Biden's 'Rescue Plan' Will Sic the IRS on Anyone Who Earns $600 in the Gig Economy
What does this have to do with the pandemic? Nothing.

Uber drivers, Etsy sellers, and others who earn income through the gig economy could get a nasty surprise from the $1.9 trillion emergency spending bill signed by President Joe Biden on Thursday.
Buried inside the 600-page bill that's ostensibly meant to provide pandemic relief is a provision requiring gig economy platforms to report information to the IRS about all users who earn at least $600 in a year. Previously, platforms were only required to provide the IRS with information on users who made at least 200 transactions or earned at least $20,000.*
The tightening of the reporting requirements means a lot more paperwork and tax compliance requirements for platforms. It also means more tax headaches for anyone who might use those platforms to earn a little extra cash. Anyone earning a sizable income via rental properties on Airbnb was already covered by the old rules, meaning this change will only affect low earners. Now, even the sale of a single expensive piece of old furniture on eBay or running deliveries for Uber Eats in your spare time might trigger the new reporting requirements.
"We believe this provision will create unexpected challenges for small business owners and entrepreneurs," a coalition of trade groups and businesses, including online DIY marketplace Etsy, wrote in a letter urging members of Congress to reject the proposed change. "In a year in which small business owners and entrepreneurs are dealing with a myriad of challenges, making this change would place a burden on small business owners and entrepreneurs and further complicate an already challenging tax season for small business and entrepreneurs."
Tightening the reporting requirements is being sold as a way to crack down on tax cheating. Politico reports that House Democrats believe the change will generate about $8.4 billion over 10 years—but that's a drop in the bucket compared to the $1.9 trillion bill.
There's reason to doubt that even those paltry revenue figures will become reality. Nina Olson, a former head of the IRS taxpayer advocacy office, told Roll Call that gig workers earning a few hundred bucks are unlikely to pay up no matter what.
The big difference is that now the IRS will have their personal information and can go after them.
"Workers who are under-reporting their income now will become guilty of nonpayment next year and subject to penalties and actions by the agency," Olson told Roll Call, adding that an IRS collection action "can destroy a person's life."
Americans for Tax Reform, a conservative think tank that opposes tax increases, notes that the change to income reporting requirements for gig workers—whose income is reported on IRS form 1099-K—bears a striking resemblance to a widely loathed tax originally included in the Affordable Care Act when it was first passed in 2010. That provision, which required businesses to report all purchases of more than $600 to the IRS via the 1099 system, created huge headaches for small businesses and was repealed in bipartisan fashion just a year after Obamacare became law.
The new reporting requirements are likely to be just as big of a mess for gig economy platforms and the independent contractors who use them.
If all of this seems like it has virtually nothing to do with the COVID-19 pandemic, then it actually has a lot in common with the rest of the American Rescue Plan Act of 2021. From bailing out private pension plans to throwing money at states that don't need the aid, Biden's first major legislative initiative is a mishmash of Democratic policy priorities and excessive spending, with a dash of actual pandemic relief on the side—only about 5 percent of the bill's $1.9 trillion price tag is earmarked for public health efforts.
Congress and Biden just agreed to spend $1.9 trillion the country doesn't have, but don't you dare forget to pay taxes on the few hundred bucks you made selling your old junk on eBay.

I feel for you. I remember in the late 70s taking a summer job, and while I could have worked another week before school, I quit because at the time I wouldn't have to file an income tax return as long as I didn't earn more than something like $3200, which is worth about $12,000 now. Biden is really going after the little folks; you won't hear it in the MSM because it's not the Democrat narrative, and anyone looking should have expected it. Look at what they do, and don't believe what they say.

I'm just trying to understand something here and I don't read articles - how is this different from the current 1099-MISC filing standards? It's the same dollar threshold, and it's the same category of recipient: unincorporated service providers who are paid $600 or more. Payments to incorporated law firms also need to be reported under the 1099-MISC regime. Is that the difference? That payments to Uber Driver Inc. would need a 1099, where payments to Uber Driver (person) or Uber Driver LLC would have already been covered under 1099-MISC requirements?
This relates to the 3rd party payer reporting on 1099-K not the NEC (formerly MISC). We need more tax forms.

It just seems like it's a shift of one stupid information reporting for another stupid information reporting, bloating compliance and administration costs for businesses in hopes of finding matching errors on individual income tax returns.

It is how many are reported. 1099-NEC(formerly 1099-MISC box 7) is for non-employee compensation but has no way to note any fees the company withheld or miles driven. As a business, I am required to send a 1099-NEC to any non-incorporated person or entity I give over $600 dollars to, like a contractor I hire to paint a wall. Uber, eBay, and the like report on a 1099-K. This allows them to report their fees, miles driven, and other info as a third-party pass-through payer. Credit cards do the same for merchants that use them for payment processing. The previous limit of required 1099-k reporting was $2000 dollars worth of transactions. It is now $600. Technically the taxpayer was already required to report those $ 600 dollars without the 1099-K. So it really isn't generating any additional tax liability. It is just generating additional reporting requirements and a higher likelihood that more of the money will be actually reported.

Thanks. I’d worked for years as an independent contractor and was sent a 1099 MISC for any income over $600 so I was confused by this article but I see 1099 K income is different somehow.
The 1099NEC is reported by the person or company sending you money. The 1099K is reported by the company, like PayPal or Venmo, that is handling the transaction. The real problem for contractors is that some people or companies prefer to pay through Venmo or PayPal, meaning that you can end up getting both a 1099NEC and a 1099K for the same transaction.

Each house may remove members who have proven unable or unwilling to read and understand bills, but their votes will count as Nays until they are replaced.

Currently on a schedule B with the cost basis of what you paid for the car so you wouldn't owe any tax assuming you haven't depreciated it or sold it for more than the original purchase price. It is exactly what happens now for houses or property, with a 1099-S. The problem that happens now is you don't put the sale of your house on a return. The IRS gets the form saying you sold a house for $200000. They know you likely had some cost basis for that house, but they treat it like you made $300000 you failed to report on your return. So depending on your tax bracket they send a letter saying you owe around $60000 when you likely owe nothing because you bought the house for $250000 and have lived in it 2 of the last 5 years so you have an exemption up to $250000 in profit.
Sorry, that should be sold for $300000 and $300000 you failed to report.
1st an entity has 2 create a 1099 n then send it to you n the hugely under staffed IRS. This means there's a tangible legal & economic relationship between u and a (usually) business. Selling your home,car etc clearly does Not meet those requirements,unless u are in the Business of selling items like these. Ask yourself: whose going to generate the tax form from a home/car sale?
2nd, a 1099 generally creates the opportunity to write off actual expenses Before Taxes,a far better deduction than tax schedule deductions which are granted only a small percentage of value towards reducing the tax burden. Gig employees need only to file a form 2106 to realize these off-the-top deductions.

I have sat in a tax office with clients that received IRS letters from house sales that weren't included in their Tax return. Yes The IRS says you don't have to include it but If a 1099-S is sent by the title company without the correct box checked because they don't ask if you qualify for exclusion then the IRS assumes the worse and sends a letter.
Unfortunately, I can see the IRS automating the process, to send notices out to anyone who didn't report income that the IRS knows about due to a 1099 being filed against them.

If I'm not mistaken, contractor already have to pay taxes if they earn at least 600 dollars. I play daily fantasy sports and receive MISC 1099 if my profit is 600 dollars or more. I worked as a freelance writer back in the early 2010 and received 1099 forms.

Currently, the IRS has 74,500 employees and does 300,00 audits a year, or 4 audits per employee (a back-breaking, to be sure). I obught it on a lark for $500so its now down to $165 , got it home realised the colur wasnt right for the room I bought it for.... stored it in my workshop for two years, business use of home. At FiDolla uh month, that's down to $105. I had to hire a proffessional uphilstery cleaner to clean up the mess the mice made in it whilst I had oit stored. That cost me six bits. Down to $30. The bill going after the 'gig; economy is equivalent to going after those of us who are picking up a little extra to try to keep up with the rising costs of living. Food is way up, so is fuel, utility costs, and repair and maintenance of everything. This is going after the middle class and to a high degree the working poor. The gig economy is how we stay afloat. The government is incompetent. One size does not fit all. And when the delayed rent restrictions go away, all of those who were put out of work and going to be evicted by the landlords they have not paid in the last year or so. That is about a third of everyone renting. The government is going to have homelessness at the level of the 1930's. The government has about half of the people in this country dependent on them for their livelihood already, and there is not enough housing for three orders of magnitude in homelessness to manage it. The whole country will be like San Francisco with streets full of urine and feces, at the point city services will not be able to manage sanitation, feed the starving, provide work through enterprise, or even manage law and order.

All "issues" with independent contractors (gig workers) are solved by incorporating. I assume that is a great big hassle in the bluer parts of the country, but in Free America it is a two page form and a couple hundred bucks a year. The record keeping is easier then for a sole owner of an unincorporated business, and there is enough software out there now that bookkeeping is dirt simple. One USB stick kept all corporate records for five years.
But then again, I am retired now and am not affected, and lots of the gig workers voted for it, so let them deal with it.

I expect that the bill's authors do not expect this provision wlll really raise any revenue, or will not be done away with in the near future. The purpose is to play accountancy games to hide the real cost of the total bill to make it easier to swallow. The fact that it will not raise any real money and will likely be repealed is part of the ridiculous, dishonest game which is our normal politics.

As one must earn $12,401 to even have to pay income tax, I fail to see why they are going after someone who only made $600 because you'd have to make $600 from TWENTY DIFFERENT employers to even get to $12,000 -- and you still wouldn't have to file or pay anything.
