Brickbat: Don't Take Your Guns to School

The Ohio Supreme Court has ruled school employees may carry guns on the job only if they have "satisfactorily completed an approved basic peace-officer training program" or have "20 years experience as a peace officer." The ruling overturns a Madison Local School District policy that allowed school employees to carry guns at work if they had a concealed carry license and had passed active-shooter response training, a background check, and a mental health exam.

How the fuck did the court come up with all of those additional rules and requirements? Isn’t that the legislature’s job? Shouldn’t the court merely say whether the law passed by the legislature is constitutional or not? When did the judiciary receive the authority to make policy?

Well, there is an Ohio law which says, “No public or private educational institution or superintendent of the state highway patrol shall employ a person as a special police officer, security guard, or other position in which such person goes armed while on duty, who has not received a certificate of having satisfactorily completed an approved basic peace officer training program, unless the person has completed twenty years of active duty as a peace officer.” So, although I disagree that the court got this right (hiring someone who chooses to go armed is not the same as hiring someone for “a position in which such person goes armed”), it’s not *totally* ridiculous.

They have interpreted a provision that can be reasonably understood to mean “hired to be armed while on duty” to mean “chooses to be armed on duty”.

A lot of older cops were there before the current round of training programs existed. This gives them an out for not requiring elderly experienced officers to go back for newbie training just because their decades of experience aren’t on the list..

Not really. It is the “approved” portion of the law that points out why. They probably instituted a new (when this law was written) approval process for police academies and such within the previous decade or so and were grandfathering in folks near retirement.

It’s fair. They were trained, but standards change. Still, to force a 50 year old detective to go through academy like he was a 24 year old new hire would be ridiculous. Theoretically, there should be ongoing training for procedures and tactics basic to policing, just like how cops must re-qualify with weapons and other skills regularly. You’re not starting from scratch.

It’s not through the academy, it’s through a training course same as the teachers; and that’s my point, if it’s a 6-week course that aged/retiring police officers can’t be bothered to go through, how is it just to make teachers do so? Shouldn’t the 20-yr. seasoned veterans breeze through it with pay? Kinda disgusting that you agree with the policy, at least in part, because aged/retiring public servants can’t have their precious egos damaged.

Seems like a good idea to allow teachers, janitors, coaches and school administrators with conceal carry permits, who take an active shooter class and pass a mental health screening to carry guns to protect the students.
But the people who brought this lawsuit are against these “ common sense” gun laws.

I would also like to object to the photo showing a well dressed person drawing a gun with their finger on the trigger.
That goes against all training and is likely to result in a negligent discharge.
Kids, keep your finger off the trigger until you are ready to shoot.
Also, be certain of your target and what is behind it.
Treat all guns as if they are loaded.
Remember the boarding house rules, each criminal gets shot once before any criminal gets shot twice.

Great advice, but I worry about the cluelessness of the people who would bring a gun to school. Also, kids in school are smarter than we give em credit for, and are great at working in pairs, the distract and snatch move. A classic. I have seen plenty of teachers get their keys, purses, etc. go missing.
I would be worried about kids swiping these guns for their own amusement.
Schools don’t mix well with guns. Neither do bars. Not trying to abridge anyone’s 2nd amendment rights, but I am just saying…

In Ohio? It’s not that expensive but it does take about 4 months.

Don’t forget the part about living on campus 24/7, the dress code, pseudo military environment, no facial hair, & physical fitness requirement. Not to mention the things normally supplied by “the department” like guns, ammo, handcuffs, uniforms, etc.

Oh, let’s not forget all the parts of training that might be fun will make no difference in a school such as the entire dangerous driving classes where cops learn to drive like assholes and run people off the road. Well, maybe the driver’s ed teacher might find it useful.
