And on another note about academia and practical law, I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation (across the centuries?well, just a little more than two centuries, and of course less for many of the amendments). Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century. Which means that the original Constitution, the Bill of Rights, and the post?Civil War amendments (including the 14th), do not speak to today. David Strauss is right: The Supreme Court treats the Constitution like it is authorizing the court to create a common law of constitutional law, based on current concerns, not what those 18th-century guys were worrying about.
In short, let's not let the dead bury the living.

I used to really like Posner but he has really turned into a horrible judge. You can sum up the entire quoted paragraph into the single phrase "the constitution means whatever we judges decide it means." How someone of Posner's obvious intellect could be so drunk with power and lack humility to such a degree they could endorse such an idea is beyond me.
In the end, the Constitution is nothing but a law. I would love to ask Posner why this logic doesn't apply to every other law in the land, such that they only mean what judges say they mean not what drafters and legislatures meant them to mean. Then I would like to hear how Posner squares that contention with any reasonable commitment to the rule of law rather than the rule of man.

I'll say "Shall make no law" is pretty clear, and I don't see any subordinate clause reading "except if it is really important." I think the larger point was the left's rejoinder to complaints about using the no-fly list as an obvious and simple gun-control measure. Folks worried aloud that people can be placed on the no-fly list for any sort of reason, or by mistake....
The response was, there are methods for dealing with that....
So this story tells us that getting off of the no-fly list would run you about $4 million bucks, if the government didn't just say "oops, sorry" and take you off the list for the asking.
But yea, no undue burden....

Crafting an expert defense of why due process is necessary just isn't as effective against someone on the Left as tying that person to racism is. If we take advantage of their aversion to racism, we can win.
