Lawsuit: Male Student Accused of Sexual Harassment for Rejecting Gay Advances Commits Suicide After Title IX Verdict
The University of Texas at Arlington's sexual misconduct investigation resembles the Salem witch trials.

"You should consider killing yourself."
That's what Thomas Klocke, a straight male student at the University of Texas at Arlington, allegedly told a gay male classmate after finding out about his sexuality during class on May 19, 2016. The classmate filed a Title IX complaint with the university.
The problem? Klocke denied ever having made such a comment. In his version of the story, the classmate came on to him during class, calling him beautiful. Klocke felt uncomfortable, told the classmate he was straight, and moved to a different seat after the classmate wouldn't stop looking at him.
The classmate might have been worried Klocke would accuse him of sexual harassment, Klocke later guessed, because he immediately filed his own sexual harassment complaint against Klocke. The accuser told university officials that Klocke had called him a "faggot" and threatened to kill him.
Klocke maintained that he did no such thing, but the university sided with the accuser.
Days after discovering that a finding of responsibility could prevent him from getting in to grad school, Klocke committed suicide.
That's according to Watchdog.org's Ashe Schow, who writes that "if every other egregious example of a male student denied due process after being accused of sexual misconduct gets ignored—this one should not be." I suggest reading the full story here.
We will never know who was telling the truth and who was lying, though it's worth noting that in Klocke's version, he's the victim of something approaching harassment—at least according to the Education Department's broad definition of harassment under its revised Title IX guidance. And, as Title IX activists frequently remind the public, we must always believe the victims.
The investigation was biased against Klocke from the start, owing to the unfortunate fact that his accuser was on friendly terms with Associate Vice President of Student Affairs Heather Snow, who assisted the accuser in filing his complaint. Snow did not follow proper procedure, according to a lawsuit filed against the college by Klocke's family: she failed to contact the university's Title IX coordinator, and took charge of the investigation herself. Note the blatant unfairness:
Snow took control of the disciplinary procedure that involved a complaint she wrote herself. She enlisted the help of UTA's associate director of academic integrity, Daniel Moore, and had him tell Klocke he was immediately prohibited from attending the class where the incident was alleged to have occurred. Klocke was completing the course as part of a short, pre-summer semester in order to graduate that summer.
When Klocke was informed that an accusation had been lodged against him, he was not told the name of his accuser. Klocke was also informed that he could not contact anyone in the class, directly or indirectly, effectively denying him any ability to find witnesses to corroborate his story.
His accuser was able to remain in the class and find witnesses. He found only one, who didn't corroborate his account but did say he overheard someone say "you should leave." This could have been said by either Klocke or his accuser in either of their stories.
Klocke received no hearing, even though the university's Title IX policy explicitly mandates hearings for students in danger of being expelled. He was simply charged with making physical threats against a student and engaging in harassment, in violation of Title IX.
Snow conferred with Associate Director of Academic Integrity Daniel Moore, who conceded that there wasn't enough evidence against Klocke, according to the lawsuit. The administrators found him responsible for harassment anyway and placed him on disciplinary probation.
On June 2, 2016, Klocke killed himself. His family is now suing the university for, among other things, violating his Title IX rights.
How much longer must this madness continue? Students accused of sexual misconduct deserve competent legal representation, fair hearings, and the opportunity to confront their accusers. If it cannot be reasonably shown that the accused is likely guilty, he should not be punished.
The original purpose of Title IX was to ensure equality between the sexes in education. In its present day iteration, Title IX is little more than a tool for irate students to exact vengeance on people who offended them. The investigations have now begun to resemble the Salem witch trials in their contempt for principles of basic justice, capacity to destroy innocent lives, and deference to hysteria.
It's long past time for President Trump to appoint a new assistant secretary to head OCR and reverse the previous administration's Title IX guidance. For more on that subject, read Stuart Taylor Jr. in The Wall Street Journal.

I wondered when this story was going to make its appearance here at Hit & Run. It will be interesting to see if, as a straight male student accused of homophobia, in death this young man gets sympathy at any level and the university feels shamed into any amount of introspection of its conduct.

From the article it sounds like Trump hasn't appointed a new assistant secretary to head the OCR yet. I don't think it's a guarantee that whoever is selected will reverse direction, unfortunately. I'm not sure this issue is on the radar enough for Trump to seek out someone who will change direction, so he may just appoint whatever career bureaucrat was next in line at the OCR. Someone like that isn't likely to "rock the boat" and most likely agrees with the old guidance anyway.

This is precisely what made me think about the fall of the Roman Republic above. It's generally understood (if not accepted) by libertarians that the CRA isn't going away. If he had murdered his accuser, that probably would have confirmed in a lot of people's minds that he was guilty of the allegations. Not endorsing suicide, but it definitely made a more striking statement that will now be seen on a much broader level than anything else he could have said or done. If there was a murder/suicide, the accuser would have now been seen as victim of not one but two crimes, generating even more sympathy. As messed up as it is, he flipped the script on the accuser and assumed victim status, and the only silver lining is that this case is getting a second look. Ideally, some form of Title IX reform would follow, but I'm not holding my breath.

I think you're being naive or optimistic. A suicide bomber doesn't walk into a crowd and blow himself up in order to make people think 'OMG, he killed himself!' The attention-getting is only half the message.
Just the allegation did or would pretty much kill his future (to say nothing of the hopes/dreams of the parents/family), so there's already an obliviousness or conviction on one side with regard to ruining lives. It's almost or more like the spread of British Imperialism only from within.
Okay, those are good analogies and you're probably right, but let me try to explain what I was thinking a little better. I don't think he committed suicide with the hope that his friends and family would take up his cause and raise awareness or try to work towards a solution to put an end to this unjust system, and I guess it kind of read of like that. But unless the victim is seriously messed up, when people kill themselves they know it will affect others and open eyes to how bad things were perceived to be. I'm not saying that he did it did it for attention, and as you and the article mention, it was probably mostly grief-related. But my point was, the thought had to have crossed his mind at least once that word of it would spread to his accuser and everyone who was involved with or knew of the case. And I think he knew too that suicide sends a completely different, more sympathetic message than a murder/suicide, so I was just trying to speculate on why he wouldn't have considered it (of course there are more variables, like personality, religious beliefs, etc., but I was just working with the information we were given). This probably still sounds very naive and optimistic to you, and I guess I'm okay with that (been accused of the former but not so much the latter, ha).

Uh, no... you need to read those rules closer. In any dispute between male and female we must believe the female. In any dispute between straight and gay, we must believe the gay person. In any dispute between any two people, we maintain a chart on the wall that shows the relative ranking of marginalized groups. In any event where this does not suffice, we must believe whoever reported first.

Every student in that class is now a witness in an ongoing civil proceeding, and as such can be compelled to give testimony regarding anything they personally witnessed regarding the facts of the case. If the lawsuit is being seriously pursued and makes it into the discovery process, then every student in the class will be looking at at least giving a deposition.

Its amazing how much information can be gleaned from just a simple deposition. Even if the students were not privy to the actual conversation, they might offer testimony that supports or contradicts that of the parties. And its absolutely amazing how much people can remember when they focus...especially when they're in a room with a bunch of lawyers and a court reporter writing down everything you say in exacting detail and theres a potential perjury charge against you if you lie.
Why was the father, as a lawyer, not involved prior to this? When I was practicing law I lived in a university town, and had represented several students who had been brought up on actions before the university's disciplinary council. The disciplinary proceedings were a joke even 10 years ago--a real mockery of any type of fair tribunal. And not just for matters related to progressive bullshit, the whole system was rigged against the accused. BUT once you've had enough of dealing with the university's 'court' system you can drag them into the local circuit court, and the tough acting administrators fold up real quick when they are getting subpoened and having to appear in front of a real judge and they can't control the proceedings or implement their own rules of evidence and procedure. So where was the Dad here? Why was he not raising holy hell when his son was facing this absurd disciplinary action?

And, at least in my experience, it's not like grad students or future grad students aren't known for folding up at the lightest slight of their career or future options. I thought it had long been understood that grad schools are places where grown children avoid dealing with the complexities of real life.

Comparing this modern regime of sexual accusations to the Salem witchcraft (or for that matter the Inquisition) is unfair to the latter. There actually was due process, at least by the poor standards of the day, in the latter. Not only that, but they eventually learned better, and halted the hysteria (or at least the executions resulting from it) by rejecting spectral evidence on the basis of a theological argument raised by Increase Mater (namely, that the devil could appear as anyone, guilty or innocent).
That is an excellent and poorly understood point about those historical events.

What I hate most about sexual harassment complaints and, as an executive I've had to deal with a few, have even been involved directly in a couple, is that it will almost always come down to "he said, she said". Or, in this case, "he said, he said".

Legally, it ought to be pretty simple: if there is no other evidence, the complaint should be dismissed.
Wow. This is awful. Even assuming the guy had said to his accuser, "You should kill yourself", that's fucked up, but it's not a reason to keep a student from attending school. It would be a reason to call him an asshole and avoid him, but not to push a sham hearing affecting his future through to a dubious conclusion. When I was in school, another student told me that I should have killed myself, but she had her own problems (obviously). I'm not sure getting kicked out of school would have helped her any.
Maybe the gay student was the one that was the victim, although assuming that off the bat is irrational. It's getting to be where I think that some people seem to believe that anyone who isn't a straight white male is innocent as a newborn babe, when really such an attitude is condescending, insulting, and ultimately detrimental to minorities.

What's scares me about this is not that universities realize sexual harassment, assault, and rape need to be addressed seriously is that it has morphed into them getting involved in any and all social interactions when there is no real way of verifying what happened. In addition, they are refereeing social interaction as part of a political agenda leaving both sides without adequate justice. In the end it undermines justice for real victims and creates victims in the for of the accused all too often. Neither party is truly served when the system isn't about justice but about airing grievances, using relationships to push agendas, etc. These things are destructive to society and have been observed in radical regimes of the left and the right before.
