Brickbat: Reckless Driving

Addis, Louisiana, police officer David Cauthron has been charged with two counts of negligent homicide and one count of negligent injuring for his role in a high-speed chase on New Year's Eve that left two teens dead. The chase started after a man stole a family member's car. Cauthron reportedly ran a red light and slammed into an unrelated vehicle in which the teens were riding.

I don't know how this is a brickbat. Know what happens when police don't chase? Way more people try to escape.
Seems like they're also charging the person he was chasing with the deaths. IMO you can't have it both ways; you can't say the officer was negligent and that the other person should have forseen the negligence of a random police officer.
I wonder which of the two charged in the deaths will be convicted.
Just note that the officer was not charged with homicide by the Reason editorial staff. He was charged by the same local law enforcement system he works for.
Apparently they thought the chase was not justified, and I don't believe they are suffering from some sort of excessive self-hatred.
Unless the fleeing suspect poses an immediate danger, chases are stupid. They endanger both the cops and the public. That's why many police agencies have policies to sharply restrict chases. If this means people running away, so what? In most cases the suspect can be arrested later, without endangering people who are just walking or driving down the street.
Of course you can charge both the thief and the cop, since they were both in the wrong. Neither party's bad behavior justified the other.
What do you mean they both can't be charged in the deaths?
You drive your friend to the bank, he comes running out and jumps in the car and says drive - and you do. Then you ask him why and he says he just killed the guard. You think you won't be charged as an accomplice? You didn't pull the trigger... didn't even know the trigger was pulled.... You are culpable.
It seems like they could add emergency signal preemption to the signals there to make it safer for the emergency vehicles (police, fire, paramedics) involved. We have that here, and a signal will turn red for cross traffic before one of them arrives at the intersection, allowing them to safely go through on a green signal.
If they did a Brickbat on a buggery story, one could say there would be a lot to unpack.
Was the thief driving dangerously before the cop showed up?
If not why did he chase him at all?
They know who to look for.

What does Reason want?
1. Criminal actions should not be prosecuted. Theft is OK. Sounds like the SFC branch of the LP.
2. Require policies and technology to make prosecution safer and kinder. Specifically, all vehicles must have mechanisms so law enforcement can shut them down remotely. Sounds like the Silicon Valley/D.C. branch of the LP.
3. Require police staff and systems to have super-human (if not super hero) abilities, including perfect foresight and instantaneous judgement. Sounds like the Marvel Comics branch of the LP.
1. The car was stolen by a relative of the owner. They know exactly who the thief is and where the thief lives. Absent pre-chase reckless driving by the thief, a high speed chase was in no way needed to catch the thief.
2. Nowhere does the article call for anything remotely resembling this.
3. How about requiring police staff to have some basic common sense (see my response to #1).

And unless they apprehend him with the car, he drives it somewhere else, gives it to someone else, and the justice system is left with zero evidence and the victim is left with a he said/she said battle in civil court.

Does the government, the public, owe criminals and their victims swift and timely justice or security in persons or effects or can we just delay it?
I kinda used to believe the whole "just arrest/cite them later" notion and I still agree that it makes sense for some crimes or relative to other police policies/actions but, after 2020, it feels an awful lot like people are making E-bHS's first point when they make this argument.

The only security in persons or effects you are owed is against government agents seizing you or your stuff.
And again, he was not charged with homicide by the Reason editorial staff. The charges were filed by law enforcement personnel. I hope we're not against law enforcement charging offenders.
It doesn't take perfect foresight or instantaneous judgement to know that maybe entering an intersection on red while going 80+ MPH probably isn't a good idea. Because even if the cops have super-human abilities the people crossing the intersection the other way on green probably don't.

That's really strange. Normally when police kill people in a chase, the person they were chasing is charged with murder. This officer must have been unpopular on the force.
From the article it seems like both are being charged.
We had a case here where an ex-gang member was being chased by his former colleagues in a high speed chase, and he hit and killed someone. The jury found him not guilty based on reasonable fear for his life.
I wonder if it would work if it was the police chasing you, and you had good reason (for example an affair with the cop's wife) to believe they intended to do a Tyre Nicholls on you.

I wonder what kind of range it has.
Flipping the light half a second before a squad car traveling at 80+ MPH enters the intersection doesn't seem like it adds much in terms of safety.
We have them in my town and they have a decent enough range to change the light and let an emergency vehicle through even at 80+ MPH, provided the emergency vehicle has the strobes on, however I often see cops gunning it down the street with no flashing lights. They end up having to stop at a red and turn the strobes on and wait for the system to change the traffic signal.
