Brickbat: Driving Them Crazy

For the past 36 years, Judy and Ed Craine parked their car on the driveway of their San Francisco home. But they recently got a ticket for $1,542 for parking there and the threat of another $250 a day in fines if they continued to park there. The city Planning Department told them that it's illegal to park in front of their home. After all these years, someone filed an anonymous complaint against them and two neighbors who were also parking in their driveways. The department told them they could be grandfathered in if they could demonstrate that parking was a historic use of the driveway. The couple found a 34-year-old photo of their car parked there but were told that wasn't old enough. They found an aerial photo from 1938 that they believe showed a car parked there but were told it was too fuzzy. They are now parking on the street.

Officials tell 7 On Your Side the couple was violating a code section banning vehicles in a setback in front of a house, even if it isn't blocking a sidewalk.
This is one of the stupidest things I've read. They're basically claiming a municipal easement up to the actual house.
Although, applying proggielogic, a driveway is for driving, not parking.
But a parkway is for trees and greenery, not parking either.

Yeah, the violation is "Use of Required Front or Rear Setback as Parking". This is one of those nanny regulations, for aesthetics, not for utility. You'd think they'd go after the homeless street poopers if they are concerned about aesthetics, because nothing looks or smells good with poop lying about. Apparently, SF would rather have good aesthetics for where the homeless can setup a tent and do their thing in the yard, rather than have someone's car parked on their own property. They deserve what they voted for.

Zoning laws are among the most confusing regulations that the average person will face. The simplest option for this couple is to apply for a variance. Unfortunately, they will be forced to bear the expense which can vary depending on the locality. In San Francisco I'm sure it won't be cheap.
And it most certainly will involve a consulting group and an environmental impact study.
That would be unusual for this type of request, but is is SF.

Without reading the linked story, I'm guessing this is retaliation by anonymous, else why complaints against two other neighbors? I'm guessing those 3 all complained about something of anonymous, so the best defense is a good offense.
