Prosecutors Drop All Charges Against Jussie Smollett
The FBI is still investigating, however.

There has been another twist in the Jussie Smollett saga: Prosecutors dropped all charges against the Empire actor who had been accused of orchestrating a hoax hate crime against himself.
State attorney Kim Foxx made the unexpected announcement Tuesday: "After reviewing all of the facts and circumstances of the case, including Mr. Smollett's volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case."
Note that this outcome is not the result of a plea deal—prosecutors simply decided they did not want to go ahead with the case, which is now sealed.
"Today, all criminal charges against Jussie Smollett were dropped and his record has been wiped clean of the filing of this tragic complaint against him," said an attorney for Smollett at a press conference. "Jussie was attacked by 2 people he was unable to identify on January 29th. He was a victim who was vilified and made to appear as a perpetrator as a result of false and inappropriate remarks made to the public, causing an inappropriate rush to judgment."
Smollett initially told police that two men had attacked him on the streets of Chicago in the middle of the night, and that they had yelled "MAGA country." Since Smollett is black and gay, the assault was considered a possible hate crime.
But the police quickly came to view Smollett as a suspect, and believed that he had paid two brothers—one of whom had been an extra on the show—to stage the attack. The brothers, Abel and Ola Osundairo of Nigeria, were athletic trainers who had worked with Smollett, and they eventually admitted to authorities that they were involved. Police arrested Smollett, and a grand jury indicted him on 16 charges of making false statements.
Less than a month later, Smollett is a free man. It's impossible to say for sure what exactly went wrong, but prosecutors clearly decided that the evidence they had was not as rock solid as Chicago PD had implied in their repeated statements to the press. It's also possible the police really screwed up somewhere. Indeed, the cops' contention that a check paid by Smollett to the Osundairo brothers was intended to cover the hoax was bound to become a sticking point, as it had become plausible that the money actually was for training costs. The brothers were questioned extensively, and suspects do occasionally slip up and make incriminating but false statements under such conditions.
Still, there's no alternative theory of the case, and it's fairly obvious the brothers were indeed involved—they were caught on camera near the scene of the crime. But the prosecutors decided, for whatever reason, that proving Smollett's involvement was not worth their time. Foxx had exchanged text messages with supporters of Smollett, and had recused herself from the case two weeks ago. Police are evidently furious with her.
Smollett agreed to forfeit his bond, and perform community service, though again, not as part of a plea deal.
Smollett isn't in the clear yet, however. The FBI is still investigating a threatening letter he received in the mail a week before the alleged attack. If forensics teams find evidence Smollett sent the letter to himself, he would face very serious federal charges.

I thought that it indicated that there was disagreement among Muller's team about whether or not stuff like Trump allegedly telling Comey to lay off Flynn was obstruction. Since they couldn't agree about the underlying law, and couldn't prove exactly what he said to Comey in any case, they decided that it would create an RCF if they claimed that Trump obstructed justice. Apparently Barr and Rosenstein take the view that what Trump is accused of saying isn't obstruction, so they said that Muller didn't identify anything that meets the elements of obstruction. So Trump correctly said that he was exonerated.

I read the Smollett investigation cost Chicago at least $150,000. His forfeiture of his $10,000 bond leaves $140,000 wasted.
Tina Tchen, former Chief of Staff to Michelle Obama, contacted Chicago State's Attorney Kim Foxx 1 Feb 2019 on behalf of Smollett. That lead Kim Foxx to recuse herself from the prosecution and suggest to CPD Superintendent Johnson the incident case be handed over to the FBI who, as I understand, were investigating the letter as a hate crime.
1 Feb 2019 the letter and incident were apparently not considered hoaxes.
Now if the investigation of the incident (now presumed to be a hoax by Smollett) were being handled by the FBI with the investigation of the letter (now presumed to be a hoax by Smollett) things could get interesting. It is possible Chicago prosecutor's office did not pursue the case because it has gone federal and Chicago did not need to waste more money.

FOX32's Rafer Weigel spoke to Smollett's defense team and they are saying his community service was done prior for something not related to this case.

Hoaxes? The FBI produces an annual report of thousands of hate crimes perpetrated by unknown individuals at a category lower than, but distinct from, verbal assault. Literally thousands of documented cases of minorities getting the wrong change when getting out of a cab, being given sideways glances on subway platforms, and standing in line outside clubs where someone might have yelled something that was probably a slur. You call those hoaxes?

The tv series and movie are loosely based on the case of Dr. Sam Sheppard of Cleveland, Ohio.
Interesting read about him. There was no dramatic escape as in the movie. One thing is part of his conviction was from the literary "dog in the night" which Sherlock Holmes fans know. The dog did not bark according to witnesses. It remains one of those sort of unsolved things.

Recusal means just that; you can't be a part of the case. That means you can't work on the case or be privy to any privildged information about the case.

I wasn't equating what this guy did with smoking pot, simply using that as an argument against the rabbit hole of claiming the taxpayers as victims, as that threshold could apply to almost any "crime" that requires investigation.
It's not unreasonable to hold someone accountable for willfully leading investigators on some expensive wild goose chase. The guy paid $10k in fines to Chicago, which seems like a reasonable punishment to me. "Serious Federal charges" invokes a vision in me of something more substantial than a fine. In fact, you can get up to 5 years for lying to the FBI, 8 years if it involves terrorism. Do you think Jussie deserves 8 years in prison for this?

If they can show damages, then they have a lawsuit against Smullett, and should pursue it. That would include wrongful conviction if it were to have gotten that far.

I think the $10,000 fine is an appropriate punishment. What is not appropriate is him not walking away with a felony conviction. If this were a real plea deal where he got a conviction and had to admit what he did in open court, I would not have a problem with it.

The city and county looked at the bill and said no thanks. Remember that the costs associated with the prosecution and incarceration in this matter would fall entirely on chicago and cook cook county. They both are running large budget deficits this year. Security costs would be enormous. PR costs for dealing with the press, also large. Then if they did get time for conviction, housing a celebrity in jail would represent enormous security costs for the city/county.
Essentially they looked at all this, and made the deal to take the bond $10,000 and call it a day.

If they had made a deal for him forfeiting his bail money and a community service, I wouldn't have a problem with this. The concerns you raise are legtimate. But addressing them does not require letting him get off without a conviction. Convict his ass and mark him as a liar for the rest of his life. Make him admit in open court he lied. Any punishment beyond that is of marginal utility.

Isn't forfeiting your bond something that happens when you fail to show up in court or violate the conditions of release? Guilty or innocent, they just want you to show up and follow the conditions. If you fail in these respects, you're *supposed* to lose your bond, you're not doing the state a favor.
Did he comply with his release conditions? If not, then he doesn't deserve thanks for suffering the legal consequence of his failure.

You don't have to. The police reports are a matter of public record and are, themselves pretty incredible and, in the process of investigating, they found two men who openly admit that Jussie paid them to do it.
If you start out not believing the police in this story, then you start from the assumption that the crime was a hoax because the police took it seriously until they couldn't find any suspects matching Jussie's description but could see the two men who admit to the act/crime on the video.
The CPD does have ways of getting information out of witnesses. Calling it "openly" is quite laughable though.

OK, in front of a jury. Either way, sure was lucky that the CPD chose two guys who just happened to be associated with Smollett and willing to go along with their scheme to extort $10K out of Smollett by convincing him to let them beat the shit out of them. Working the knowledge about the undisclosed letter into their testimony and making them go in to buy the ski masks and gloves they wore to perpetrate the crime was just icing on the cake.

More likely, it's a political calculation.
Chicago is run by a Democratic party machine that does Democrat things for Democrat reasons. The African-American community is an important part of that machine, and it may have been decided not to prosecute because prominent members of that community urged them not to prosecute.
I wouldn't read the decision not to prosecute as implying anything about the quality of the evidence at all. More likely, prosecution just wasn't politically expedient. It might be otherwise if we were talking about somewhere in Kansas. The Democrat machine is so powerful in Chicago, even Rahm Emanuel has to play by their rules.
It's not really in the interest of African American community or their activism for Smollett to go unpunished. They can't afford him to be used as evidence that Americans are obsessed with identity politics and will often launch witch hunts to advance a narrative. They have a convoluted narrative on privilege and intersectionality that often turns on them and puts them on the defense, as this case was the more recent example.
Who can seriously defend him? There's no footage, no physical evidence, and the brothers all but admitted to the act. Black celebrities once revered as national pop icons are being exposed every year. Surviving R Kelly called out the black community for rallying around a man who was at minimum a highly unethical individual. Inevitably some poor black kid in Chicago will be sent to jail for stealing a sneakers bar from Walmart and the outside world will pounce on it. It's not a good situation for the city and the left.

I infer they all believed Smolletts and had an opportunity to stick it to Trump and MAGA. Then it all blew up in their faces.
