Rand Paul Was Right to Delay Vote on Funding Bill for 9/11 First Responders

The Kentucky senator wants the Senate to consider offsetting spending cuts before approving limitless, automatic spending for the rest of the century.

Sen. Rand Paul (R–Ky.) is catching a lot of flak for demanding that the Senate actually debate an open-ended extension of the September 11 Victims Compensation Fund.

On Wednesday afternoon, Paul objected when Sen. Kirsten Gillibrand (D–N.Y.) attempted to pass the bill by unanimous consent—an expedited process that does not require each senator to record his or her vote.

"Any new spending that we are approaching, any new program that's going to have the longevity of 70, 80 years, should be offset by cutting spending that's less valuable," said Paul on the Senate floor. "We need to at the very least have this debate. I will be offering up an amendment if this bill should come to the floor, but until then I will object."

Sen. Mike Lee (R–Utah) also opposed passing the bill by unanimous consent.

The bill, H.R. 1327, would extend the life of the Victims Compensation Fund to 2090. (The fund is currently set to stop accepting claims by the end of next year.) It would also do away with any limited appropriations for the fund, instead paying out however much is necessary to cover eligible claims through 2092.

The Congressional Budget Office estimates that the bill would cost $10.2 billion over the next decade.

The first 9/11 Victims Compensation Fund operated from 2001 to 2003, and awarded $7 billion to the families of the 2,880 people killed in the attacks on that day, plus another 2,680 who were injured.

In 2011 the fund was renewed and expanded to cover anyone injured during the rescue and recovery efforts at the targeted World Trade Center, as well as those in proximity to the attacks who were injured or came down with other health problems, including cancer.

Since 2011, the fund has since given out $5.2 billion to nearly 29,000 claimants.

Despite Paul's objections, the permanent extension of the victim's fund will almost certainly pass. The Senate's reauthorization measure currently has 73 co-sponsors, and Senate Majority Leader Mitch McConnell (R–Ky.) has said he will put it to a vote before the August recess.

On Fox News, former Daily Show host and 9/11 first responder champion Jon Stewart accused Paul of "fiscal responsibility virtue signaling," saying the Kentucky senator's current concerns about the deficit were hypocritical in light of his support for 2017's tax cuts.

Stewart was not alone in this line of criticism.

So let me get this straight: @RandPaul has no problem voting for billions in tax cuts for the wealthy and corporations, but votes against providing health care for 9/11 first responders because he's worried about the debt.

These condemnations skate over Paul's rather reasonable position that the Senate should actually debate the bill and consider fiscal offsets before approving nearly a century's worth of effectively unlimited spending.

Rep. Justin Amash (I–Mich.) made this same point last week when explaining why he voted against the victim fund's extension in the House:

Our Constitution empowers Congress to appropriate money. Typically, this means we must vote annually to spend on a particular object. This process holds government accountable to the people. The 9/11 VCF works differently by authorizing 70+ years of unlimited, automatic spending.

And while it's true that Paul voted for a deficit-increasing tax cut, he has also consistently introduced legislation to cut spending across the board. Just last month, the Senate rejected a budget plan authored by Paul that would have cut federal spending by $183 billion in the coming fiscal year.

Libertarian-leaning folks like Paul want less spending, lower taxes, and smaller deficits. The senator has a record of supporting all three policies, even though the rest of Congress seems only able to muster support for one.

President Donald Trump's attacks on "Squad" member Rep. Ilhan Omar (D–Minn.) escalated markedly Wednesday night at a North Carolina rally. Trump went on an extended rant against the congresswoman, declaring that she "looks down with contempt on the hardworking Americans, saying 'ignorance is pervasive in many parts of this country.'" He also said that "Omar has a history of launching vicious anti-Semitic screeds."

The president's riff sparked a chant of "send her back" from the crowd, which Trump did not discourage.

Both right and left condemned the crowd's behavior on Twitter:

The House voted to repeal the Affordable Care Act's "Cadillac tax" on high-end health plans by a commanding 419–6 vote. That measure, passed as part of the initial Obamacare legislation, imposed a 40 percent tax on employer-sponsored insurance plans worth $11,200 for individuals and $30,100 for families. It was scheduled to go into effect in 2022.

Both unions and businesses opposed the tax, as it raised the cost of providing fringe health benefits to employees.

Free marketeers are split on the tax. Many view it as just another way the government makes health care coverage more expensive. But some libertarians have offered tentative support for it. By taxing wages but not health benefits, they argue, the current tax code encourages an expensive, inefficient system of employer-sponsored insurance coverage. The "Cadillac tax" amounts to a partial rollback of this distortionary tax policy, the thinking goes.

Libertarian-leaning Rep. Justin Amash (I–Mich.) voted against the tax's repeal.

        Even the Veterans Health system does not allow all claims of service-connected disability to be filed forever. You have to file most claims within a short period of time after leaving the US Military.

        The First Responders to Sept. 11 evidently do have some health problems related to the collapsed buildings but they have NY health insurance and Union insurance which should cover everything.

        Some of these First Responders want cash. Did y'all also know that taxpayers paid out money to the civilians that died on 9/11? Yup. I guess regular life insurance would not pay out because it was a labelled a "terrorist attack" and insurance has all sorts of exemptions for War and Terrorism.

        The fund received 7,408 claim submissions from 75 countries. Awards were made in 5,560 of those cases and totaled over $7 billion.
        The fund received 2,963 death claims. This accounted for more than 98% of eligible families. Funds were distributed in 2,880 of these cases. The average award was $2,082,128 and went as high as $7.1 million.
        The fund received 4,445 personal injury claims. Funds were distributed in 2,680 of these cases. The awards ranged from $500.00 to $8.6 million.
        The money was tax-free.

        Statistics for Re-opened VCF (as of May 31, 2019):

        Since its re-opening in 2011, the VCF has received 50,170 total eligibility claims. Of that, 23,641 eligibility claims have been approved and 16,715 are still processing.
        More than $5.1 billion in compensation has been rendered.
        The lowest dollar value of a compensation decision was $86.07.

        September 11th Victim Aid and Compensation Fast Facts

          VA disability claims can be filed for as long as the disabled veteran is alive.

          HOWEVER, if you want to receive disability compensation pay from the time you separate/retire from the military it must be filed within 18 or 24 months (I can't remember and can't find the reference off-hand) from the time the veteran separates, otherwise they only draw disability from the time they're approved and get no "back-pay".

          The longer you wait from the time you separate/retire from the military, the harder it is to get approved as it becomes more difficult to prove that your condition is service related and not something you inccurred AFTER service.*

          *Exceptions (people whose conditions are automatically presumed to be service related): POWs, people with certain conditions who were at Camp Lejeune during a certain period, Gulf War vets, vets with ALS (was unaware of this exception), vets exposed to Agent Orange, and a few others.

      Considering 3000 people were killed, and about 6,000 injured, why are there 29,000 claimants? Note 5.2 billion/29,000 = $179,000 payout on average to each claimant.

      Paul and Amish are right to reject this, because it's a racket whereby some people have managed to get lots of money when they should be paying it out of their own pocket. Even when soldiers die on the battlefield their families get a death gratuity of $12,420. The government isn't paying compensation to victims of other natural disasters, crime, or other terrorist incidents, and it shouldn't. They have the freedom to do what other victims do: sue the responsible party and collect it from them. Of course when the offender is in another country (like for Otto Warmbier who suffered death from Kim's prisons) collecting is a problem.

          The September 11th Victim Compensation Fund ("VCF") was created to provide compensation for any individual (or a personal representative of a deceased individual) who suffered physical harm or was killed as a result of the terrorist-related aircraft crashes of September 11, 2001 or the debris removal efforts that took place in the immediate aftermath of those crashes.

          Considering dust and ash contained minute particles of EVERYTHING that was in the collapsed buildings, "bad air" drastically undersells what people inhaled.

People who were happy to pay Netflix $10 a month for a huge catalog of quality movies of a variety of ages and origins, plus a small, high quality set of compelling original content that was bingeable water cooler (or maybe social media, now?) pop culture discussion material are much less likely to find a withered husk of movie content and shotgun approach to new content among a sea of competitors who have been letting their dirt cheap content licenses to Netflix lapse and are withholding them either for unprofitable (to Netflix) new terms or in a bid to beef up their own library for a competing $10/mo service.

      Netflix had huge success because the content owners couldn't see how valuable their catalog was or what appetite there was for streaming. Now that they've demonstrated how successful the model is, all those owners are salivating and will tank the market by trying to milk as much as they can out of it for themselves at the expense of the variety, convenience, and value that made Netflix so attractive to cord cutters in the first place. It's a classic boom/bust cycle.

    Senator Rand Paul recent courage on fiscal responsibility amazes me, mostly because it has eluded him so often in the past. But when it comes to people healthcare he is certainly willing to draw the line. He wants cut in the budget to offset the spending. I suggest he start with Federal funds going to Kentucky. A state listed as the second most dependent on Federal dollars. Kentucky takes in over $2 dollars of Federal money for every $1 they send to Washington.

Cutting this fund would mean absolutely nothing to our budget. Unless we're talking about social security, medicare/medicaid and military spending... we are not talking about reducing spending in any meaningful way.
