The judge is clearly thinking about this from a purely political perspective. There is zero chance this survives under the plain reading of the Protection of Lawful Commerce Act.
Considering that Adam Lanza stole the weapons he used, I don't think the defendants marketed their weapons at him.

I don't see how it's unclear that there was an unwanted touching (battery). The only reason she pressed charges was that the Trump campaign denied it happened and said she made it up for publicity.

Any judge that engages in a plain reading of the PLCA would've thrown this out. Criminal misuse of a product does not create liability for the manufacturer of an otherwise legal product in commerce. A higher court should toss this out, preferably heavy on the "fuck you" dicta to the trial judge.
