Brickbat: Not What He's Getting Paid For

A New Orleans court constable has been suspended without pay pending an investigation after being accused of ignoring a bystander's plea to help a woman who was being raped on a public street. A 911 call showed the bystander reporting the crime and telling the dispatcher she saw an officer parked nearby. The dispatcher told her to ask the officer for help, but when she did, the constable ignored her. The officer was off-duty but providing security for a movie shoot. "We are all shocked that anybody could get that kind of complaint and not respond timely," said Constable Edwin Shorty, who oversees that department. He did not release the deputy constable's name.

Every arrestee, no matter how bogus the charge, gets his name plastered all over the Internet, but this guy is exempt from such things. A civilian, even if innocent, would get his name out there.
They won't release his name because he will be re-instated with back pay following an investigation that say he did nothing wrong because he was properly assigned to the movie and couldn't leave his post.
(the investigation will be "ongoing" until the story dies down)
They will also add that he was off-duty, which means he's not obligated to spend his free time enforcing the law.
And under federal law (SCOTUS decisions) there is no duty to protect even on duty, so unless Louisiana has something on the books... sol on a lawsuit.
But the fact that no one else stopped this also speaks volumes to this country's deferral of power to the authorities. Should have gotten, 5 guys off the street to beet the shit out of the rapist when the off duty cop turned you down. Of course they'd be arrested for making the Blue look bad.
I find it interesting that police can wear their uniforms (was he using his patrol car? not mentioned) and pretend to be policing, when they are not.
Which also begs the question, can you get charged with assaulting an officer or resisting arrest if they aren't on duty but are wearing their police uniform? Is it in the public interest that off duty police go around wearing their uniform while doing non-police work? That seems to be a misrepresentation and a lie, so I'm against giving these government employees a license to do so, and it should be illegal for police to wear their uniforms except where permitted while off duty (I suppose exceptions for funerals would be warranted but unnecessary).
Long time ago I was out with friends for a "bachelor party". There was a guy who was in civilian clothes and totally trashed. He starts picking a fight with us and finally goes too far. One of my friends punched him, once, knocking him down, The Police came and we found that the guy was a cop and my friend was charged with assaulting a police officer. With witness testimony and help from a JAG lawyer the charges were dropped. So yes you can be charged with assaulting a "police officer" even if they are not in uniform.
About the same time Jacksonville Florida Police were allowed to work part time jobs as security, in uniform. His lack of response may have been covered under his employment agreement or Police regulations. I wouldn't jump to a conclusion without knowing more.

True. Cops have no legally enforceable duty to protect citizens in general from crime in general, much less to protect any particular person from any particular crime. If this particular LEA has higher standards, good for them.
