14-Year-Old Boy Facing Assault Charge, Sex Offender Registry for Sex with 12-Year-Old Girl

A Houston-area seventh-grade boy has been charged with aggravated sexual assault of a child because he engaged in consensual sex with his sixth-grade girlfriend.
Unless a judge decides to show leniency, he could be forced to register as a sex offender.
That's according to the Houston Chronicle, which redacted the names of both kids. The boy is 14, the girl, 12. Are they too young to be engaged in a sexual relationship? Sure. But what business is it of the state's? Who is well-served by criminalizing this kind of thing? Certainly not the boy, who will face significant difficulties finishing school, getting into college, finding a job, and even just finding a place to live, if he is placed on the sex offender registry.
"The idea that a 14-year-old who has sex with a person just a little bit younger then him or her would be treated as the worst of the worst in our society and placed on the sex offender registry is really sick," the teen's attorney, Joseph Gutheinz, told the Chronicle.
It's as sick as the law is arbitrary. In Texas, teens are immune from prosecution for underage sex if they are within 3 years of age of each other. But this does not apply if either party is over the age of 18, or under the age of 14. If the sexual encounter had taken place two months earlier, before the boy's 14th birthday, it would not have been a crime.
We don't know the whole story: it's certainly possible the boy did something worse, something that merits police intervention. But it doesn't sound like that's the case:
"He had consensual sex with his little girlfriend and he loved her. They were boyfriend-girlfriend," the teen's mother told the Chronicle. "And because he turned 14, they want to make him a sex offender, put him on the registry with pedophiles and child molesters—really sick and dangerous people."
Actually, the sex offender registry is not just for pedophiles and child molesters. Plenty of perfectly non-dangerous individuals—including kids—end up on the registry for the kind of crime this mother's son is accused of committing. It's wrong, and the laws sustaining this sort of moral panic need to change.
In the meantime, maybe Harris County could go easy on Romeo and Juliet.

When I was 14, my friend and I were definitely trying to get laid. He had a gf who was 12 and they did it often. I had one my age and never got there, only making out. Guess she wasn't as horny as the other one. Had to wait for 15 and with another (not as attractive) girl.

When I was 17 I had a gf for most of the year and I would be at her house all the time, hanging out with her parents and everything. We would stay up after her parents would go to sleep and make out, etc. We had been going out for a while and I just assumed that her parents assumed that we had sex. I mean, they would go to sleep and leave us alone all the time. We were always out late, stuff like that. One night after her parents went to sleep I think her dad heard us or something. The next day he flips out on me talking about how I must think he's an idiot and how dare I take advantage of his daughter and the like. He was trying to scare me, but the whole time I'm just perplexed thinking we all understood how it was. Maybe it was some form of pressure to marry. I'll bet that's what it really was. Maybe he thought I would say "But, kind sire. I was planning on asking for your fair daughter's hand." Then she started asking shit like "If I got pregnant, what would you do?" Uh... Thankfully I went off to college and we broke up soon after. Dodged that bullet.
I think if you have a teenage daughter and she's been dating the same teenage guy for more than 2-3 weeks, odds are they're fuckin'. I used to be a teenage boy, so I know how they think: they're not sticking around that long for the brilliant conversation or long walks on the beach or some such horseshit. They're sticking around 'cause your little girl's a freak. But of course, everyone wants to assume that their little girl is a precious, unspoiled virginal flower until the day you walk them down the aisle on their wedding day. Yeah, right.
See, its one of those 'you know, but you don't *know*, you know' sort of deals. Like how someone can 'know' their spouse is cheating, but as long as nothing happens to *force* it to their attention they just . . . don't know.
And as soon as that happens they flip the fuck out because now they have no plausible way to deny knowing and have to deal with something they didn't want to deal with.
Correct - the sex offender registry is not for dangerous pedophiles and rapists --- that place is PRISON. If you are too dangerous to be out in public somewhere, then you should be in fucking prison. A friend's friend is on the list for getting drunk, walking home from a bar, and peeing in a park at 2AM. Seriously.
I don't have kids but I have a 13yo cousin and shit like this makes me paranoid for him. One wrong more and your life is over. Especially when they have smartphones. When one of my nephews was 13 he knocked up a 12 year old girl "She was the only one who would have sex with me" The son turned 12 last fall. He's married with two more, she's single but has an 8 year old daughter.
When I was 19 I was friends with a 17 year old guy who told me he did it with an 11 year old at a beer party. I was dating his 13 year old sister.
The next year, when I was 20, I was dating at 15 year old. I brought her home for dinner and my dad thought she was immature, so he recommended another 15 year old who lived down the street. He also gave me a box of condoms and warned me against bringing home any "mistakes".

High school & college kids hung out together, so that's ages 15 to 21. We were all at home, going to school, maybe had a job. 18 wasn't some bright line - really no line at all.
Not just to kids, put to parents as well. My dad wasn't as concerned about the number as making sure they were mature and generally worth the effort. I only brought the 15 year old home once, but I was at her house all the time. Her parents thought I was a great catch (but she dumped me)

I was painfully shy and feared rejection. My first date was the spring of my senior year in high school. From then until I met the woman I eventually married was 5 years. I was gradually working my way into being able to talk to and occasionally go out with a girl, and a handful of times got to 3rd base. When I met my wife she made clear she wasn't giving it up until marriage, although we messed around some. About a month before we got married we were in a hotel room (we went to another city where I was looking for employment) but she swears to this day that I missed and had it between her legs. I had no previous experience to judge whether she was fibbing to protect her honor.
Point is, as mentioned below, one's 18th birthday or graduation from high school weren't considered to suddenly bestow adulthood on "children." Parents judged the maturity, responsibility and general potential of their children's chosen dating partners. They told us not to have sex while realizing not many would take the advice (or fail so miserably at it)
Kids consensually fooling around with other kids may not always be right but it shouldn't be a crime. And by "kid" I'm thinking anyone who's physically mature, living at home and still in school.
But without lists, how would we know who it is Ok to hate?

You see, in order for the "private vigilantes" to be able to commit an act of force without initiating it, the party upon whom the force is acted must have initiated it. And, as it seems no initiation of force occurred in this case, the "private vigilantes" couldn't do jack.
The state, on the other hand, is almost certainly initiating force here, unless there is more to the story than what we now know.
So what you've attempted to "prove", that "private vigilantes" would initiate force whenever they want has been shown to be untrue, and what you are attempting to defend, the state, is initiating force whenever they want to. So you've committed a failure of the first order.

The idea of sex offender registries was an offshoot of the child porn and pedo scare in the late 1990's. State legislatures jumped on the bandwagon in their eagerness to create a list of pedophiles. But once the lists were created at considerable time and expense, legislators faced strong criticism because the lists were fairly short. Legislators responded by expanding the lists with the names of non-pedophile sex offenders. When the lists still remained fairly short, they expanded them with non-sexual crimes like public nudity and public urination. The legislators in the state of CT even went so far as to propose going back 50 years and adding the names of persons whose prior offenses encompassed the expanded definitions. Only a strong public outcry prevented this from becoming law.
At the same time Legislators began raising the age of consent which in most states ranged from 12-14. This turned young teens into sexual criminals. This is an issue that should be left up to the parents.
They didn't just propose going back years and years.....they DID....I read a story of one guy that was off probation back in like 1972....The man had led an exemplary life since his offense.......then, in the late 90's his name was put on the list w/o even notifying him......his daughter, at that point, a girl around 14 in junior high school....was harassed and himiliated to the point of killing herself!!! IMO, the Legislators are guilty of that gilrs death......

The thing is, "they" are not enforcing the "Laws" and putting nearly enough people that are guilty on the Registries!! The fact is, every female that gets pregnant underage is guilty of a sex offense and the proof is right there is the crib. As a minor, they are not legally capable of "consent." Every underage boy that gets his girlfriend pregnant is also guilty.....they should ALL be registered. This sound crazy?
