Suburban Mom Handcuffed, Jailed for Making 8-Year-Old Son Walk Half a Mile Home
Heather Wallace plead guilty to child endangerment and can no longer work with kids.
Heather Wallace's oldest son, 8-year-old Aiden, was driving his two brothers crazy in the car as they all returned from karate one afternoon in October 2021. Wallace asked Aiden to walk the rest of the way home—half a mile in quiet, suburban Waco, Texas—so that he could calm down.
For this she was arrested, handcuffed, and thrown in jail.
She was charged with endangering a child, a felony carrying a mandatory minimum of two years in prison.
"It really brought us into deep trauma," says Wallace.
She is finally able to speak out after completing a six-month pretrial diversion program to get the charges dropped. But her arrest remains on the books—easily searchable by employers—which is disastrous for someone with a Bachelor's degree in education.
Here is how the events unfolded.
Aiden agreed to walk home; after all, it was something he had done many times. There are sidewalks the entire way, and practically zero traffic.
But 15 minutes later, two cops knocked on Wallace's door. Her son was in their patrol car. Another officer was parked across the street.
A woman one block away had called the cops to report a boy walking outside alone. That lady had actually asked Aiden where he lived, verified that it was just down the street, and proceeded to call nonetheless. The cops picked up Aiden on his own block.
As they stood on her porch, the officers told Wallace that her son could have been kidnapped and sex trafficked. "'You don't see much sex trafficking where you are, but where I patrol in downtown Waco, we do,'" said one of the cops, according to Wallace.
This statement struck her as odd.
"They were basically admitting that this is a safe neighborhood," she says.
The officer then asked Wallace whether she would let her son walk home again, now that she knew about the sex trafficking.
"I still didn't know it was illegal and I said, 'I don't know,'" says Wallace. "That's when the cop replied, 'Okay, I'm going to have to arrest you.'"
He proceeded to do so in front of the kids, handcuffing Wallace behind her back.
By this point, the cops had allowed Aiden to get out of their car and called Wallace's husband, who arrived at home. Then they put Wallace in the cruiser. She didn't have her shoes on, but the cops told her the jail would provide a pair. It didn't.
In the backseat, still handcuffed, Wallace was interviewed by a case worker with Texas Child Protective Services. All in all, it was about three hours from the time the cops showed up to the time—around 8:30 p.m.—that they drove Wallace to the McLennan County Jail, where she was locked up.
"I'm a suburban mom—I didn't know what I was doing," says Wallace. "I got booked at 4:00 a.m."

The next day, Wallace's husband paid her $300 bail and they went home. When Aiden heard his mom come in, he looked up, panic stricken. "I ate your piece of cake!" he confessed. "I didn't know you were ever coming home."
Child services had the family agree to a safety plan, which meant Wallace and her husband could not be alone with their kids for even a second. Their mothers—the children's grandmothers—had to visit and trade off overnight stays in order to guarantee the parents were constantly supervised. After two weeks, child services closed Wallace's case, finding the complaint was unfounded.
Wallace believes this could be due to the Reasonable Childhood Independence law that Texas passed in 2021 with the help of Let Grow, the non-profit I co-founded. It's part of HB567, a larger child welfare reform bill, and clarifies that parents are allowed to let their kids engage in independent activities as long as they aren't putting them in serious, likely danger.
"I'm encouraged to see CPS follow the law the legislature enacted to protect parents from government interference when they make reasonable parenting decisions," says Andrew Brown, associate vice president of policy at the Texas Public Policy Foundation, which worked on the bill.
Unfortunately, HB567 amended only family law, not criminal law. This meant the cops were still free to punish Wallace.
She obtained a lawyer, who told her that if she admitted guilt, she could participate in a pretrial diversion program that would close the case. On the other hand, if she went to trial and lost, she faced a minimum of two years behind bars and a maximum of 20. So she took the plea deal.
Her diversion program required 65 hours of community service, which Wallace completed at an early childhood center. The program mandated that she only work there during the weekends, when there were no kids around for her to endanger. She helped develop the center's curriculum and also did some cleaning.
Meanwhile, she was forced to resign from the pediatric sleep consulting business where she worked, for the same reason: child endangerment charges. There went half the family's income. She found work at a cookie store instead.
To comply with the program, Wallace also had to take a parenting class and eight random drug tests. Ironically, that meant she sometimes had to leave the kids by themselves for an hour.
"We couldn't afford a babysitter," she says.
At the lab, Wallace had to pull down her pants and underwear in front of a supervisor. "Then I'd pee into a cup while they're watching."
Wallace's sister has started a GoFundMe for her. She is in debt after losing her job and paying for the lawyer and the diversion program. She also hopes to hire a lawyer to get her record expunged so that she can work with kids again.
But in her pretrial essay, which required her to admit guilt and remorse, Wallace thanked the officers for teaching her how wrong she was to have her son walk half a mile on a warm day in his own neighborhood. From now on, Wallace wrote, "I will continue to grow more as a parent and a person."

The problem is the cops, but also, I would have risked a possible two year jail sentence for the opportunity to clear my name. If I am going to get my life ruined by not being able to work in education like I am trained to do, then might as well get right in there and risk possibly getting thrown in prison. If everyone who is unjustly arrested just caves then that is a bigger problem.
The problem with being unjustly arrested is that they pile on a bunch of unjust charges and you end up with a choice between going to trial and facing years in prison if you lose, or taking a plea. That's why innocent people take the plea. The cops and prosecutors have immunity so they're going to lie their asses off in court. It's hard to defend against liars with power. So most people take the plea.
But the problem is, your name isn't really cleared. A lot of casually ignorant people would hear the basic story that you took a deal and got the charges dropped, and assume you were guilty. It also perpetuates the system of prosecutors padding their stats by overcharging arrestees and then offering plea deals that count as convictions even though the person essentially confessed under duress to a crime they didn't commit. If you're innocent, you should always fight. Get a good lawyer. It's worth whatever you have to do.

Judges know that when a cop opens their mouth a lie falls out, but they treat their testimony as truth. How do you fight that?
That's not what I've seen in traffic court. But even if they do, that system can't exist without defendants choosing to participate in it. If people stopped pleading to false/exaggerated charges just to get it over with, prosecutors would have to stop pushing plea deals.
Last time I went to traffic court the judge said, and I'm not exaggerating "You are all guilty. The law says the radar is right even when it's wrong. So if you can prove you weren't speeding it doesn't matter. I'm still going to find you guilty. Now let's start wasting my time."

It’s more than just getting it over with. People routinely face years of their life being taken away for something they didn’t do, and they know the system is run by people without souls. Cops lie about literally everything, prosecutors knowingly pursue innocent people because convictions looks good on the resume, and judges don’t care. Taking a plea is the logical choice in most cases.
Part of the answer has to be in the jury. Juries need to look at cases where it is clear that someone is being overcharged or that the prosecution is stacking on extra charges and find them not guilt of most, if not all, of the charges. Nullification is part of the answer.
Jurors are not independent actors. They are supposed to follow the instructions from the judge. You even mumble the word "nullification" and you'll be kicked off the jury and maybe jailed for contempt.

Aiden agreed to walk home. Great. Can he also agree to marry a 40 year old woman selected by his mother? Why did she kick an 8 year old out of the car a half mile (2 minutes or less) from home? The lawyer advised pretrial intervention instead of trial; a judge signed off on it. We are definitely missing facts - starting with the interview of the 8 year old.
According to the story, Aiden had to walk because he was misbehaving in the car. I am not sure the reason is relevant to the charge anyway.
The lawyer said the reason was irrelevant. It was simply the act of him walking home by himself. I asked the lawyer... was it something I said? Nope.

It was half a mile. My kids walked half a mile to the elementary school around the corner without an adult, starting in about second grade or the same age as Aiden Wallace. Stop and think about how short a distance that is. Unless there's something in the way, you could clearly see his house from any point along that walk. If we're missing any facts, it's most likely a pre-existing dispute between Aiden's mom and the neighbor who sicced the cops on her even though she knew he was close to home and not lost.

Before I started second grade, the school district I lived in noticed my parochial school had relocated its driveway. This resulted in our house being 90' short of a mile, and we were told we'd lost bus service. As a result, I walked home nearly a mile each day for 7 years. Sometimes I was allowed to ride my bike. My Dad usually dropped off a station wagon full of his brood in the morning, since it was on the way to his job in the next town over.
My walk was cut in half for high school, as that institution was closer. We were not allowed to walk or ride all over town (though I broke that rule, repeatedly.) Grade school years: 1960s. 60 miles from Times Square on Long Island. It's not like there weren't some freaky-deaky things going on then. Never to me, though.
Unfortunately Aiden is outraged as well, "They're treating me like a baby! I can walk home by myself!" he always says! He is also quite outraged that he had to sit in the cop car for 30 minutes. He tried to call for someone to get him out, but no luck. Now I'm having to figure out how to teach him that most police officers are there to help, and that it's important that you cooperate with them. (Which I thought I was doing when I was answering questions and listening intently to the officer, trying my best to be respectful.) I'm terrified that this incident will cause him to be uncooperative with an officer and something worse than jail might happen.

How is this anyone's business except the parent's and the child's?
I'd assume that he was kicked out of the car about a half mile from the house because that's about where the misbehavior reached the level where his parent deemed it appropriate that he lose the privilege of riding in the car. And no, he can't marry a 40 year old, or anyone, or buy a gun, or drink alcohol. He's eight, and the law is clear that eight year olds can't do those things. Can you advise on the maximum distance that an eight year is legally permitted to walk unsupervised, but with parental permission, according to Texas law? Because I'm betting there's no such thing in Texas law.

What are you talking about? Rittenhouse, whether you like him or not, had a legal right to be where he was, and he had a legal right to carry the rifle. He was set upon by the first assailant--he retreated (i.e., did what we would expect)--and could not retreat further with safety. He then shot the assailant--the only question, from a legal standpoint is whether, the state had any evidence that could disprove self-defense beyond reasonable doubt. Obviously, there was none. (Note: the mere fact that he shot someone isn't, given these circumstances, enough to satisfy the minimum evidence standard.)

At nine I was riding my bike to school and friend's homes. At elevel I had my own newspaper route, which I managed completely on my own. At 12 we moved to the next town over, and I kept riding my bike to finish school at the one I'd been attending for six years. I had friends further and further from home, and rode there. At 13 I discovered sailing, and rode my bike 17 miles each way to where the boat was moored. By the time I turned 18 I had ridden my bike all over Southern California, on my own or rarely with a friend (few could keep up with me on those hundred mile and lonver rides, so I went solo). No cell phones then to just buzz home and say "Mommy come get me I'm tired" One time in pouring rain I called for a ride home. After we got there and I dried off some, Mom said I cane and got you this time. Don't let it happen again. YOU learn about the weather and when it promises rain either stay home or bring a raincoat. I'm NOT packing all the kids into the car to come get you again.
Guess what? Sixty years on I have ridden a couple hindred thousand miles on a bicycle and have not once called for a ride home. I've always gotten back in one piece on my own.

When I moved to a large city at age 11, I drove my bike across traffic, used the car lanes, and traveled to and from middle school on my $200 Schwinn 10-speed.
I’m glad I never got arrested at the stop light, where I crossed the 8-lane city thoroughfare that separated my neighborhood from the school’s. I was one of the few who did this, but I felt that walking my bike and following the pedestrian route was too wimpy and slow. I preferred to make all of the moms driving their kids to school wait behind me, because I literally took the whole lane most of the time and preferred that they not pass me.
I used the sidewalk where it was bike-friendly, but we kids were actually taught that the sidewalks are for pedestrians. In those days, the sidewalks stopped abruptly at a curb, and navigating street curbs with those skinny wheels was extremely difficult and bone-jarring. This was long before mountain bikes were used in cities and sidewalks were made for wheelchairs and mobility scooters. My path to school was 1.2 miles, about half of which I traveled on the road.

As someone who was a “free range” kid by default, regularly walking over a mile from home at that age, it seems insane that it should be a criminal issue.

Because parents can’t parent their children, we’re raising a generation of kids who think they don’t have to be accountable to anyone or anything. No wonder kids do heinous things like hurt teachers who give them bad grades, or shoot up classmates who upset them. The system is taking away parents’ power and kids know it. They grow up never being held accountable and think anyone who hurts or offends them needs to be punished or killed. Getting so triggered over someone disagreeing with kicking a kid out of a car for misbehaving by hurling abusive language at them is literally a textbook example of mental and emotional abuse. Don't worry about who raised me. Be more worried about who hurt you, and how this is affecting your current outlook in life. I made my oldest daughter do that once. She had to walk in front of the car the rest of the way home, maybe 1/2 to 3/4 a mile. Now she’s about to graduate with honors and a full ride scholarship to a great college. Different strokes for different folks. The punishment fit well at the time and she learned a lesson. Just because your mom didn’t ever do it doesn’t mean it’s immoral or that it should be illegal.
Got bullied by a kid in grade school. The bully was only there about a year. His friends said his home was a blast to hang out in because his mom was never there and let him do anything he wanted. When I graduated HS, he was on the news. It wasn't clear whether he shot himself or his partner-in-crime shot him in the head during an interstate manhunt as the result of a multiple homicide. Not theft, or burglary, or rape, or vengeance... just multiple homicide.
I'm not so insane as to assume that every overwrought single mother or doting Norma Bates is producing a brood of homicidal sociopaths. I'm also not so insane as to assume that everybody's upbringing would, should, or could go off like mine did, we got to walk out to the orchard and pick our switches when we misbehaved too badly. We had to walk half a mile just to get to the end of our driveway, and it was a sheet of ice half the year. Then if we missed the bus we had to walk the 5 miles to school uphill, and in winter chop wood for the fire to heat the building before the other kids got there.

5 miles merits a bus. Walking 1 mile per 15 min, means it takes to walk to school and then home. That is 2.5 hours walking. While it is good exercise, it is also a waste of time. It requires kids to get up earlier and so too parents (mom) to make breakfast. One mile is a reasonable distance to walk. This kid only had to walk 1/2 mile -- maybe seven minutes; less if he hustled.
I don’t think an eight year old can maintain a 4 mph walking pace needed to average 1 mile per 15 minutes. That’s a pretty good pace for a full grown adult.
When my siblings and I walked home a mile from school, we were under orders not to run. My parents were worried we'd run through intersections without watching for cars. Even if there was little to no traffic, they didn't want us ruining our Catholic school uniforms.
I took note of the technique of Olympic speedwalkers and put some of those tricks to use, so a 16 min mile wasn't far-fetched, even carrying a full bookbag.
I think it was mostly a jobs program.

When I was 12, I used to stay home for a few weeks at a time while my parents, grandmother, and brother went to visit relatives. No cops can do anything to them now, they are long dead. I had a paper route. I stayed home, worked, went voluntarily to summer school to study stuff I wanted to learn, cooked, cleaned, and generally took care of myself. The neighbors kept an eye on me, but I was essentially on my own. When I turned 18, I was out of the house, living in Arlington Virginia and amazingly, could take care of myself. I learned it when I was 12. None of my children came back home after they graduated from college, except to decide where they wanted to live, because I taught them to be independent. They live now all over the US, and one lives overseas. Maybe our fascist, overzealous imbeciles in ACS and our cops should recognize THAT. A sad commentary on this country.
