California Gov. Gavin Newsom Issues Surprise Retraction of Controversial Stay-at-Home Order
The governor's order had banned outdoor dining and forbade Californians from socializing with members outside their household.

In a surprise move, California public health officials are lifting a controversial stay-at-home order. The rule had forbidden people in affected regions from socializing with members outside their households and imposed a raft of restrictions on businesses in much of the state.
"California is slowly starting to emerge from the most dangerous surge of this pandemic yet," said California Health and Human Services Secretary Mark Ghaly in a press release today. "Californians heard the urgent message to stay home when possible and our surge after the December holidays did not overwhelm the health care system to the degree we had feared."
"Today we can start to see some real light at the end of the tunnel," said Gov. Gavin Newsom at a press conference this afternoon.
The stay-at-home order, issued in early December, divided the state into five regions. The rules snapped into effect whenever a region's hospital intensive care unit (ICU) capacity fell below 15 percent.
Where it was in effect, the order banned restaurants from operating outdoor dining and kept personal services businesses, such as nail salons, from operating at all. Retail businesses were required to operate at 20 percent capacity.
Before its snap repeal, the order was in effect in three regions: Southern California, the San Joaquin Valley, and the Bay Area. It had been lifted in the Sacramento region and had never gone into effect in the Northern California region. At his press conference, Newsom shared state projections showing that all regions of the state would have more than 15 percent ICU capacity by February 21.
Those restrictions were more severe than the state's prior Blueprint for a Safer Economy. That system put counties into one of four color-coded tiers, each with different conditions for which businesses were allowed to open and at what capacity they could operate. But even in the most restrictive "purple" tier, outdoor dining was allowed.
The regional stay-at-home order sparked widespread resistance. Many restaurants continued to keep their outdoor dining patios open in protest. Sheriffs departments across the state said they wouldn't enforce the order. Local governments and business associations threatened or filed lawsuits. The order also boosted efforts to recall Newsom.
The sudden lifting of the order, which leaked Sunday afternoon, came as a surprise to state legislators, many of whom learned the news from Twitter.

The state will now return to the four-tiered "blueprint" system. All but three of the state's counties are currently in that most restrictive "purple" tier, although Newsom said in his press conference that this would be reevaluated tomorrow.
Counties are allowed to set more restrictive reopening conditions than what the state mandates. It will be a while before the precise practical effects of today's decision are clear.

Looks like SCOTUS Chief Justice John Roberts will NOT preside over the Senate's impeachment trial of Trump (because Trump is no longer president).

If left wing Senator Pat Leahy presides over the trial, and if Trump refuses to participate because the procedure it isn't Constitutional (which would be smart), I'd be surprised if more than 53 Senators vote for conviction (67 votes are required to convict).
A Senate impeachment trial for Trump (after he left office) is going to blow up in Schumer's angry face if he proceeds, which is why I continue to believe the trial will never occur.
Totally a fair process. And the fact that one of the people identified in the constitution as being part of the process not being there means it is constitutional.
The CJ is only required in the trial of a sitting President to remove the VP's conflict of interest. Donald Trump is a former President, his conviction does nothing to (directly) benefit her.
The Constitution says nothing about the trial/conviction of former officials, and the English tradition in which the Founders were reared doesn't prevent it. But a conviction/disqualification at this point would certainly (and rightly) be appealed to the USSC.
Regardless of the merits in this particular case, I think impeachment of prior officials for conduct which occurred in that capacity is absolutely an appropriate power for Congress to have.

There's also a reasonable constitutional argument to be made that a conviction which includes barring from holding office couldn't apply to an *elected* position (as opposed to an appointed one.) Even felons who can't vote can still be elected according to the constitution so, I think, the framers would have argued that will of the people trumps all when it comes to deciding who their representatives are.

Congress already has the power of impeachment; the bounds upon it have only been established to this point by Congress itself. I blame social security and medicare. Old people aren't reliant on their own families for care so they say, "Gimme my check and y'all can go f- yourselves." If all the current payers opted out of the program tomorrow then current benefits would have no source of funding (other than just printing even more money, but I guess that's considered a viable solution these days). The only way it's going to happen is if society decides to collectively to choose one of three things:
A) Cut off benefits when current recipients die off and have a generation of young people pay for benefits understanding that they will not receive any in return. They will take responsibility for the promises made to their parents and get fucking screwed so that their children and grandchildren will not.
B) Cut off benefits immediately and throw grandma and grandpa to the cold winds of fate. Old people who are not otherwise financially secure will get fucking screwed so that their children and grandchildren will not.
C) [The default option] If neither A nor B is chosen, the country will eventually experience total economic collapse as either people cease lending it money and/or it prints the value of the currency it has down to nothing. What goes up must come down. Everyone gets fucking screwed because they all failed, collectively, to pick another less awful choice.
Try running on either option A or B and see what vote percentage you get. Do you think the $1,000 in currency you took out of the bank this year is the exact same $1,000 in currency you put in five years ago? Reason's Christian Britschgi must be one of the few "surprised". Many of us predicted this, Biden would be inaugurated and the Democratic states and cities would open back up. The virus is no longer as dangerous now that Trump is out of office and destroying the economy is no longer necessary to defeat Trump. Couple that with the destruction Biden's policies will wreak on the economy and you can see why they have to open up. We are also starting to see west coast Democratic cities starting to enforce laws against rioting, arson and other assaults and destruction. This too is no surprise.

Here in my part of Ohio, it appears everyone is abiding by such restrictions like mask mandates, yet numbers keep rising. The explanation: clearly a small pocket of selfish people aren’t listening to #thescience and they’re ruining it for all of us.

I see maybe 1% of people wearing masks in the street.
Of the two ICUs in my suburban Hospital, the MICU has no corona patients, and the surgical ICU has two corona patients out of 12 beds.
So our two states with minimal restrictions are doing great in terms of both the economy and corona cases.
It almost seems like the states with the worst restrictions have the worst problem.

Governor French Laundry is a no-talent demagogue but he is not entirely stupid. He is facing a very real recall threat because he has been a horrible leader and mismanaged everything he and his administration have touched. He let the EDD give away over $2B in fraudulent payments and accepted zero accountability. His unchecked edicts for lockdown didn't work. He ignored the rules and considered himself better than those who elected him. He loves attention and the sound of his own voice more than anything and in a desperate attempt to salvage his position, he issued a "surprise retraction" of policies that don't work but make him feel powerful and important. It will not work. He is soon to be "former Governor of California"!

Gov Newsom claims to be "following the science" when he imposed his most recent stay-at-home-orders, which relied on the secret formula mentioned above, as well as ICU capacity.
The regional order, which Gov. Gavin Newsom first announced on Dec. 3 and was set to expire Monday, splits the state into five regions — the Bay Area, Greater Sacramento, Northern California, San Joaquin Valley and Southern California. If the remaining ICU capacity in a region falls below 15%, it will trigger a three-week stay-at-home order, Newsom said.
It was just a few weeks ago (Dec 29) that Newsom extended the stay-at-home order for the San Joaquin Valley and Southern California regions, and Jan 9th that he extended it for the Bay Area ("Bay Area 'stay-at-home' order extended indefinitely until ICU capacity increases"). But now, for unspecified reasons, all that is tossed. Note for the record that the San Joaquin Valley, Southern California and the Bay Area ICU capacities still remain under 15%.
When Newsom was asked by a reporter to respond to critics who say his decision is "political, arbitrary, and that he's feeling the pressure of the recall effort," the governor replied: "Utter nonsense."
Gov. Newsom and state health officials were criticized for withholding data from the public that help them determine when the order would be lifted. State health officials defended that action, saying they rely on a very complex set of measurements that would "confuse and potentially mislead the public if they were made public". Newsom provided some insight into the four variables state health officials were monitoring, including a region's current estimated ICU capacity available, current community transmission, current regional case rates and proportion of cases admitted into the ICU.
P.S. Some of the Gov's most ardent supporters needn't have worried...5 days ago "Governor Gavin Newsom today signed an executive order in response to the COVID-19 pandemic, extending the validity of medical cannabis identification cards that would otherwise have expired." In a separate order "Today, we are announcing an agreement to extend the eviction moratorium in California through June 30, 2021".
I am loving these preventing eviction orders.
How do they expect the property owners to pay their mortgages and maintain the properties?
And even worse, how do they expect them to pay their taxes when non paying tenants can’t be evicted.
Of course the state can seize the properties, but now it is an albatross around the states’ neck when no money is coming in and no one will buy a property when you can’t get rid of deadbeat tenants.
Unlike the federal government, the states can’t just print money to make up for missing taxes.
The Biden administration can try to support them by printing more money but as others have said eventually the massive printing of money will lead to the money having no value.
So the only question is when the real estate market will collapse in California
