Biden's Plan To Crack Down on Tax Cheating: Snooping on Everyone's Bank Accounts
The president says the IRS needs just two bits of information: all the money that goes into your bank account, and all the money that comes out.

In order to make sure the rich are paying their fair share in taxes, President Joe Biden says the IRS just needs two bits of information: all the money that goes into your bank account, and all the money that comes out.
That's how Biden pitched his plan for a more comprehensive financial surveillance state—all to catch those nasty tax-cheating rich folks, of course—during a speech from the White House on Thursday afternoon.
The plan "will give the IRS the resources it needs to keep up with the lawyers and accountants of the super-wealthy. It would ask just for two pieces of information from the banks of these folks: the amounts that come into their bank accounts and what amounts go out of their bank accounts," Biden said. Right now, he added, "the IRS can't see what they're making, and can't tell that they're cheating."
Thankfully, he stopped short of using the "If you've got nothing to hide…" cliché.
Still, Biden's framing of this plan to beef up IRS enforcement with an additional $80 billion in funding is wildly off-kilter. As I wrote in April, giving the IRS more information about the inflow and outflow of bank accounts won't automatically tell the IRS that someone is hiding unreported, taxable income. But it gives the federal tax cops another way to establish probable cause for a financial stop-and-frisk.
The details of Biden's plan are far different from the innocuous-sounding description he used Thursday.
"The administration's proposed 'comprehensive financial account reporting regime' would dramatically increase the types of financial institutions and transactions exposed to the feds' prying eyes," Reason's Matt Welch recently wrote. "The new domestic surveillance program, which requires congressional approval, is one prong of a tripartite strategy for transforming the entire global financial system into a harmonious, haven-free collection funnel to the IRS."
Closing the so-called "tax gap" and making sure everyone pays what they owe is a crucial part of how Biden and congressional Democrats plan to pay for part of the budget-busting $3.5 trillion reconciliation bill curring being crafted by the House. The $700 billion that will supposedly come from stepped-up tax enforcement was the largest single funding source for Biden's American Families Plan when he outlined it earlier this year (though Congress could make significant changes before the bill is finalized).
It is disingenuous to suggest, as Biden did Thursday, that letting the IRS peep at your bank records is about ensuring "that the wealthy can no longer hide what they're making, and they can finally pay the fair share of what they owe."
As the details of his proposal make clear, enhanced tax enforcement will mean hoovering up more data from crypto wallets, bank accounts, and third-party payment providers such as PayPal and Venmo. And that comes after Biden already ordered the IRS to give greater scrutiny to transactions in the so-called sharing economy.
Biden is pitching this plan as a way to go after the wealthy people who can afford tax lawyers and accountants. But as always, the people who can't afford those things will probably bear the brunt of the new rules.
"I'm not out to punish anyone. I'm a capitalist," Biden said Thursday. "All I'm asking is that you pay your fair share."
All he's really asking is the end of financial privacy for millions of Americans.

The reason the rich have tax lawyers and accountants is so that they can comply with the law while paying as little as possible. And it's pretty absurd to expect anyone to do anything else. That's not cheating. "Exploiting loopholes" is another way of saying "complying with the law". People not reporting income are going to be in the middle and lower wealth classes, probably skewed towards poorer.

To acknowledge China is committing billions in corporate theft and uses monetary manipulation to game theory is hardly protectionist, which is a large part of his actions. Sure he ramped up the rhetoric vote for the populist vote, but very rarely did he enact tariffs solely for protectionist reasons. In virtually every case it was in response to some action from the other country.
I keep harping on it, but they have been doing trade theory modeling for decades since game theory was developed with economic principles. Time and time again, the AI competitions regarding these rules showed a tit-for-tat strategy as the optimal condition given the conditions. Recognizing and acting on that theory is just a reality in complex global markets. Not reacting is simply a stupid policy left for idealists (not saying you believe in no reactions).
As a simplified example... if the Mob decided to rob producer X and sell that producer's goods at even the same price, producer X would have to increase his costs for security and production merely to match the cost at which the Mob is now deciding to sell his goods at. producer X would be in his right to enact the state to fight the Mob's disruption of the market, even if it makes prices lower for the consumer. Not doing so would reduce development in future markets in both IRAD and protection as profit would decrease and be eaten up in security costs.

Be aware that the theft of intellectual property is a direct result of the companies who own those intellectual properties choosing to do business in China.
In order to produce in China you have to expose your inllectual property to the manufacturer. It's not like you can say "produce my advanced electronics for me" and then not tell them how to make them. It is a tradeoff that those companies are willing to make to get cheap labor.
Some, like Apple, strategically manufactured the majority of their iPhones, in China. They made everything that was easy to figure out there, where the intellectual property theft was of largely useless or standard technology. They then produced the parts containing the important IP in countries that protected it, then shipped those parts to China for assembly.
While some of the IP stolen by China was obtained through industrial espionage, the vast majority was surrendered by the owners so they could cut costs.
It's not like it's a secret that China steals IP from companies who manufacture there. It's been a known reality for decades.

The problem with an income tax is it forces the government to create definitions of 'income' and in turn, it needs to know how you spend your time during the day, and whom with. It creates an incentive for a surveillance state.
This is why I advocate for a "national sales tax". How exactly that's structured can be argued and debated, but it gets the government out of the individual surveillance game, and turns it into a regulatory game with businesses- most of which are already built around collecting the tax, and have a high likelihood of compliance.
Oh, and I've been doing a lot of reading on property taxes and... I'm not much liking those either, because they beat the economic bushes to drive prices up, indefinitely.

The only kind of tax which can be truly anonymous is a property tax. All the government cares is that the tax is paid; they don't need to know who paid it. Owners only need to prove they paid the tax if someone else tries to squat and claim it, and receipts can do that; and if the owners don't care to be anonymous, I'm sure the government will be happy to record your ID etc.
The amount of auditing required for a sales tax isn't really that hard. It would be a marked reduction from the work required to argue what "income" is, vs arguing what a "sale" is.

Back in the day, money was a thing. And it was though that for the government to do things, it needed money. For it to have money, it would have to get money. The choices were (1) pull it out of the ground like the rest of us or (2) take it from those who had it. Since it's much easier to take than dig, taxation was invented. Thus the quaint notion that the whole idea of taxation is to generate revenue for governmental operations. Lots of laws based on this assumption.
Fast forward to today. The government has been adding debt since FY 1958. The sky has not fallen, ergo debt means nothing.
Now that government debt means nothing, there is no need for a personal income tax nor any tax directly paid to the government by an individual, and you could argue that the very idea of taxation as we know it may be obsolete, at least at the federal level. Hell, what it is now, 61% of people pay no income tax as it is anyway, right? Finance government operations with debt and repeal the 16th amendment. A win for privacy.
Disclaimer: This idea in no way claims to repeal the iron law of life, TANSTAAFL. More debt = inflation. But inflation with privacy is better than inflation without privacy.

Yeah, right. Regardless of the the tax rate, the powers that be will simply raise the "market value" to bring in more income. Here in Texas, they value property on "recent sales," not what you paid for it originally or what shape it is in compared to those other houses. House flippers buy a property, make some changes and resell at a higher price, or buy an older house, tear it down and build a mini-mansion and end up pricing people out of the area.
The powers that be can't just raise the "market value". Even your example shows that it isn't the powers that be but the actual market realities that raise the value. Texas also has systems in place to protest the value and limit the amount of increase that can occur in a year.
Also, just protest the appraisal and show that your house should be assessed and the flipper bought not the flipper sold price.
They can create policies and incentives that drive up value, though. And if you own property and don't intend to sell, that harms you.
It seems like would also create a situation where people who just want to buy a house and live there for 30 or 40 or 50 years would end up house poor just because their property taxes kept rising. It doesn't seem like a good system to allow people to retire with savings and equity in their houses.
Maybe if the basis for the property tax is some fixed value of the land or something. But as long as it is based on an assessed value of land and improvements, invasion of privacy is required and there are big incentives to artificially increase property values.

A sales tax just puts that nosiness elsewhere.
A property tax eliminates that nosiness, all the associated government auditers, and all the private accountants to combat those auditers.
It does bring in assessors, and private accountants to argue assessments, but that's a lot less than accountants quibbling about how much of your mileage was work-related.
But we already have a sales tax, and it's mostly a technocratic policy of making sure businesses file their gross receipts and do paperwork. I don't consider it an invasion of privacy because Safeway logs its sales info and forwards the appropriate percentage to the government. We're talking about a major difference in scale and scope here.
It's no business of the government what my compensation is, let alone how I'm compensated.
And I fully understand the business owners should have some privacy rights too. But an agent walking around my house and saying, "That's a pretty nice painting you got there, Mr. Donovan... and on a janitor's income..." is morally wrong.
Oh and don't even get me started on inheritance taxes which IS an income tax. The fact that my dead parents handed down some property and bonds to me when they shuffled off their mortal coil is fuck-none of the government's business.
Even worse, the death tax is a WEALTH tax. I have seen family businesses ruined by the death tax. Mom and Pop have a small bakery that earns enough for the family to live modestly. But then they die and when you add up the bakery building, the equipment, trucks, etc, they have such a huge net asset being transferred that the family has to sell the business in order to pay those taxes.

The IRS uses computer algorithms and form letters. No one agent is going after me. The letter my company has that says I owe them over $35000 in payroll tax from 2019 was automatically generated without anyone at the IRS looking at it and taking to seconds to look up my account. So, it is computer-generated based on mistakes and a bad algorithm or they are all fucking idiots that just like screwing with people.

This proposal is for financial data to be provided without the individual's approval, by financial institutions. I am guessing you comprehend this, but, do you have your bank fill out your W2, or do you fill it out? Beyond the massive intrusion into an area covered by 4A, there is the fairly clear issue of data privacy and opportunity for theft/identity theft -who has access, how it is transmitted, how and where it is stored. The fed has a shit record for not being having personnel records breached, and quite frankly, state govt isn't much better. The latter is a secondary consideration, 4A and government overreach is the issue. Keep govt and bureaucratic tentacles out of everyday life.
Individuals do not fill out W2s. An employee fills out a W4 which tells the company how much to withhold. A company then files w2s with the Social Security Administration to report on the amount of money the employee made during the year. A bank is also required to report to the government how much you made in interest and dividends in a year. This is reported on 1099-INT or 1099-DIV.
All that being said, I don't agree with the new law and think it is a huge invasion of privacy.

It has dawned on me recently that it was probably true of every presidential ticket that won going back half a century... with perhaps the sole exception of Trump. He seemed to not be the type to take direction well or sink into a role of subservient compliance to the deep state.

On this side of the state, our Philadelphia county tax upcharge is 2% so the total here is 8% sales tax.
The county upcharge is quite often missed by online retailers that collect the state's 6% cut, so if what is being purchased has free shipping, all other prices being equal, it still pays to buy online vs. local for items that are subject to sales tax.
It isn't audited because it is small enough right now for most things. The reason they started forcing online sellers to collect the tax is because individuals weren't paying it. It was easier to force the businesses than audit individuals. But what few people realize is legally we were suppose to be paying it all along, at least in Texas. Legally, if I buy from an online retailer in Louisiana that charges less sales tax than if I bought the item in my taxing district I am supposed to pay the difference directly to the state. I have never done this. The way the law is written, technically, even if I drive to Lousiana to purchase and pick up the item then drive it back here, I am to pay the difference. Again, nobody personally does that. But businesses do. The state audits a business if they think they are avoiding sales tax by purchasing online or out of state. So while it would be a minor increase for auditing on the business side, if the feds truely wanted to go after individual sales like lawn mowing and babysitting which are services being sold to me then it would require a lot of auditing.
One of the things that I love about Delaware is the low tax burden. No sales tax, a moderate income tax, low property taxes, low school taxes (with no school taxes after 65), and low gas tax. Cross the line into PA, Maryland, or Jersey and most (if not all) of those skyrocket.
People come here specifically to buy things here, which is why the Christiana Mall is constantly expanding when most malls are failing. It's part of why our economy is both diverse and vibrant.
Other states use different mixes, but for an average middle-class family, our works pretty well. Having no sales tax helps us gain revenue from people outside of the state (or even the country).
