Upper Providence Township, Pennsylvania, police have charged Bruce Stanley Garner, a former school bus driver for the Marple Newtown School District, with 139 counts each of invasion of privacy, unlawful contact with a minor, criminal use of communication facility, and sexual abuse of children. He also faces one count each of endangering the welfare of children and possessing instruments of crime. Police said Garner took up-skirt photos of teen and pre-teen girls riding on his bus. The school district fired Garner after a female student complained about his behavior.

One count of "possessing instruments of crime"? Was that the phone? Kinda seems inappropriate to charge him separately with possession of a phone, if that is indeed the case.

Like in New York you get hit with "criminal possession of a weapon" if you hit somebody with something. Whatever you hit the guy with becomes a criminally possessed weapon. In Massachusetts it becomes a "dangerous weapon".

Criminal use of a communication facility? I love how it’s not enough these days to be charged with the underlying crime. Now you’re also charged for the tools you used, as if that makes it worse. So if he used a Kodak Instamatic it’s a lesser crime?

A case in New Hampshire got a lot of press a few years ago. High school boy had sex with a 15 year old girl, misdemeanor statutory rape without force. But he emailed or texted her to arrange their meeting, felony use of electronic communication.

Interesting contrast between the brickbats of the past few days. This guy does some creepy stuff (but doesn't physically hurt anyone) and he's up on 139 counts. Yesterday's cop does bad stuff over the course of two years (including outright theft and what would be assault if he wasn't a cop) and he faced 1 count of conspiracy and 1 count of falsifying a report.
