Harvard Students Filed Multiple Title IX Complaints Against Brett Kavanaugh To Get Him Fired

On Monday, Harvard University announced that embattled Supreme Court nominee Brett Kavanaugh would not be teaching his three-week Law School course this year. More than 800 alumni had signed a letter asking Harvard to cancel the class.
Additionally, student-activists had lobbied their classmates to file Title IX complaints against Kavanaugh. Nearly 50 students signed a petition indicating they had done so, though it's not clear all of them actually did, according to The Harvard Crimson.
Title IX is the federal statute that mandates sex equality in education. The Obama-era Education Department had also required universities and colleges to adjudicate sexual misconduct in accordance with the federal government's expansive view of Title IX. Education Secretary Betsy DeVos is currently revising this guidance.
One of the reasons Title IX reform has been so urgently necessary is that aggrieved students have weaponized the process in order to silence people—other students, invited speakers, faculty members—who offend them. Using Title IX to get rid of Kavanaugh, who is not accused of anything that would sustain a hostile educational environment charge, is a perfect example of this. As Harvard Law professors Jeannie Suk Gearson and Janet Halley told the Crimson, student-activists are abusing the process:
"Such an abuse of process would undermine the legitimacy and credibility of complaints that the Title IX process is intended to deal with, as well as of the Title IX office to focus on its duties," Suk Gersen wrote in an email. "It might be effective in drawing further attention to some students' objection to Kavanaugh's teaching appointment, but I don't expect him to be found to have violated Harvard University's Sexual & Gender-Based Harassment Policy based on the currently known public allegations against him."
Janet Halley, another Law School professor with a background in Title IX law, also called the students' strategy of filing formal complaints unlikely to succeed.
"I urge the students to divert their energy from this implausible claim that he's going to create a sexually hostile environment by teaching at the Law School to the really grand issue of whether he's fit to be in his current judgeship or promoted to the Supreme Court," Halley said.
Samanatha Harris, an attorney with the Foundation for Individual Rights in Education, agreed.
"This is such an absurd contortion of Title IX that I suspect even those filing the complaint know it's unlikely to succeed as a matter of law, and are doing it more as a publicity stunt than anything else," Harris wrote in an email to Reason. "While it is obviously their right to protest, they might consider whether forcing Harvard's Title IX office to devote its time and resources to this particular claim would undermine the office's ability to provide services to students in need."
Jacqueline Kellogg, the student who organized the campaign to file Title IX complaints against Kavanaugh, told the Crimson that using the Title IX process in this manner gives them "power" and legitimizes their "right to our feeling of being safe."
In an email to Reason, Kellogg defended her tactics.
"Using the Title IX process to file formal complaints against known abusers and harassers is exactly what the process is designed to do," wrote Kellogg. "It is not an abuse of process and I am extremely disappointed that Jeannie Suk Gersen and Janet Halley made these comments that may inevitably discourage students from exercising their rights and reporting when it is appropriate."

I'm very interested to see how this turns out in the midterms. From what I've seen, the set that has doubts over Kavanaugh is not mutually exclusive from the set that is absolutely disgusted with the behavior of the Democrats.
I am too. If nothing else, they have given Republican voters a lot of motivation to vote that I don't think they otherwise had. Since we can't live the counterfactual of this not happening, we will never know for sure just how much it effects the midterms. It might not help the Republicans but I have hard time believing it is going to help the Democrats outside of districts they would win anyway.
Good point, but the Dem leadership pushing their ability to ruin someone publicly with zero proof are not, I don't think, in danger of losing their repective elections.
Don't get me wrong, it's possible the Dems do poorly enough the leadership pays attention, but now that they have verifiable proof they can destroy anyone they want, my guess is they will continue to use it.
Additionally note that James Carville himself tried to help Dems learn from their 2000 loss by telling them they sometimes talk down to their opponents.

I doubt seriously the mid-term elections will change that trend.
And again, while I think this is horrible, I think even if Kavanaugh is confirmed the Democratic leadership will still count this as a win and I think any actual downside penalty for them will be miniscule.
The reality is most voters hate every politician except their own.
This too depresses me, but until society decides to make those people doing this pay a price heavy enough to dissuade others from also doing so, the trend will unfortunately continue and likely get worse.

I do wish I were more confident that this will play negatively. I can tell you with some certainty that Feinstein won't be unseated, and I think you're right that generally speaking Democrats in blue states won't really suffer for this. Given how much Trump polarizes people, a lot of people are very likely just going to swallow whatever bile they have and continue to support their chosen Team.
Where I think it may hurt them is not picking up new seats. These days it's crystal clear what partisans think about things and how they're going to vote. What we have less knowledge of is how independents are leaning. It's possible that they'll lose the three current red-state Democrats and not unseat any Republicans, which would be a disaster for the "Blue Wave" that could well get all but the most die-hard defecting from the party.
Not counting on it; prepared for disappointment; but interested to see what happens.
Yeah, I should add I think I may be a little depressed as usually I have faith in humans in general. Things usually get better and it wouldn't completely surprise me that somehow the invisible hand of societal beliefs finds a way to dissuade this to kill its future use.
Some freedoms have gotten better in 20 years, such as gun rights and I doubt that could've been predicted in the late 90s.
But from where I sit, this is just the latest move in a trend of demonizing opponents (it started with smokers I think - it went from legal habit to disgusting, filthy and finally to dangerous even though proof of that assertion does not exist).
I additionally think the underlying trend, where people believe only what the rulers in their group tell them and believe no other sources has been ongoing and getting worse as well.
The reason so many innocent are in jail with such crap evidence is because people no longer believe in innocent until proven guilty.

I think (hope?) we're nearing the end of cycle going back to the 1960s. By the 1980s the "New Left" was so convinced that it was right about everything that they really became like religious fanatics. When the USSR collapsed, it shook a lot of people's faith in socialism, but a lot simply doubled down (like Bernie).
I had social science teachers in the '80s who told us in all seriousness that we were being lied to about conditions in the USSR and that things were actually quite peachy. You couldn't say that anymore in the '90s.
The new wave of "socialism" is a simulacrum of socialism being acted out by a combination of today's youth and the die-hard socialists left over from the '60s. The more shrill they get, the more they alienate people. There used to be "serious" voices on the "hard left," but that's increasingly untrue.

As with Title IX abuses leading to reforms, I would expect (and actually demanded of my senator) reforms in the confirmation process. If anything, I'd be more concerned with an overcorrection as tensions are high and people rarely make the best decisions when their ire is raised.
