, and the governments of SF city/county are full of special people who get to rule.
San Francisco was a model of freedom and individual rights before Ronald Reagan made LSD illegal. Ponder that when trying to understand how Californian Bert Hoover turned the USA into Hoovervilles and other Republicans turned California into a fentanyl sandbox.
That's some impressive partisan mental gymnastics. Even though California and its major cities are completely run by Democrats, all of their problems are the fault of Republicans from decades ago and not at all by the Democrats currently in charge.
Reps helped screw the place up. Dems seem to be doing a lot more to make it worse than to fix it. There is no contradiction between these two statements.
Don't forget, St. Ronnie also got the ball rolling on gun control in Cali, due to all those scary black men.
Sorry, but you're wrong on several fronts. Desuetude, the idea that a law is considered void if it's not enforced for a prolonged period, is more commonly applied under civil law systems than common law. It's not generally recognized under US law, and insofar as it is, it's generally applied to criminal penalties, not civil. Secondly, it's well-established precedent that the Constitutional ban on ex post facto laws applies only to criminal laws, not civil. You and I may not like or agree with this idea, but it's currently the law. Finally, this isn't ex post facto anyway. They're not passing any new laws, they're merely stepping up enforcement of existing laws.
None of this means I support these actions. I strongly suspect they're nothing but a cash grab. But like it or not, the grabbers have the law on their side.
There was a postwar movie about this. A tightass cop going around citing businesses for the height of an awning or sign. The moral was that the cop ought to be a pal and ignore the law the looters pay him to enforce, RATHER THAN that the politicians should trouble to repeal the wretched things. Ambrose Bierce defined congress as: "a body of men who meet to repeal laws." The LP traditionally strove to extend this to include state legislatures and city councils.

Do you really need to know anything else? Tax revenue isn't looking too good right now, gotta bring in the dough somehow. When their tax base collapses, local governments often turn to fines and fees to support themselves. Similar hijinks are afoot in Florida, and they've been going on for years elsewhere. If the burden happens to fall most heavily on the poor, tough luck.
