Brickbat: A Finger on the Problem


A Kenyan court has upheld the use of anal exams to determine a person's sexual orientation. "I find no violation of human dignity, right to privacy and right to freedom of the petitioners," said Judge Mathew Emukule. Two men charged with engaging in gay sex say the anal examinations and testing for HIV and hepatitis B they were forced to undergo amounted to torture and degrading treatment.

It's amazing how brazen the statement is. Just say "petition denied" and move the fuck on. But no, they've got to tell bald-faced lies. If the judge finds no violation of human dignity, did he bow down and have the bailiff* give him an anal exam to prove the point?

It's a common law system, to set precedent, you need the explaination. A mere denial doesn't create as strong a precedent as stating "there was nothing wrong with what the government did".
If that qualifies as an explanation, they must have different dictionaries in Kenya, because I don't see how it "explains" anything. You're probably right, but that doesn't change the absurdity of it. Whether he says such utter bullshit because he hates homosexuals or because he loves the government is irrelevant.

Hmm, it is somewhat notable that this happened in Mombasa, one of the few places in Kenya that's majority Muslim. Don't know about the judge, but Islam isn't big on "human dignity".
