She Let the Kids, Ages 3 and 5, Wait Briefly in the Car. Now She Can't Be a Teacher.
Many parents are on the child abuse and neglect registry, and they don't even know it.

In 2018, Nzinga Terrell-Brown was hired as a teacher's aide: her dream job. But a couple months later, she was fired—and didn't know why. She got another teacher's aide job but was abruptly fired again.
What was going on?
As Scott Pham details in a thorough and jaw-dropping expose for Buzzfeed News, Terrell-Brown was listed on a registry. Not the sex offender registry, which is public, but the child abuse and neglect registry, which can be accessed by employers and adoption agencies.
Terrell-Brown had been placed on New Jersey's registry almost 10 years earlier after she decided not to wake her fiance's kids, ages three and five, when she popped into the store to pick up a birthday cake for the five-year-old. The errand was short, the weather was mild, and the kids were fine. Nevertheless, someone called the cops, and Terrell-Brown was charged with "inadequate supervision." For this, she was placed on the registry.
There are millions of moms and dads like her, registered for crimes ranging all the way from sex trafficking to letting their kids frolic outside. Recently, I wrote about an Arizona mom facing registration for letting her seven-year-old play at a popular park while she picked up a Thanksgiving turkey during COVID-19.
That mom's registration as a child abuser is pending, because she got a lawyer to fight it. But this is rare. As Pham chronicles with damning stories from across the country, getting placed on the registry is quite easy; getting removed from it is obscenely difficult.
"People can be placed on these registries on the sole judgement of a caseworker and a supervisor from a child protective services agency, without a judge or similarly impartial authority weighing the evidence," writes Pham.
Got that? The decision maker and the caseworker can be co-workers.
What's more, according to Pham: "In numerous cases reviewed by BuzzFeed News, people went for years without even knowing they had been listed—until they were turned down for an adoption or a job."
The agencies have not seemed terribly concerned about alerting folks to their registered status. In Michigan, for instance, an audit published in 2018 found that the child protection agency could not verify it had notified 40 percent of the people it placed on the list.
The deadline for filing an appeal to get off the list is far stricter, however. Appeals must be filed within months or, in some states, weeks. In Vermont, parents have 14 days. And the right to an attorney is usually not guaranteed.
"In virtually every state, people who have been accused of neglect do not have the right to court-appointed counsel," writes Pham.
The impact is felt most heavily on the poor and on minorities, in part because so many government employees are "mandated reporters": They must report every scintilla of suspicion or risk losing their own jobs. The more government services you receive, the more mandated reporters you have weighing in on your parenting. Racism is also a factor; in Arizona, five times more black people are on the registry than white people. In New Jersey, Terrell-Brown's state, the ratio is 4:1.
It's worth asking whether the list makes anyone safer. After all, how much safer would you feel knowing that a lady who picked up a cake while her kids snoozed in the car 10 years ago is not allowed to teach your kids in a classroom?
At Let Grow, the nonprofit I run, we are working to fix things at the legislative level. As long as the states allow improper supervision as reason enough for registry, no parent is safe, because no parent is perfect. Who among us has never had their kids wander off? Who among us has never let their kids come home to an empty house? Who among us has never let their kids play outside unsupervised?
The "Reasonable Childhood Independence" law that just passed in Colorado—and earlier, in Utah, Texas, and Oklahoma—narrows the country's open-ended neglect laws and ensures that neglect is when you put your kids in serious, obvious danger, rather than any time you take your eyes off them.
Meanwhile, other changes are afoot. Thanks in large part to activist Joyce McMillan, founder of the Parent Legislative Action Network, New York recently reduced the amount of time parents remain on the registry. Previously, they didn't exit the registry until their youngest child turned 28. Their records are now expunged eight years after the fact, which is comparatively lenient.
In 2019, a New Jersey court ruled that the state should appoint attorneys for parents who are trying to get off the registry and can't afford them. Terrell-Brown, who had doggedly requested an appeal and—to her surprise—received one, suddenly realized that she qualified for a court-appointed attorney, too.
Just a few weeks later, before any hearing, New Jersey's Department of Children and Families changed Terrell-Brown's neglect charge to "unfounded." That means she can be a teacher's aide, after all.

Well, obviously, I think that schools should be privatized and make such decisions privately based on business and safety considerations.
Having said that, even a completely private school system might handle this the same way, since ultimately, even the appearance of a careless employee would be bad for liability should a kid come to harm at school.
For those who were disagreeing with me in Shackford's morning thread- this is what I mean when I say the Government should be staying out of how parents raise their kids. Even when that comes to gender reassignment surgery.
I would tend to agree that a parent authorizing reassignment surgery on their kids is not healthy, and may even be abuse. But I also think that having the government get involved creates exactly these bizarre dystopias described above.
Most people know what abuse and neglect looks like, and yet we have the CPS ruining peoples' careers for these choices.
I am not a terribly social person, but I have many friends and family who have ended up on the wrong side of a CPS conversation because of rumor mills, misunderstandings and other general nonsense. We used to have posts from people on this forum who talk about how difficult it is to get out from under CPS once you are in the system. Untidy houses with dishes in the sink go down as "unfit living conditions" and an argument with a CPS officer can get kids put in foster care for months or years.
Despite the continuing ratchet of power afforded to the CPS, they have not been able to eradicate real abuse of children- all while making life a living hell for many parents. I am convinced that they do farm more harm than harm prevention. And I am convinced that empowering the government to police Trans issues between parents and kids will cause far more problems, while failing to actually lower the risks that I fully agree exist there.

If someone is obviously unfit to be in charge of young children, then not hiring them to be in charge of young children will make the young children safer. That's really not complicated, is it?

Leaving your children out of your sight behind locked doors for a few minutes instead of waking them up and distractedly dragging them crying into a market is not good parenting? Kids are injured or die in parking lots so often that it isn't even news, but a vanishingly small few are taken from cars. Neuroticism does not make for good policy.
I see your point, but I think your perspective lacks nuance. While there certainly are situations where leaving a child in the car while you run into the store would be negligent, there are others where it isnlt negligent. It really isn't black and white.

Now, a private school is going to have to decide whether to hire that mom, or another equally qualified candidate without such an accusation against her. Who do you think they are going to hire?
And the issue isn't even whether that particular situation was objectively dangerous, the issue is whether mom is able to follow widely accepted rules even when those rules are arbitrary, because as a teacher, mom will have to follow a lot of arbitrary rules even when she disagrees with them.
To be clear, I think what she did was safe in that instance. But even in a libertarian society, she would likely face problems because of her actions.

I was a single Dad, and my 9 year-old daughter had a cold. I left her with my 8 year-old for about 15 minutes while I picked-up a prescription for my 9 year-old.
A few minutes after returning home, the police knocked on my door. The officer and a state social worker were there to take the kids to their mother.

Let's see - a ULCC tanker runs about 15 knots in open ocean, so figure about 12 days (assuming no storms affect them -in hurricane season), and another month for refined gas to reach the market. So this might affect prices from mid-August to October.

3 and 5 year olds are well capable of taking the handbrake off, even starting the vehicle and moving it deliberately. I did at that age, and was just plain lucky the car didn't hit anything.
But that aside, you shouldn't leave children of that age alone for a minute, except perhaps in a locked padded room with no other contents. Adult supervision is required. If you aren't willing to give it, you aren't fit to be a parent.

Did it say she left the keys in the car? My car requires that I push on the brake pedal before starting it and I have to press on the brake again to put it into gear. If the keys are not in the ignition and the ignition is not in the "run" position I can't take my car out of gear.

It's perfectly legitimate to criticize her for leaving kids in the car ten years ago. That's not the issue. The problem is there's a secret list out there that is getting her fired from jobs, with no accountability, without any decision from a judge. And she didn't know it existed, she had no opportunity to appeal it.
Government shouldn't maintain such secret lists.
However, in a libertarian society, employers likely would maintain and exchange such secret lists. Employers would also likely be risk averse enough not to hire someone as a teacher who had left their young kids alone in a car ten years ago.

Now she needs an attorney. The authorities have admitted that she was placed on the list UNLAWFULLY ("unfounded"). This means that she is due her income from them first time she was terminated through her next employment.
However, remember that no district that hired her before will hire her again. No way in hell that is happening. So the suit needs to be for DEFAMATION OF CHARACTER as well. Since it was not accidental triple damages should apply PLUS attorney expenses.

A friend worked for a Sandwich and Six Pack store while she was in college. One evening a man cam in and purchased some beer and left. He came back and bought some more a few minutes later. This wasn't unusual because they were only able to sell one 12 pack per purchase. He repeated this a few more times and then left. What he did was to take the beer out to a car full of people who were under age. When the car left the Police pulled them over. My friend was charge with selling alcohol to people who were underage. Video backed her up and the charges were dropped. When she finished college she found that since she had been charged, she could not obtain a teaching certificate from the State. She was on a "list". There was and still is no way to be removed from it.
Another friend was a police officer. After his divorce his ex-wife wasn't happy with the settlement, so on the advice of her lawyer she filed for a PFA. When she filed she stated that he had threatened her with his issued weapon. This was investigated and my friend was fired from his job. It was proven that her accusations were false, but, it didn't matter. His Union and the DA wanted nothing to do with the issue, so now he can't get a job anyplace as a police officer because of another list.
I'm on the list because I had a bit of a breakdown during my divorce. I appealed it saying that it's not like getting a divorce after fourteen years is something that happens every day, but the word of a social worker is the word of God. The mere act of questioning it is treated like a crime.
and this story illustrates why government lists are so damned bad. this is why we don't want gun registration as that is also a "list". wonder why people build "ghost guns"? this is why.

The purpose of these lists is to ultimately take the child away from the parent and put the child in a foster home where they will be sexually abused and trafficked.
I was going to squall until I read your last sentence of this interesting, but troubling, article.
I am getting too old to do public work but wonder if a series of courthouse skirmishes with a perjuring accuser got me registered for two different no-contact orders she obtained. I fought the first restraining order all the way to the Supreme Court of NC. The second RO was obtained by fraud, and behind my back, i. e., without notice of the date of hearing.
At the trial level I was ordered to court 29 times defending against this evil woman. At least 6 times she tried to have me convicted so that for the first time in my life I would have had a criminal record.
The last court appearance I was forced into was a cyberstalking warrant which was dismissed by a judge who found that she had lied from the witness stand and committed malicious libel on Facebook. The first cyberstalking prosecution had been dismissed with prejudice by the DA after I caught him, judges, the clerk, and their corrupt pals tampering with court records. Either the judge, Hon. Sam Cathey, had changed his judgment from a probationary sentence to an active sentence, when he had no authority to do so, or someone had forged his signature and altered his judgment while the case was on appeal for trial de novo.
Finally the judges were in total agreement that she was a perjurer and shooed her away from the courthouse. And, thankfully, she is no longer living nearby and has fled to another state. Like Ligia Filler, Tiffany Hargis Bredfeldt, and Morgan Mischaune Wright, she left a lingering stink behind her.
This is a lot more than the soft tyranny that Tocqueville predicted.
