Princeton Student Activists Have a List of Title IX Demands That Aren't All Bad
They want restorative justice and facts about disproportionate punishment for students of color

Princeton students have occupied the space in front of Nassau Hall, the campus's administrative building, and are engaged in a round-the-clock protest until university leadership addresses their demands relating to the prevention of sexual misconduct.
Surprisingly, the demands are not all bad.
"In the service of survivors, fix Title IX," activists chanted on Wednesday, the first day of the ongoing protest.
Title IX is the federal statute that outlaws sex-based discrimination on campuses, and was cited by the Obama administration as justification for compelling colleges and universities to take stronger action combat sexual harassment and misconduct. The policies recommended by President Obama's Education Department were unfriendly to the due process rights of accused students, and Education Secretary Betsy DeVos has revised them.
When activists press for Title IX-related changes on campuses, they are typically demanding that authorities adopt a "believe all victims" mentality, which would make it less likely that accused students would receive fair treatment. I've been harshly critical of this kind of activism, in the past.
The Princeton students' demands, though, are not all bad. For one thing, they have asked for the university to devise a restorative justice option for victims who "want to pursue alternative pathways for healing and justice that fall outside the punitive system." If both the accused and the accuser would prefer to reach some other arrangement regarding their dispute, they should be permitted to do so. (Indeed, one of the many reasons DeVos's guidance constituted an improvement is that it allows for such an option.)
The activists have also demanded "full access to statistics relaying the racial and socioeconomic makeup of both alleged and convicted perpetrators. We want to ensure, as a community, perpetrators are being held accountable at the same rate - regardless of socioeconomic and racial background." What they will likely find is that male students of color—and immigrants—are overrepresented among those disciplined under Title IX, consistent with the preliminary evidence gathered at other colleges and universities. It's important to spread awareness of the fact that young men of color are disproportionately harmed when sexual misconduct adjudicators abandon basic principles of fairness.

The remedy to this will not be what you want it to be.
I came here to say that.
If both the accused and the accuser would prefer to reach some other arrangement regarding their dispute, they should be permitted to do so.
Coercion or extortion; choose your weapons.
How do you think the wife of the cop who lived on our block ended up working in my mom's office?
Though disparate impact is not causal proof in itself of different treatment, especially in statistically small sample sizes.
What do you mean, small sample sizes?
Every man enrolled in a college is a proven guilty rapist. All right thinking students agree on this point. The science is settled.
How much bigger of a sample do you want?
Hey, wanna see my sample size?
Define "man".
"We want to ensure, as a community, perpetrators are being held accountable at the same rate—regardless of socioeconomic and racial background."
What do they mean, "at the same rate?" Proportion of the general population as opposed proportion of the population of offenders?
Sorry we can't adjudicate your case until we get some more white guys in the hopper. We just hit our quota for Cablinasian men this month.
I suggest releasing a PSA... "don't wait until your rich white rapist is decades older and trying to get the Supreme Court nomination before telling anyone.... (The more you know!)"
There was one of those PSA announcements telling us to scream "this guy is not my parent" if a stranger tried to kidnap us back in the 1980's. California's new sex ed standards go over consent and abuse in grades 7 and 8. Knowlege about rights is the best way to stop abuse.
How about proof of guilt and a fair trial. After that, check the porportionality. There should be fairness in sentencing, but only the provable guilty should be pusnished.
"These nutty protesters aren't as nutty as other protesters - let's applaud their moderation!"
Why should all of the races be punished at the same rate? What if one race happens to be more guilty than the others? Should not the truth in each case matter more than anything else?
Robby likes to repeat this point because it signals his progressive bona fides. He fails to realize that establishing racial quotas always requires under punishing the guilty and over punishing the innocent. It doesn't get us closer to anything like justice.
I don't think it's just that. Sad to say, but I suspect white college women are more likely to be embarrassed when caught out sleeping with a black guy and more likely to cry 'rape' to deflect blame for their own behavior. What fraction of complaints against black men are filed by black vs white women?
People from a minority culture are less likely to know the meaning of a subtle hint. The Torah says someone should scream an objection if he or she wants the sex to stop. Don't calmy say, "This date is starting to remind me of that painting with the Sabine women," as you show your respect to a Kohan by assuming the position, because that signal could mean an invitaion to role play. (That reminds me, this got under reported , and the island containing Notre Dame was peaceful a few days ago other than some guy screaming "SOS" near me as the police dragged him away.)
Speaking of cross-cultural romantic misunderstandings this guy is still pissed over his troops voting to surrender Syria once they heard my dad's rumor about me wanting to be an ISIS bride.
You jest, but I think you're on to something. Cross-cultural miscommunication probably does contribute to situations in which a young white woman perceives herself as raped while the Black young man she was with just thinks he got laid.
Hey, whatever you need to tell yourself to avoid giving Blacks agency.
This "overrepresentation" meme needs to stop because it's being disproportionately misapplied. The fact that more blacks commit more crimes does NOT mean blacks are "overrepresented". It means they are accurately represented compared to the level of crime they commit, which is higher.
How many of them would still want restorative-justice options if they knew DeVos was pushing for the same thing?
Is Devos *pushing* or *permitting* it?
"Permitting" would probably be enough for them to drop it. Suggest that Trump likes it and they'll demand the school administration should start blaming the victims.
Or Trump could really make their heads explode by announcing he's a woman.
Unless the demand is to end universities adjudicating cases of alleged sexual assault it's bad.
Why?
Was it wrong when Penn State did this with respect to Jerry Sandusky?
I still don't understand why colleges are adjudicating criminal complaints. Like, isn't that what the criminal justice system is for?
