CIA arms destined for Syrian moderates 'get stolen, emerge on black market'

Following the delivery to Jordan, the CIA used General Intelligence Directorate officers to transport the weapons to the Syrian rebels where they disappeared midway.

Jordanian officials told the publications that the theft was apparently perpetrated by officers with direct access to cargo, who "regularly siphoned truckloads" of the weapons while still delivering some to designated drop-offs.

And on another note about academia and practical law, I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation (across the centuries?well, just a little more than two centuries, and of course less for many of the amendments). Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century. Which means that the original Constitution, the Bill of Rights, and the post?Civil War amendments (including the 14th), do not speak to today. David Strauss is right: The Supreme Court treats the Constitution like it is authorizing the court to create a common law of constitutional law, based on current concerns, not what those 18th-century guys were worrying about.

In short, let's not let the dead bury the living.

You can sum up the entire quoted paragraph into the single phrase "the constitution means whatever we judges decide it means." How someone of Posner's obvious intellect could be so drunk with power and lack humility to such a degree they could endorse such an idea is beyond me.

In the end, the Constitution is nothing but a law. I would love to ask Posner why this logic doesn't apply to every other law in the land, such that they only mean what judges say they mean not what drafters and legislatures meant them to mean. Then I would like to hear how Posner squares that contention with any reasonable commitment to the rule of law rather than the rule of man.
