California Gov. Gavin Newsom Issues Surprise Retraction of Controversial Stay-at-Home Order

The governor's order had banned outdoor dining and forbade Californians from socializing with members outside their household.

In a surprise move, California public health officials are lifting a controversial stay-at-home order. The rule had forbidden people in affected regions from socializing with members outside their households and imposed a raft of restrictions on businesses in much of the state.

"California is slowly starting to emerge from the most dangerous surge of this pandemic yet," said California Health and Human Services Secretary Mark Ghaly in a press release today. "Californians heard the urgent message to stay home when possible and our surge after the December holidays did not overwhelm the health care system to the degree we had feared."

"Today we can start to see some real light at the end of the tunnel," said Gov. Gavin Newsom at a press conference this afternoon.

The stay-at-home order, issued in early December, divided the state into five regions. The rules snapped into effect whenever a region's hospital intensive care unit (ICU) capacity fell below 15 percent.

Where it was in effect, the order banned restaurants from operating outdoor dining and kept personal services businesses, such as nail salons, from operating at all. Retail businesses were required to operate at 20 percent capacity.

Before its snap repeal, the order was in effect in three regions: Southern California, the San Joaquin Valley, and the Bay Area. It had been lifted in the Sacramento region and had never gone into effect in the Northern California region. At his press conference, Newsom shared state projections showing that all regions of the state would have more than 15 percent ICU capacity by February 21.

Those restrictions were more severe than the state's prior Blueprint for a Safer Economy. That system put counties into one of four color-coded tiers, each with different conditions for which businesses were allowed to open and at what capacity they could operate. But even in the most restrictive "purple" tier, outdoor dining was allowed.

The regional stay-at-home order sparked widespread resistance. Many restaurants continued to keep their outdoor dining patios open in protest. Sheriffs departments across the state said they wouldn't enforce the order. Local governments and business associations threatened or filed lawsuits. The order also boosted efforts to recall Newsom.

The sudden lifting of the order, which leaked Sunday afternoon, came as a surprise to state legislators, many of whom learned the news from Twitter.

People: Is it true? CA is lifting the shelter-in-place?

Me: Huh? I haven't heard.

People: It's all over Twitter.

Me: Oh.

People: Aren't you a state official? Shouldn't you be in the know?

Me: *sigh* ????‍♂️Where to begin… pic.twitter.com/hn1LhIeR6g

— Evan Low (@Evan_Low) January 25, 2021

If you think state legislators were blindsided by, and confused about, the shifting & confusing public health directives, you'd be correct.

If you think we have been quiet about it in Sacramento, you'd be wrong.

— Laura Friedman (@LauraFriedmanCA) January 25, 2021

The snap reversal of the order, coming on the heels of intense criticism and non-compliance, has sparked accusations that the governor was bending to political considerations.

A new day, a new erratic COVID rule.

Californians want to follow the science. Instead we're forced to follow a governor who decides on a whim the fate of millions of Californians while refusing to release the data behind his contradictory and arbitrary decisions.

It's absurd. https://t.co/QaomyxMuAz

— Kevin Faulconer (@Kevin_Faulconer) January 25, 2021

The state will now return to the four-tiered "blueprint" system. All but three of the state's counties are currently in that most restrictive "purple" tier, although Newsom said in his press conference that this would be reevaluated tomorrow.

Counties are allowed to set more restrictive reopening conditions than what the state mandates. It will be a while before the precise practical effects of today's decision are clear.

The biggest scandal here that will never be rooted out into the sunlight, is dozens of state and local leaders across the country willfully created chaos in the lives of their citizens for nothing more than a shallow political purpose. There is a measurable body count from what these state and local leaders have done, and none will be held to account. And in fact, not only will they not be held to account, they'll be hailed as heroes.

Science is a process. Not a set of facts or a political consensus or a religion or even a website that posts natures pics. It's a process. It doesn't get anything right and it doesn't get anything wrong, because it's a process.

Gosh, I learned this back in high school.

The media doesn't get it. Not to engage in whataboutism, but neither the Left nor the Right gets it. The Left who says the science is on their side don't get it, and the Right who say the Left makes up the science don't get it.

Science is a process. Deal with it.

Progressivism is using the coercive power of government to force people to make sacrifices for the common good--as they see it.

The proper term for progressives who want the government to force people to do things against their will is "pious".

The proper term for progressives who want the government to listen to people and adjust policy accordingly is "heretic".

    1. koumpounophobic   4 years ago

    2. Ignore me!   4 years ago

Progressives as a group have stopped thinking. Any progressive I know who even mildly questions the most trivial aspects of tribal dogma is immediately and loudly denounced by other progressives. I've seen it happen in my own family, and the struggle sessions play out every day in social media and corporations. Progressives repeat mantras and punish heretics. That's it. They've become a cult that some people like Kendi, Hannah-Jones, etc. use to grab wealth and status. It's a cult that serves the interests of the powerful, which is why the Democratic party pushes it so hard. Look at how antifa uses "community policing" to terrorize ordinary people and destroy small businesses, or how BLM has set back and sidelined the cause of police reform, or how trans-identified men have coopted feminism and invaded women's spaces, or how #metoo feminists betrayed their own movement to get a pussy-grabbing old molester into the White House. Progressives are a cult of power and authority.

      1. mad.casual   4 years ago

Progressives as a group have stopped thinking.

They didn't start thinking. Progressivism at it's core and since the beginning, has been about change for the sake of change. From the enaction of Prohibition and the beginning of the Progressive Era, the "conservative" retort has been "let's think about this change before making it."

Looks like SCOTUS Chief Justice John Roberts will NOT preside over the Senate's impeachment trial of Trump (because Trump is no longer president).
    https://townhall.com/tipsheet/katiepavlich/2021/01/25/its-official-kamala-harris-will-oversee-trumps-second-impeachment-trial-n2583685

If left wing Senator Pat Leahy presides over the trial, and if Trump refuses to participate because the procedure it isn't Constitutional (which would be smart), I'd be surprised if more than 53 Senators vote for conviction (67 votes are required to convict).

A Senate impeachment trial for Trump (after he left office) is going to blow up in Schumer's angry face if he proceeds, which is why I continue to believe the trial will never occur.

    1. JesseAz   4 years ago

Totally a fair process. And the fact that one of the people identified in the constitution as being part of the process not being there means it is constitutional.

      1. Claptrap   4 years ago

The CJ is only required in the trial of a sitting President to remove the VP's conflict of interest. Donald Trump is a former President, his conviction does nothing to (directly) benefit her.

The Constitution says nothing about the trial/conviction of former officials, and the English tradition in which the Founders were reared doesn't prevent it. But a conviction/disqualification at this point would certainly (and rightly) be appealed to the USSC.

Regardless of the merits in this particular case, I think impeachment of prior officials for conduct which occurred in that capacity is absolutely an appropriate power for Congress to have.

        1. Don't look at me!   4 years ago

          It is not.
Or, do you think it should happen each time?

          1. Claptrap   4 years ago

I would greatly prefer it if Congress spent it’s time ensuring executive accountability. Would give them some reason for being following its 90 year abdication of power to the Presidency.

            1. Mickey Rat   4 years ago

The problem here being that it is not being used for executive accountability, it is being used as an instrument of petty revenge, while Biden Administration gleefully issues its diktats.

        2.  a libertarian   4 years ago

The purpose of Impeachment is removal from office.

Only a fucking retard thinks someone out of office needs to be removed from office.

          1. CE   4 years ago

The Dems want to convict him for inciting (which he didn't do) an insurrection (which isn't what occurred), so they can bar him from running for office in a democratic election (to save democracy by removing a person 70 million people voted for).

          2. Mark Thrust, Sexus Ranger   4 years ago

He’s being impeached by democrats. So yeah.

        3. JesseAz   4 years ago

So we go from the constitution prescribing powers to it letting them do whatever is not written down. Got it. Youre an authoritarian fuck.

They are attempting to stop future elections. They are open this. What is their constitutional power to deprive someone of running for president in the future in this case?

          1. mamabug   4 years ago

There's also a reasonable constitutional argument to be made that a conviction which includes barring from holding office couldn't apply to an *elected* position (as opposed to an appointed one.) Even felons who can't vote can still be elected according to the constitution so, I think, the framers would have argued that will of the people trumps all when it comes to deciding who their representatives are.

Not that Trump realistically would run in 2024. This is all just a way of keeping his name out there so nobody has to talk about what the Democrats are doing. People care less about 'god' coming to save them when there is no devil to save them from.

          2. Claptrap   4 years ago

Congress already has the power of impeachment; the bounds upon it have only been established to this point by Congress itself. It is literally one of the most wide open, if not the most wide open, powers in the whole document, akin to the pardon power of the President. This is plainly unsettled, and in the event of conviction I’m sure the USSC would relish the chance to establish precedent. Trump can’t run until 2024 anyway so he’s got plenty of time to bitchfit his way into another court loss.

The favoring of Congressional supremacy vs. the Executive is literally the opposite of an authoritarian take (and is the Originalist take, but since you’re decidedly a principals over principles kind of guy I never thought it likely you’d grok that.

What is their constitutional power to deprive someone of running for president in the future in this case?

Article 1, Clause 7. Disqualification is one of the only points of impeachment. That part is plain as day. Whether the impeachment of former officials is not established, though.

            1. JesseAz   4 years ago

Congress is given a power under struct terms, to remove an officer or president from office. They are not granted powers to do something different.

Again, you are saying since the constitution doesn't exclude it, congress can do it. That is not how constitutional systems work.

            2. JesseAz   4 years ago

You are also ignoring the giant AND prior to disqualification to office? Why?

I blame social security and medicare. Old people aren't reliant on their own families for care so they say, "Gimme my check and y'all can go f- yourselves." These programs must be abolished so that old people have skin in the game and they suffer along with the rest of the economy. Now if you're going to cry about old people starving alone in the street then you're not a libertarian (and it's better than young people wasting away alone in a basement under your policies).

    1. Don't look at me!   4 years ago

You would feel different if you had to put some of your hard earned money into it by force your entire life.
Young people should be able to opt out going forward.

      1. n00bdragon   4 years ago

The problem is that your own payments don't fund your own benefits. If all the current payers opted out of the program tomorrow then current benefits would have no source of funding (other than just printing even more money, but I guess that's considered a viable solution these days). The only way it's going to happen is if society decides to collectively to choose one of three things:
        A) Cut off benefits when current recipients die off and have a generation of young people pay for benefits understanding that they will not receive any in return. They will take responsibility for the promises made to their parents and get fucking screwed so that their children and grandchildren will not.
        B) Cut off benefits immediately and throw grandma and grandpa to the cold winds of fate. Old people who are not otherwise financially secure will get fucking screwed so that their children and grandchildren will not.
        C) [The default option] If neither A nor B is chosen, the country will eventually experience total economic collapse as either people cease lending it money and/or it prints the value of the currency it has down to nothing. What goes up must come down. Everyone gets fucking screwed because they all failed, collectively, to pick another less awful choice.

        1. creech   4 years ago

Try running on either option A or B and see what vote percentage you get. Do you think the $1,000 in currency you took out of the bank this year is the exact same $1,000 in currency you put in five years ago? The vast majority of old folks don't care that their hard earned money was paid out to other retired folks for all those years and if you say "tough shit" I just bet they won't vote for you.

    Today in Libertarian Commentary.

‘Freeze peach!’ That has long been the mocking, infantile cry of the middle-class left whenever anyone complains about clampdowns on freedom of speech. There is no ‘free-speech crisis’, radicals insist. No Platforming right-wingers on university campuses is not censorship – it’s just students freely choosing not to associate with people who have horrible views. And alt-right types being turfed off Twitter and Facebook is not censorship, either – that’s just private companies enforcing their terms and conditions. (Who knew lefties were so supportive of private property rights?)

Will these censorship deniers change their tune now that the left itself is coming under censorious attack? Amazingly, probably not. But perhaps there will be a smidgen of self-reflection. Some of the left-wing architects and cheerleaders of contemporary censorship, including Britain’s Socialist Workers Party, which has backed the No Platform policy for decades, are now being No Platformed themselves. ‘This is a disgrace!’, they cry, which would be funny if censorship were not so serious. These people helped to build the infrastructure of modern censorship, with its determination to crush ‘hate speech’ and ‘offensive’ views, and now they’re shocked to find themselves falling victim to it? Have they not read any history books at all?

    1. middlefinger   4 years ago

That’s it. I’ve decided I’m for confiscatory taxation...on grievance study and humanities (this includes Economics) PhDs and their assistants. The taxation follows these professionals throughout careers in private industry and political life. Why not. Someone has to pay for EQUAL OUTCOMES.
Put their money , investments, cronyism and pensions where their mouths are.

I was thinking that perhaps the assets of companies that are so desperate to embrace fascism should be nationalized. Google, Apple, Amazon, Facebook. Everything anyone who works for them has, anything they own, anything their majority stockholders own. And they have to keep working, and live in shitty communal housing, eating the gruel from the community kitchen.

"You wanted the collective, and now you're getting it, good and hard."

        1. Red Rocks White Privilege   4 years ago

These companies are practically nationalized as they are, considering they are openly working in the service of a single political party now.

    2. Red Rocks White Privilege   4 years ago

Amazingly, probably not. But perhaps there will be a smidgen of self-reflection.

These people don't have the emotional maturity to be self-reflective. "No bad tactics, only bad targets" and the perpetual double standard are their de facto guiding principles.

      1. Red Rocks White Privilege   4 years ago

And, I'll add, it's been this way since the French Revolution--their whole ideology and paradigms, and the people who actually run their movements, have not changed a single iota in over 230 years. It's practically a religious movement now like Christianity or Islam, which took several hundred years to insinuate themselves throughout Europe and the Middle East, and in Islam's case, Africa and into the Indian subcontinent.

So we are headed for a Corsican artilleryman in a strong man position?

          1. Red Rocks White Privilege   4 years ago

I'd say it's more like Rousseau is the secular left's version of Moses or Elijah, and Marx is their Christ. There's a reason the radical left went from trying to abolish Christianity entirely, to insinuating itself into it's institutions instead. It's why so much of radical leftism these days reflects the Calvinist theologies of original sin that formed the foundation of today's congregationalist churches, and why western Catholicism is basically indistinguishable now from Unitarianism.

    SURPRISE SURPRISE SURPRISE!!!1!!

NEW YORK (WABC) -- With statewide metrics improving, Gov. Andrew Cuomo said he will soon ease some COVID restrictions in New York state.

Cuomo says he will have announcements on Wednesday, and anticipates the state will start to open up more economic activity and reduce some of the restrictions and micro-cluster zones.

Watch for COVID cases and deaths from COVID to plummet soon, and deaths from flu to start climbing again after being largely non-existent for most of the actual flu season.

Reason's Christian Britschgi must be one of the few "surprised". Many of us predicted this, Biden would be inaugurated and the Democratic states and cities would open back up. The virus is no longer as dangerous now that Trump is out of office and destroying the economy is no longer necessary to defeat Trump. Couple that with the destruction Biden's policies will wreak on the economy and you can see why they have to open up. We are also starting to see west coast Democratic cities starting to enforce laws against rioting, arson and other assaults and destruction. This too is no surprise.

And the issue with Ct has been widely known since April/May of last year. The viral community has known about it since the technique was developed. Also the issue of testing folks w/o symptoms is known as being error prone as well.

All of the main issues have been known and it is extremely frustrating.

        PCR problems (asymptomatic & Ct)
        Hope-Simpsom (seasonality & latitude dependency)
        Gompertz behavior
Futility of NPI's (ineffectiveness of lock downs and masks)

Love this: "Californians heard the urgent message to stay home when possible and our surge after the December holidays did not overwhelm the health care system to the degree we had feared."

So, despite the reports of people not abiding and sheriffs not enforcing, #thescience pushers have commended the people for listening and have now rewarded them with a sliver of freedom.

Here in my part of Ohio, it appears everyone is abiding by such restrictions like mask mandates, yet numbers keep rising. The explanation: clearly a small pocket of selfish people aren’t listening to #thescience and they’re ruining it for all of us.

Seems like the arbitrary rules have no effect on the numbers and vice versa.

    1. CE   4 years ago

Governor issued restrictive edict from on high, people mostly ignored it, cases surged after holidays and are now declining, as easily predicted. Governor claims success of edict and removes it.

    2. docduracoat   4 years ago

Here in Florida, and our adjoining state Georgia, we are both totally open for business.
Restaurants are packed, bars are open, theme parks are open, and the beaches are crowded.
I see maybe 1% of people wearing masks in the street.
Of the two ICUs in my suburban Hospital, the MICU has no corona patients, and the surgical ICU has two corona patients out of 12 beds.
So our two states with minimal restrictions are doing great in terms of both the economy and corona cases.
It almost seems like the states with the worst restrictions have the worst problem.

Governor French Laundry is a no-talent demagogue but he is not entirely stupid. He is facing a very real recall threat because he has been a horrible leader and mismanaged everything he and his administration have touched. He let the EDD give away over $2B in fraudulent payments and accepted zero accountability. His unchecked edicts for lockdown didn't work. He ignored the rules and considered himself better than those who elected him. He loves attention and the sound of his own voice more than anything and in a desperate attempt to salvage his position, he issued a "surprise retraction" of policies that don't work but make him feel powerful and important. It will not work. He is soon to be "former Governor of California"!

    It's a miracle!

California Governor Announces Statewide Stay-at-Home Order Lifted ‘Immediately’

The state is also lifting a 10 p.m. to 5 a.m. curfew. The newest decree allows restaurants and churches to resume outdoor operations and hair and nail salons to reopen in many areas, though local officials could choose to impose stricter rules.

Wonder if this has anything to do with being a scant 6 days into Biden administration?

Maybe it was the recent exposure that California was hiding COVID data because it might "confuse" the populace?

Maybe it was Pres. Biden admitting that there's nothing we can do about the course of the virus for some months to come?

Or maybe it's that there are already 1.2M signatures on the petition to recall Gov. Newsom, with 1.5 months left to get to 1.5M needed to put it to a statewide vote?

Gov Newsom claims to be "following the science" when he imposed his most recent stay-at-home-orders, which relied on the secret formula mentioned above, as well as ICU capacity.

The regional order, which Gov. Gavin Newsom first announced on Dec. 3 and was set to expire Monday, splits the state into five regions — the Bay Area, Greater Sacramento, Northern California, San Joaquin Valley and Southern California. If the remaining ICU capacity in a region falls below 15%, it will trigger a three-week stay-at-home order, Newsom said.

It was just a few weeks ago (Dec 29) that Newsom extended the stay-at-home order for the San Joaquin Valley and Southern California regions, and Jan 9th that he extended it for the Bay Area ("Bay Area 'stay-at-home' order extended indefinitely until ICU capacity increases"). But now, for unspecified reasons, all that is tossed. Note for the record that the San Joaquin Valley, Southern California and the Bay Area ICU capacities still remain under 15%.

When Newsom was asked by a reporter to respond to critics who say his decision is "political, arbitrary, and that he's feeling the pressure of the recall effort," the governor replied: "Utter nonsense."

Gov. Newsom and state health officials were criticized for withholding data from the public that help them determine when the order would be lifted. State health officials defended that action, saying they rely on a very complex set of measurements that would "confuse and potentially mislead the public if they were made public". Newsom provided some insight into the four variables state health officials were monitoring, including a region's current estimated ICU capacity available, current community transmission, current regional case rates and proportion of cases admitted into the ICU.

P.S. Some of the Gov's most ardent supporters needn't have worried...5 days ago "Governor Gavin Newsom today signed an executive order in response to the COVID-19 pandemic, extending the validity of medical cannabis identification cards that would otherwise have expired." In a separate order "Today, we are announcing an agreement to extend the eviction moratorium in California through June 30, 2021".

  37. docduracoat   4 years ago

I am loving these preventing eviction orders.
How do they expect the property owners to pay their mortgages and maintain the properties?
And even worse, how do they expect them to pay their taxes when non paying tenants can’t be evicted.
Of course the state can seize the properties, but now it is an albatross around the states’ neck when no money is coming in and no one will buy a property when you can’t get rid of deadbeat tenants.
Unlike the federal government, the states can’t just print money to make up for missing taxes.
The Biden administration can try to support them by printing more money but as others have said eventually the massive printing of money will lead to the money having no value.
So the only question is when the real estate market will collapse in California
