Biden's Plans To Fix the Pay Gap Won't Actually Help Women
Plus: A win for animal rights activists in Iowa, Republicans sue the CDC over air travel mask mandate, and more...

Yesterday was "Equal Pay Day," so named to mark the point in the year that a U.S. woman allegedly must work to make the same amount of money as her male counterparts made in the preceding single year. As has become tradition, Democratic leaders marked the occasion with big talk and little substance.
Their big idea was restricting the use of salary history in hiring. President Joe Biden released an executive order instructing the Federal Acquisition Regulatory Council to "consider" implementing rules that "limit or prohibit Federal contractors and subcontractors from seeking and considering information about job applicants' and employees' existing or past compensation when making employment decisions." Vice President Kamala Harris announced that the Office of Personnel Management (OPM) would "begin work to address the use of salary history in the hiring and pay-setting process for federal employees."
Careful observers may notice that nothing concrete is actually being done; the big announcements amounted to plans to "consider" or "begin work to address." But the amusingly toothless nature of these announcements is actually a good thing, since an actual ban on salary history disclosure (even just among federal workers and contractors) would be pretty silly.
The idea that salary history disclosures harm women has become commonplace—the thinking being that if women are financially disadvantaged at their first jobs then their salary history will suggest they can be paid lower wages at their next job and so on, creating a vicious cycle of lower pay from which women can never emerge.
Several states have already passed laws to ban salary history discussions during the hiring process. But evidence that this actually helps women is mixed. Meanwhile, such restrictions would have unintended consequences.
"For example, employers who can't ask about prior salary might assume that a female candidate would accept less money than a man, because women make less on average," as The New York Times has previously noted. In this scenario, a ban on salary history discussions could lead to women getting lowballed in job offers.
Salary history bans could also cost people—particularly women and younger workers—some job offers. It's not hard to imagine an employer choosing to hire someone whose salary requirements seem slightly lower than an equally qualified candidate with higher requirements. In this case, prior salary disclosure could mean the difference between getting a job or not.
In other cases, where an employer has a strong preference for a particular candidate, the company may be prepared to offer a higher salary than the baseline in order to recruit them. Without knowing the candidate's salary history, however, the employer may be lost as to what to offer. They might offer lower than the candidate currently makes, leading the candidate to reject the job that could have otherwise been a good fit.
Which is all to say that surely some women may actually benefit from past salary disclosure—especially now that young women are out-earning their male counterparts.
In general, letting employers and prospective employees exchange more information, not less, seems likely to lead to the best matches and the most satisfaction.
The Biden administration's enthusiasm for limiting prior salary disclosure jives with the general cluelessness (or deliberate misrepresentation) by politicians and activists on the issue of equal pay.
The feminist campaign for "equal pay for equal work" was once quite justified; women frequently faced lower pay than men for performing the same jobs. But outright pay differentials based on sex have long been illegal, and the pay gap between women and men in the same positions is now quite small. A 2016 study of wage data in 33 countries including the U.S. found that men made 1.6 percent more on average than women doing the same work.
Today's rhetoric about wider disparities in male and female incomes tends to 1) rely on research looking at incomes across professions and positions and 2) ignore explanations other than discrimination that might explain pay disparities—things like gender differences in types of work, work schedules, and years in the workforce. Politicians and media then use this distorted picture to spawn outrage and get kudos for addressing the issue, even if nothing they're doing can actually "fix" the complicated causes behind disparities.
There may be a broader discussion to have about whether female-heavy industries are undervalued or how choosing to have children may harm women's salary prospects more than men's. But the issue is nowhere near the simplistic narrative that many modern progressives often make it out to be, in which sexist bosses and companies simply choose to pay women less than men for the same work and everything can be fixed with federal mandates.

"Ag gag" law unconstitutional. A federal court has ruled against an Iowa law that makes it a crime to obtain "access to an agricultural production facility by false pretenses." The decision by U.S. District Judge Stephanie Rose blocks enforcement of the law on First Amendment grounds. "The case had been on hold while the 8th U.S. Circuit Court of Appeals considered a challenge to an earlier version of the law," notes the Des Moines Register:
In partially upholding the first law, the 8th Circuit found that false speech is not protected by the First Amendment if it enables a trespass. Under that standard, Rose ruled Monday, the second law still doesn't pass constitutional muster.
By criminalizing deception to gain access to an agricultural facility "with the intent to cause physical or economic harm," it impermissibly distinguishes between animal rights activists and others who might lie to gain access to facilities for other reasons, Rose ruled.
"Simply because speech is unprotected does not grant a free license for the government to regulate that speech based on viewpoint," she wrote, finding that "the law seeks to single out specific individuals for punishment based on their viewpoint regarding such facilities."

Massie sues the CDC. Congressional Republicans led by Kentucky Rep. Thomas Massie are suing the Centers for Disease Control and Prevention to end mask requirements on airplanes. Massie is joined in the lawsuit—filed in the U.S. District Court for the District of Kentucky—by 16 other GOP members of Congress, including Sen. Rand Paul (Ky.) and Reps. Marjorie Taylor Greene (Ga.), Lauren Boebert (Colo.), Paul Gosar (Ariz.), and Andy Biggs (Ariz.). You can find their full complaint here.
"The Centers for Disease Control and Prevention does not have the legal authority to force people traveling on commercial airlines to wear masks," said Massie in a statement. "Congress never passed a law requiring masks on commercial flights. This lawsuit targets the faceless bureaucrats who are behind the CDC's unscientific regulation so that this illegal mask mandate can be brought to a permanent end."

Friends (whose kids are teens now) lived close enough to the school to literally see it if they stood on their roof. Maybe 6 blocks of walking distance, 3 or 4 blocks as the crow flies. In one of the safest, richest communities in the US.
They were required to pick up their kids all the way up to middle school. Their kids could not just walk to school and walk home from school, a parent had to sign them in and out.
So, yeah. Kids don't walk to the bus stop in Karen coastal California, they are dropped off and picked up. One per SUV or Tesla.
I grew up in California, but not coastal. My elementary school was one block away, two blocks if I didn't hop the fence. Literally no one in the universe cared if I walked to and from school. Hell, sometimes I took a five block detour to get an ice cream.
This was during the height of stranger danger panic.
I expect it was the same for most of coastal California as well. Just not the hoity toity coastal parts like Malibu or Redondo Beach. Kids in Pismo definitely walked five miles to school each day. Uphill. In the snow. Both ways. 😉

My understanding is current federal law allows a state to remain on standard sense but it requires the federal government to allow states to stay on DST. The original law was poorly written.
Yes, the Senate bill allows states to keep DSL all year long, which makes sense and which I support.
Not sure if/how the bill addresses autonomy by local governments, which can opt in or out of DSL if they want. Back in the 1960's St. Paul and Minneapolis had different times during one summer. Some western counties in Indiana have opted into DSL, some opted out, and some are in the Central Time Zone.
But in this era of diversity, can't we each identify with whatever time zone (and system) we prefer?

And when said fields hire them often they want a reduced work schedule for family. We hired 2 women into our group recently. Offered them both full partner. Both declined. One just wants to work 4 days a week, the other wants to do 5 days but with no call. They prefer more days off with family.

A Company that I used to work for tended to hire young women as Customer Service Reps. Many women took the job, worked a year and used the insurance to have a child. Then they either resigned or took leave. The Company was pretty good about letting them flex their hours or even bring the child to work with them. The problem was that with the numbers they had to have extra Reps. due to the number out on leave or flexing their hours. To me that justified a lower wage for women. When you add in the leave and the flex time as a benefit, they actually came out ahead, but, that's never counted.
So pay them equally--by the service call?
Commission based or piece work would make it hard to claim different pay for equal work.
Also men are more likely to take a risky performance based income job whereas women are more likely to take a safer set salaried job. This is literally what happened with the soccer team BS posted below. But its a tale as old as time.
That would certainly make sense, but it doesn't seem to actually work that way.

It is absolutely the classic have your cake and eat it too. They willingly signed up for the low risk / low reward safe contract with essentially a salary guarantee and less bonus. The men's team signed up for lower salary but bigger bonuses for any post-season game, so more risk more reward (and since they didnt perform as well, they didnt get the big payout).
The women retroactively wanted to get the significantly higher pay for post season games, after the fact that they knew they of course made it to and won said games.
Just like every example of modern feminism, wanting the advantages that a man gets without taking on any or the risk or responsibility.
It turns out that the men would have made more money with the women's deal, too.
They just didn't bitch about it.
The fact that they even gave any ground to the women in this fight is absolutely bananas. They were offered what the men had, said absolutely no, gladly signed the contract they chose, and once the season was over cried that they made the wrong decision.
The only thing they should have been given was a copy of their signature on their contract and a "shut the fuck up and go kick the ball around". Caving at all to this kind of nonsense only encourages more of it.

It's pretty clear from his speeches that he was expecting NATO to step in and provide direct military support to drive the Russians out, the same way we did for Kosovo against Serbia during Allied Force.
At this point, it's really a question of whether Russia can sustain the invasion long enough for Zelensky to come to the table, or they run out of resources to keep it going. I don't think they're going to put their best units in the field on this one and give NATO free intel in to how they operate and their equipment capabilities.
At some point you'd think the artillery shelling of their major cities would drive them to sue for peace. Even if they don't advance another inch it seems the Russians can just shell the shit out of the place for as long as they'd like, I don't see the Ukrainians driving them back far enough to prevent it.
That's what's even more absurd about the No Fly Zone request: Russia isn't even doing most of the damage via air superiority. Keeping Russian aircraft out of the airspace wouldn't really reduce the amount of damage getting inflicted.
This means that the request for a NATO enforced No Fly Zone is not about protecting Ukrainian lives or assets; it is an attempt to draw NATO into fullblown war with Russia, which is the best chance the Ukraine has for "winning" this thing.
I don't blame them for trying, but we should see what they're actually attempting to do.

In WWII, we were attacked by Japan and Germany declared war on us. Arguing alternative histories about "what ifs" is just midwit masturbation. We were attacked and war was declared on us, so it doesn't really matter.

Ag gag laws are a tough one for me. I understand why farmers and ranchers favor them. These activists purposely misrepresent stuff to destroy our living. They trespass, even purposely injure animals to get footage. They are unscrupulous, and often present false credentials and resumes to gain access or get hired. They break non-disclosure agreements etc. Under existing law, they claim to be journalists, and the courts rarely punish them as a result. So, the industry has tried to write laws that give us back our protection of property and privacy, but then the activists scream 1A and many who don't realize that current laws don't provide us with the protection against trespassing and other protections most people would consider normal, the courts don't apply to our industry.
The abortion industry has similar laws and doesn't get trashed for them. It's easy to label this a 1A issue, but it's more a privacy and private property issue. Anyone who breaks into your house, even if you invited them in because they falsely represented themselves, you would expect that the law would punish them. But if they claim to be journalists, guess what, the courts won't protect you. So, yeah free press and free speech, but what about our property rights and privacy rights? How do you balance the two? Maybe these laws aren't the right answer, but we are fighting for our livelihoods against people who have no scruples and want nothing less than to destroy us, and have no hesitatancy in breaking laws to achieve it. They know all they need to do is claim to be journalists and the courts will not punish them. Additionally, as most are from out of state, the cases are usually held in federal courts, not local, and the cost to the farmers and ranchers to seek civil ramifications are usually cost prohibitive. While these activists have deep pockets and high prices lawyers on retainer (many who work pro bono, because they are not for profit companies).

I wish it were that easy, but you often don't find out until it's month past and you start getting threatening calls and emails, finding out your farm is all over certain parts of the internet. They do stuff like show a cow in heat bellowing and then say it's her crying for her calf that the dairy farmer took away from her, or the rancher stole from her to sell. Many farmers have invested in security cameras, pay (often with money they really can't afford) for private investigation firms to conduct background checks on new hires (but given the difficulty of finding new hires, this is another costly and time consuming step, and as hires often are seasonal...) and other steps. This raises operating costs, but only provide minimal protection. We have our own activists addressing the myths using social media, but they generally are full time farmers or ranchers and their reach isn't as big or as well funded. And they constantly receive death threats, have their wives and kids followed etc. These "journalists" have no scruples and are willing to do almost anything to achieve their goals.

My ranch is marked with no trespassing, not because I am trying to hide anything but because I don't want anyone injured by my cows or bulls. Also, visitors tend to leave gates opened and mess up grazing and breeding. I've even had hunters who disobeyed the signs leave outside gates open, which risks the cattle running off (and then I'm responsible for any damage they do, not to mention the cost of finding and moving them back and if any get hit by a car or truck). Calling the sheriff's only works if I catch them in the act and there's a deputy available close enough to respond in time.

Because if you actually dig in to the "women are getting paid less" claims, they typically fall under 1) women who had kids and left the workforce, thus losing several years of experience that might have qualified them for higher-paying jobs; 2) women who take the first salary offer rather than negotiate for higher pay; or 3) women who took service industry jobs that pay lower salaries by design.

In medicine we call it the "mommy track" but it is extremely common for them to have the option to make exactly what their male coworkers make but choose to take no-call or part time positions and just have more days off. Men are more likely than women to work a 50+ hour work week in medicine by a large margin.
