Mom: My Son's Daycare Provider Reported Me to CPS. Because of a Birth Mark.
Sheriff said it looked like a handprint.


It's been quite a week for Tamara O'Haire, a cowgirl and online fitness trainer from Bozeman, Montana. O'Haire is a mother to a 9-month-old boy. On Monday, she put him in daycare for the very first time.
On Tuesday, Tammy got a call at work—a cattle feedlot—from Child Protective Services. The agency had to meet with her immediately. She and her husband were suspected of child abuse. The daycare center had called CPS to report a bruise on the baby's chest.
But it wasn't a bruise. It was a birthmark.
According to O'Haire, the daycare—Roots Nature School, which offers "nature-based childcare and preschool"—made no attempt to contact her about the alleged bruise. The school, "went straight to the state, assuming we are beating our child," O'Haire wrote on Facebook.
The daycare provider later told O'Haire that she thought the mark on the child was either a bruise or a rash. But there's a pretty huge difference between a bruise and a rash (although bruises, like rashes are often innocent—kids bump into things).
On her own Facebook page, Roots Director and Lead Teacher Aysha Carter said she stood by her decision to call CPS, though noted it was a tough call.
"If I had to redo it, I would have done the same thing," she wrote. Carter was not immediately available for comment.
Tammy made an appointment for her and her husband to meet with CPS on August 10. But first thing that morning, she took her son to the pediatrician."She examined him—she's been his pediatrician since he was six days old," said O'Haire in an interview. "She confirmed it was a birthmark and not a bruise." The doctor even wrote a note.
What's more, O'Haire has posted Facebook photos of her son every month on his birthday. The birthmark showed up at around five months. She had four time-stamped photos of this "bruise."
At her CPS appointment, they were joined by a sheriff. O'Haire showed them the photos and the doctor's note. The sheriff's response?
"The sheriff told us that he thought the birthmark looked like a handprint," O'Haire recalled.
At that point, says O'Haire, "I was a blubbering mess. I think this is standard protocol—they have to take everything very serious. I've been hearing this, 'If there's any sign of any suspicious marks on any child, it has to be reported to the state.' So that was their rebuttal."
But this approach is comically misguided.
It's like zero tolerance for the Pop Tart chewed into the shape of a gun. The school didn't have to take it seriously, because anyone with two brain cells knows the difference between a weapon and a pastry, just as anyone knows the difference between a confirmed birthmark and a bruise from child abuse.
And yet, O'Haire and her husband must appear before CPS and the sheriff again in three weeks. Until then, their case is open.
The one silver lining, O'Haire said, is this: After she posted about her troubles on Facebook, "a lot of other moms have opened up about their stories. One mom said that she got called into CPS because she missed [her child's] checkup. Another mom shared how one of he children had a similar situation where a birthmark looked like a bruise and she got called in, too. Another woman told me she was involved in a similar situation with CPS. So I'm just happy that I'm spreading the word about this."

These stories illustrate the fact that we must kill off the notion that overreacting to nearly non-existent threats is prudent. As one parent wrote in support of the day care provider on the provider's page, "I would rather see 1 million reports that end up not being an issue than see even one go unreported and lead to serious injury or the death of a child." We have to stop framing the issue like that. If the system is reporting one million unfounded cases, that is a million distraught families. This is not something we have to just shrug off in the name of child safety. We cannot allow hysteria to trigger government involvement.
And finally, if the sheriff has so little to do that he is hallucinating handprints, he needs a furlough. Starting now.

The sheriff, like all cops, believes that reality is whatever he says it is. If he says it is a handprint, then it is a handprint. Doesn't matter what the doctor says. After all, he's got a club and a gun, and faces no consequences for his actions. Argue with him at your own peril.
The best part is how he can be presented with an actual doctor's note confirming that it is a birthmark, and still claim it's a handprint. Because the police academy is just as good as medical school.

All the Police Academies in New York claim they train police recruits to the level of Certified First Responder (the step below EMT). Not that they get certified, just that they're trained.
And to be fair a 2 week training course is like almost exactly the same thing as 4 years of med school and 3+ years of internship/residency.

That is why, if I were that parent, I would have told them to fuck off. And do not talk to them any more or agree to any kind of deal with CPS. Make CPS/sheriff take me to family or criminal court and present their evidence. That doctor's note would be an f'n hammer. Case closed. Parents do not understand their rights and /or fearful to exercise them. Shame on them because they are making it more difficult for other parents.
To cut down on CPS reports, all that has to be done is to not take anonymous reports and the reporter must be identified to the alleged maltreating parent. Reports often come from vindictive ex's and other associates. The lower rent you are the more likely it is to happen.

My sister was born with a winestain birthmark up her stomach and chest. It faded as she grew up, but I could see someone mistaking it for a scalding water burn or something similar. To the best of my knowledge my parents did not torture either of us with scalding water.

My ex wife on several occasions has physically abused our kids and DCF (MA's version of CPS) has decided to hand-wave away the instances; claiming essentially that I'm coaching the kids into leveling false allegations. The contortions they have gone through in the most recent incidents to stick to this narrative have been pretty disheartening. And yes, they ignored my son's bruises.
They are, essentially, modern day witch-smellers. Their investigations are not rigorous. Their investigations aren't objective. One person working with little oversight with way too much on their plate will inevitably conduct subjective investigations. And if the oversight is a superior occasionally reading reports, a supervisor who is steeped in the same institutional culture, whose own subjective biases are well known, the oversight will almost universally be an exercise in confirmation bias.
So, the people they don't like will be declared guilty, and the people they like (or can't be arsed off to go after) will get off scot free with pretty nasty abuse.
If it weren't for the lives ruined by their Type 1 and Type 2 errors, it would be farcical.
I'm certain your children are lovely and happy and the world is better off for having them around, but it's shit like this that ratifies my decision to go childless.

I'm grateful for my kids, and despite all they've been put through - which has left them with some issues that they will likely be dealing with all their lives 🙁 - they're turning out pretty well.
I think deciding not to have kids because of the risk of the world letting them down is not a good decision. Yes, the can be destroyed by the world. But they also could make it a better place. Better yet, there's a very good chance that they will bring a great deal of happiness into your life.
Yesterday, my daughter walked up to me and gave me a big hug and told me I was the world's best dad. It was spontaneous and unexpected. And it brightened my day immeasurably.

And here is why it became a problem. In her fear of CPS, my ex clearly decided to cover up her abusive episodes rather than admit to people who could help her that she was struggling to cope with the more stressful episodes of parenting.
If DCF didn't exist, I think my ex would be much more likely to seek out the help she clearly needs. Her fear that the kids will be taken away from her by DCF has made her do really hurtful things to the kids. She has convinced DCF and the cops to act as if that our kids are out to get her, that they are deceitful, that I'm manipulating the kids to use them as a weapon against her. Do you know how emotionally destructive it is to a kid's emotional development to have him tell a doc that his mother has hit him so hard he passed out, and have his mother taunt him about how no one believes him and if he talks again he is going to be punished?
I am of the opinion that had DCF never been commissioned as an investigator of abuse, our children would be much better off. Hell, if my ex had gotten the help she needed instead of trying to hide she had a problem, *everyone* would have been better off.

If nothing else, she needs to be thinking down the road about what could happen when he becomes bigger and stronger than her. Fear of the law might not be enough to prevent some pretty serious retaliation. However, I understand that if she had that kind of low-time preference thinking and wasn't a piece of shit, she wouldn't be beating her kids in the first place.

No, it is not. Because the real and serious cases will not typically go away on their own. And when it escalates to the point of family court being involved it takes on a whole new dimension. The family court judge and the law guardian will be looking at the history and will often be all too happy to ream DCF/CPS for any errors in judgment.

No. Actually they can be easier. Once there is evidence the children have been abused the worker files a petition with the family court. This is typically done when the parent refuses services or fails to follow through with safety planning. You see, that is the leverage the agency has into getting parents to cooperate with the safety plan and engage in recommended services so as to not take them to court. No moral caseworker wants a case to blow up because of their failures. Condensed version.

I call BS. Nothing prevented her from getting help. She did not have to disclose it to DCF and they would not have known. If they helped her get counseling than they would have insisted/expected her to follow through. CPS does not want to break up families willy nilly because it is hard on children. She sounds like a mental case. Did you knowingly make kids with a mental case? "Her fear that the kids will be taken away from her by DCF has made her do really hurtful things to the kids." That does not make sense and would appear that she does not really want the children but just thinks she will look like a POS if she does not.
What did you do to ease the stress? Did you involve her family? Take her to court and a law guardian will be appointed for the kids. The guardian will meet with your kids and hopefully appropriately advocate for them. Good luck and stop making excuses for her.

Next time take them to their doctor (mandated reporter) when they have marks. Your kids must not have been very consistent and/or believable. You do not mention their ages. The threshold for indicating a parent is pretty low. Your children's lives are ruined already? That is a shame.
Would you prefer the bias lean toward finding abuse when there is none or not find abuse when there may be some? I much prefer the former. Supervisors read all of the reports before they can be closed.
You know you could always go to court and file a petition for custody unless of course something about your past...like you are douchebag or still a man... might make that a waste of time. These are just some of the problems created by broken homes. Take responsibility for that.
We adopted children from China and our vary smart family doctor advised us that Chinese children when very young have skin discolorations that to the untrained eye look like bruises. They're called Mongolian spots. He told us this in case we faced a similar erroneous charge.
They also come and go. Our neighbors adopted two girls after their youngest hit High School. Both blotched a lot over the next year and part was allergies. Fortunately, he is a Dr, they avoided some of the risks, but got accosted at Disneyland. The Mouse was concerned, but educatable. They got VIP passes the rest of their stay.
I think the failure in assumptions here is that a visit from CPS and the resulting consequences aren't themselves harmful to the child.
Its one thing to claim these events are harmless, and to overreact because it is also harmless.

These are complex systems which can be fixed. Eliminating them is almost never on the table.
I think getting roughed up by the bureaucratic state leads some to think maybe the government should leave people alone a bit more. Such folks don't get a lot of press or many outlets for voicing their opinions, nor are they encouraged to do so.

My best friend, who like this women lives in MT, was reported to CPS. The reason given, when the nurse showed him how to change a diaper he took a little too long to complete it.
A different nurse told him that is not unusual these days. Since the laws are written to equate failure to report suspicion of child abuse, with child abuse itself, many professionals have taken the attitude of report everyone you have contact with for what ever possible reason you can dream up and let CPS sort it all out. That way if anyone comes asking they can point to having filed a report, and thus they protect their careers and livelihood.
The result of the complaint, he had 6 months of visits from CPS, who in that time never found any issues. I have to imagine CPS is so flooded with these false reports that it actually puts kids at greater risk, rather than stopping the 1 in a million case. It's easier for an actual abuse case to get swept under the rug with the other million crying wolf false reports than to be found and stop a real tragedy.
I would not be surprised if this daycare is simply involved in the same CYA tactic.

This is exactly why laws like this are simply awful. They put people in a position where they have to choose between losing their licenses and careers, and possibly their liberty, or turning someone else's life upside down. Take one guess how most people would choose in that circumstance.
Worse yet, many of these laws provide the party making the report with full immunity from liability to the person they report. So you have nothing to lose, and everything to gain, by reporting someone.

"Any suspicious mark" is not the same as actual knowledge or reasonable cause to suspect. We have basically the same reporting requirement in AZ (and TX). It is not mandate to report every owie a kid may get as they blunder through childhood.

Ya know what I don't get? This whole expectation that children blunder through growing up. FFS, I have more injuries of unknown origin at my age now than either of my kids (and I think my youngest has real challenges due to the top heavy mass of his noggin). I will be walking around the house and look down and see blood on the carpet or chair or something, and always my first thought is "where am I bleeding and when did THAT happen".
I know they look (and are really) unstable but ill be damned if either of my kids has more bruises or cuts than I do at any given time.
My top heavy kid would fall out of the bath-tub or out of his crib. How do you keep yours upright?

Don't blame the school. Blame the state law which makes everyone in the school a "mandated reporter," meaning that it's a criminal offense not to run to the authorities every time they suspect abuse. (And note that the law requires reporting if they "suspect," not "reasonably suspect," abuse. The omission of the word "reasonably" is not an oversight.) Calling the parents would be a waste of time, because the teacher can't rely on what a parent said to negate suspicion.
I see R.C. Dean has quoted the Montana law which appears to require "reasonable cause to suspect," rather than simply "suspicion." All I can say in my defense is that that differs from every child-abuse-and-neglect-prevention training course I've taken. (And unfortunately I've been required to take a bunch, because I *might* deal with children in some of my volunteer activities.)
With an ED and a primary care group, I periodically get asked if something is reportable. We never go with the bare "see something say something" bullshit. There has to be some "reason" to "suspect" child abuse.
A bruise is just a bruise. Hell, a broken bone is just a broken bone. Neither is necessarily, or even generally, the result of abuse, and as such, on their own, they do not trigger mandatory reports. You look for patterns, other behaviors, etc.
Unless you're a brainless twat running a daycare, apparently. God help her if anybody gets a bruise while in her care.
True story: back when the Mormon fundies got all their kids taken by the state in Texas several years ago, some of my docs were signed up as expert witnesses for the state. They were asked about the health of the kids that were taken, and especially the ones that showed they had broken bones that had healed.
They said they were some of the healthiest kids they had ever seen - excellent diet (mostly grown organically on the ranch), lots of exercise, etc. As for the broken bones a few of the kids had, they said "They are growing up on a ranch. It happens."
That's the difference between ""any suspicious mark" and "reason to suspect" in a nutshell. And the idiot sheriff missed it by a mile.
Regretably, one does not have to demonstrate posession of a working brain to run for elective office.
Lesson learned - never use a daycare with the words "nature-based" in its description. Thank goodness the family didn't send their child to the "gluten-free" daycare, the sheriff might have been obligated to shoot the parents.

Another case of hyper retardation over whelming common sense. I can speak with some experience on the matter and we've had some discussions with a couple of kids over the years. I can tell you the educators take serious and careful consideration before ever recommending our version of CPS knowing full well the implication it entails. We keep a watchful eye on stuff; sometimes we're accurate, sometimes not. It never led us to calling social services. It's in the latter case we see why it's necessary to be vigilant and apply common sense. In any event, once you get to know the parents that goes a long way into understanding things.
From what I read and conclude, I don't blame the Daycare provider--she was just doing due diligence. I do think CPS and the sheriff were out of line, and once the Dr.'s evidence was provided, it should have been dropped.

She should have had The State adopt the child and place him into a State sponsored orphanage where he can be indoctrinated into the wise and beneficent policies demanded by our ruling elitist filth so he will be a part of being the new Soviet man by the time he reaches adulthood. Plus, The State is already a nanny to us all wagging its finger whenever we do not breathe in accordance to The Breathing Regulations set forth by The State. i don't have a problem with saying they have to report any close calls, but the facebook photos and pediatricians statement is exactly the reason you pick up the phone first.
it's getting to the point, and may be passed the point, where you have to take naked photos of every part of your child's body and submit them in advance to the state so they know what marks were there already. like some lawyers will do for clients in case they're roughed up by the police.
of course, if you did that, you'd be accused of being a pedophile.
So, in two correlated stories this week, we have a family being harassed by police and CPS for a confirmed birthmark, and a 7 year old wandering the street trying to sell his teddy bear for money to buy food because he says he hasn't eaten in two days. When the police showed up and the latter's home, filled with trash, cat urine, and liquor bottles. I'm going to go out on a limb and say we may need to rethink the way we are going about protecting children. Even if the former WAS a bruise and not a birthmark, there is still a grey area (I was whopped with a switch (and many other things) like Adrian Peterson's son, and I don't think I was abused or mistreated, and turned out kinda okay), but living in squalor and starving while parents booze it up is unacceptable.
This, in a nutshell, is why I object to the entire idea of CPS. If parents meglect or abuse a child, that's a tragedy. When the State abuses parents, that is being done IN MY NAME, dammit.

Many years ago we pulled our infant daughter out of a daycare because we had good reason the believe the care she was receiving was inadequate. Two days later we got a call from DCS to schedule a visit due to an anonymous report of child abuse. The caller alleged we would frequently leave our infant in the car in the driveway while we were inside getting high. (FYI never happened!)
Because the call was anonymous we could not prove it was the former daycare provider, but we knew full well that it was. We had to suffer the intrusion into our lives and there was nothing we could do about it.
Don't we have a right to face our accuser?

It also means that CPS and law enforcement are kept busy clearing the easy cases with people who readily submit to their authority instead of hard cases of real child abuse/neglect that are difficult to prove and involve people who are unpleasant and uncooperative. Investigating and dealing with the hard cases is really hard work. Emphasis on the hard cases might even hurt the numbers that are used to evaluate the performance of CPS.
Except for Gary Johnson, maybe, libertarians seem to never consider the well-being of our wonderful public servants.

Our pediatrician reported us to CPS after my son got ring worm that covered his one of his butt cheeks. It was a complete disaster. The CPS worker envisioned hand prints and belt buckle marks in his ring worm...it's funny now, but one of it was the scariest moments of my life.
I suggest never comply and head STRAIGHT to a competent attorney. Even if you have to miss a car payment or go without a cell phone....hire an attorney right away. CPS lies and fabricates and will try to get your kids away or force you into parenting classes.
