Religious Schools Needn't Follow New Title IX Gender Guidance To Stay in School Lunch Program

Food fight for religious schools resolved. Religious schools need not follow new Biden administration Title IX guidelines in order to receive federal funding for school lunch programs, according to new guidance from the U.S. Department of Agriculture (USDA). The announcement comes amid a major battle that somehow wraps up gender identity and cafeteria food.
This food fight started when the USDA announced in May that it "will interpret the prohibition on discrimination based on sex found in Title IX of the Education Amendments of 1972, and in the Food and Nutrition Act of 2008 … to include discrimination based on sexual orientation and gender identity." This brings it in line with a Biden administration executive order issued last year.
Title IX previously applied only to sex-based discrimination but is being expanded to cover discrimination based on sexuality or gender identity. Many oppose the change, suggesting that it smuggles in certain ideology about gender—and all that entails with regard to sports, bathrooms, etc.—under the auspice of mere non-discrimination.
In the USDA's May announcement, it said schools participating in federal nutrition programs including the National School Lunch Program would have to update their non-discrimination policies and signage to match the new guidelines. That meant including sexual orientation and gender under the umbrella of sex—a development against which many conservatives and religious schools pushed back.
A number of people have characterized the fight over the new USDA guidelines as Republicans wanting to discriminate against transgender kids in school lunch programs, sometimes engaging in some majorly disingenuous rhetoric to make the point. For instance, California's Democratic Gov. Gavin Newsom characterized the opposition as "arguing LGBTQ children should starve."

This is a mischaracterization. There's no evidence that school systems have been or are planning to deny trans students equal access to lunch programs or anything like that. Nor have there been any reports of low-income students denied food assistance because they're gay.
Rather, opponents of the USDA guidance—including the 22 states suing over it—object to the larger change regarding Title IX and gender identity, and see the USDA announcement as a way to force them into accepting it by holding lunch money hostage.
Religious schools are off the hook, however. They can claim an exemption and don't even have to file paperwork to do so, the USDA said in an August 12 memo. Title IX "includes some exceptions, including one permitting an institution to be exempt on religious grounds if there is a conflict between Title IX and a school's governing religious tenets," it pointed out. "USDA regulations do not require a religious educational institution to submit a written request for a Title IX exemption in order to claim that exemption."
But the battle continues for public school systems.
The lawsuit filed by 22 states in July, "seeks to stop the Biden Administration from enforcing an expansive and unlawful interpretation of federal antidiscrimination laws under the threat of withdrawing key food assistance program funding," per a press release from Tennessee Attorney General Herbert Slatery. The complaint says the USDA changed its guidelines for school lunch programs and food stamp benefits without allowing for proper input as required by the Administrative Procedures Act.
"To be clear, the States do not deny benefits based on a household member's sexual orientation or gender identity," the complaint stressed. But where the USDA's old policy "prohibited discrimination only 'in any program or activity conducted or funded by USDA,' the new policy seemingly applies to each program-administering 'institution' as a whole," it says.
"Because Congress has declined the Biden Administration's call to rewrite Title IX and other statutes," and "because the Department of Education has so far not prevailed in the States' lawsuits against its" guidance, "the Biden Administration seemingly decided to use the USDA to accomplish its rewriting of Title IX through other means."
States are also challenging the Biden administration's interpretation of Title IX more broadly. Twenty states have filed a federal lawsuit against the U.S. Department of Education and the Equal Employment Opportunity Commission. In July, the U.S. District Court for the Eastern District of Tennessee temporarily blocked the enforcement of the rules.

I've been hate watching the latest season of Westworld, and it's weird watching a show in which a major plot point is the attempt to insidiously indoctrinate, dominate, and enslave the world's population made by people (cast and production crew at the very least) who I'm sure agree with the WEF point of view 100% and regard any views from outside their bubble as dangerous misinformation. Some people might read subversive intent into the show, but the self-awareness for that just isn't there. This is a show in which Tessa Thompson's character makes evil boasts about how easy young people are to manipulate but then, I'm sure, in real life would condemn anyone concerned about grooming in schools as bigots. This lack of self-awareness is for me one of the defining features of progressives, who almost exclusively belong to the privileged ranks of society and nearly always punch down while thinking they are bravely punching up. People on the left are very good at convincing themselves that their struggle is with the powerless instead of against them. They love to see themselves as champions of freedom, but their actions are always collectivist to the core, and when they very rarely take a position that seems to push for individual liberty, such as abortion on demand, they also inevitably push for a rollback of the liberties of others, and so abortion on demand must be publicly funded as well with no religious exemptions permitted for providers who decline to provide abortions. My curse on the left would be self-awareness.

I don't know why we ever needed national funding for school lunches in the first place. That should all absolutely be taken care of locally, with potentially SOME small assistance at the state level for the poorest districts.

On the contrary, it is the exact opposite. Our kids have had "Free Lunch" since they went back to school post-COVID. What inevitably happens is that if you aren't one of the first kids, you get nothing or you get some prepackaged snack that none of the other kids wanted. My kid is in an extra curricular program that takes up the first 10 minutes of lunch. She has to go off campus if she wants to eat.
So the fun experience of food lines at an early age. Sad.
They've carefully constructed a foundation of feeding a large group of kids with federally funded programming. This was made evident during the Pandemic when those kids couldn't go to school and we suddenly had a large population of 'food insecurity' families and a new program for BF and lunch pickup for these families.

Also, all the Religious Right crowd has won is an equal opportunity for kids in religious schools to have crappy lunches like everyone else.
Fortunately, this is an opportunity for Secularist Libertarians to pull their food trucks to the school curb and show kids how real good food is made by real humans using natural processes.

Anytime I see that comments are disabled on something like a news posts or youtube video, I know I can almost always ignore what they are saying in that particular media. There are exceptions of course, but if there is a platform that normally has a comment section and it is "mysteriously" turned off for something in particular, I know it's something they don't any want guff for saying/posting because they know it's shitty.

There was a big drive to stifle voices in 2020 because of vaccine misinformation and then election misinformation. Now all those writers get shielded from critiques directly attached to their articles.
Journalists have disabled comments and no longer publish their emails. They are only available on Twitter, which has long ago kicked most people with any brains out. They have totally insulated themselves from any accountability or sensible views.
And they just block people on twitter so those people can't see their tweets anymore and can't reply or retweet, too. They insulate themselves so much. Which is fine for most people, but a Journalist's job is supposedly to be inform and be informed, so it's really problematic when they hide inside their own bubbles.

While I don't necessary disagree with this position, the scripture you're referencing has nothing to do with school, children or government education. It was in reference to taxes. The preceding question from Pharisees was: "Is it right for us to pay taxes to Caesar or not?"
Title XI allows for religious exemptions, so this is really a giant nothing-burger. But let's not miss-use scripture to attack faith based schools. I promise you, the Muslim school is happy to take government money and will also be asking for the same exemption. Nobody will speak out against "those" schools because people value their well being.
