Despite What Her Campaign Wants You to Believe, There Were Top Secret Emails on Hillary Clinton's Homebrew Server

Hillary Clinton's campaign has repeatedly pushed back on the idea that any of the emails she sent using her personal email system while serving as Secretary of State were classified top secret.
Back in November, for example, campaign spokesperson Brian Fallon tweeted out a link to a Politico report suggesting that early findings that some of her emails contained highly classified material were wrong. Maybe Fallon was just sharing, not endorsing, and the exclamation points he included in his tweet were just there to demonstrate his surprise at the story.
In any case, it turns out that the report was wrong, and Clinton did indeed send at least 22 emails classified as top secret, according to an Associated Press report this afternoon.
These emails were classified as "special access programs," according to Politico, which means they were compartmentalized within the top secret designation; even top secret clearance wouldn't necessarily be enough to get someone access to these communications.
The State Department has slowly making Clinton's emails public over the last few months, following a court order, but not complying with it fully: A federal judge had ordered the emails to be completely released by the end of today, but instead, only about 1,000 of the 9,000 remaining pages of email will be released later tonight.
So far, about 1,300 of Clinton's emails have been labeled classified at some level. Today was the first time, however, that any had been confirmed to be classified top secret. So far, classified emails have been redacted for release. The top secret emails revealed today won't be released in any way; they'll simply be withheld.
On the campaign trail, both Clinton and her team have sought to downplay the importance of the issue and her responsibility for the matter.
"I did not send classified material, and I did not receive any material that was marked or designated classified," Clinton said. Fallon, her communications aide, has defended Clinton by saying she "was, at worst, the passive recipient of unwitting information that subsequently became deemed as classified."
That remains to be seen. As the Associated Press reports today, the State Department "wouldn't disclose if any of the documents reflected information that was classified at the time of transmission, but indicated that the agency's Diplomatic Security and Intelligence and Research bureaus have begun looking into that question."
And whether or not the emails were marked as classified is not the entire issue. As a Reuters report noted in August, "the government's standard nondisclosure agreement warns people authorized to handle classified information that it may not be marked that way and that it may come in oral form."
Previous reports have suggested that Clinton's emails contained top secret information, based on information from the inspector general for the intelligence community. But up until now, as The Washington Post notes, the State Department had not agreed that any of the emails should be classified as top secret, and her campaign had relied on the difference to suggest that the classification of her emails was largely a dispute between agencies.
What continues to be most revealing about this story is not the particular contents of any of the emails, but the way that Clinton and her team have handled it.
At virtually every turn, she and her campaign staffers have misled and dissembled, repeatedly making statements that later turn out to be false. In general, her attitude is one of disdain and dismissiveness, as if transparency and truthfulness about her unorthodox decision to conduct her State Department email business exclusively on a homebrew email server was unnecessary, or beneath her. She has displayed both a willful disregard for the truth and as a generalized resistance to public scrutiny and oversight. And that may tell us more about her, and what kind of president she might be, than any email she's sent.

But if you copy and paste classified documents into Outlook, is it still classified? Nobody really knows.
They do, actually. What computer is outlook on?
Whatever computer is now running more slowly.
This one.
Still gets a B rating, though.
RC4 and weak DH support, including a common DH prime, so it's vulnerable to decryption by a nation-state actor.
No. That turns it into Nutella.
Let's recap, shall we?
Hillary Rodham Clinton, former 1st lady, junior Senator from NY and then, Sec of State has decades of govt service. And yet, she deliberately eschewed the government email system and government issued Blackberry for her own home-brewed convenience.
Now, does it make sense that the Secretary of State would never, ever receive or send confidential - nay, top secret - emails in her entire tenure? The person 5th in the line of succession would never get or send secret info?
Really?
It boggles the mind
following a court order, but not complying with it fully
What happens to little people when they don't fully comply with court orders?
A federal judge had ordered the emails to be completely released by the end of today, but instead, only about 1,000 of the 9,000 remaining pages of email will be released later tonight
I'm assuming John Kerry will be jailed until he complies, right?
Generally for little people not fully complying is identical to not following
She is going down.
Not on Bill, though.
More likely on Huma
Post of the month.
So what is the current relationship like between the highest level career bureaucrats and their elected/appointed superiors? How will they take it if Clinton suffers no consequences for her actions? It's a serious breach of trust to be casually handling information that may have taken a lot of time and resources to obtain.
They most likely are all Democrats.
yeah this is gonna be "old news" by tomorrow. what gets you people so wrapped up in email?
What difference at this point does it make?
She was only Secretary of State, she couldn't be expected to know that she would be receiving classified information on a regular basis as part of her job.
Geez. Let it go already.
Months ago, I tried to imagine what types of emails or texts, at the top of the state department, wouldn't be classified--- Lunch orders which don't indicate restaurant, location, or attendees... ... ... That's about it.
"What continues to be most revealing about this story is not the particular contents of any of the emails, but the way that Clinton and her team have handled it."
Hahaha. This whole story is just a witch hunt. Instead of "I saw her casting spells and conjuring demons and don't believe her denials" it's "I saw her entering codes and reading about drones and her denials prove it."
You nailed it, bud. She is being framed.
So to you, email is witchcraft. Yell at that cloud!
I agree she is a witch. Good job cunt-bot, keep up the good work on trying to persuade the peeps on how she is the best.
You can polish a turd all you want, it's still a turd.
You misspelled 'emails'.
Hey now. He's got an addiction. Paint thinner, if I had to guess.
Clearly Drano, all the symptoms are evident.
This is what Democrats actually believe.
Excuses/rationalizations I've actually seen written in articles and on comment threads:
1. She knew what she was doing but she's smart and we should just trust her judgement.
2. She's old and doesn't understand technology, these were just honest mistakes.
3. Her home server was way more secure than the obsolete crap that the state department uses anyway.
4. Republicans are violating national security by probing into classified information here and should be tried for espionage/treason.
5. She doesn't owe anyone any explanations anyway, so just leave her alone.
6. Everyone does this, and it's no big deal.
7. There's no evidence she did anything wrong and this is being blown out of proportion; even Bernie agrees.
8. The FBI is run by the Republicans and are conducting a partisan witch hunt.
9. The FBI is not actually investigating Hillary at all; only crazy right-wingers believe that.
10. The FBI investigated and cleared her of all wrongdoing a long time ago.
She wants us to believe the unbelievable - that she didn't get or send confidential info and she didn't use her bathroom server to deceive but because it was easier.
Hey Tulpa.
This cretin was around earlier in the week; same misdirection, same lies.
I understand it's a ''vast right-wing conspiracy.''
This whole story is just a witch hunt.
I'm not going to gainsay your description of Hillary as a witch, but this story is about thousands of felonies. She's a criminal, and all of your sniveling won't change that.

Tony's back from rehab.
Hey, are you the same Addictionmyth that used to troll Protein Wisdom?
Well, I suppose that, when given defending a shit sandwich or a piss sandwich, this is the best you can do.
The facts are, however, she's using you.
She freely chose to eschew govt email on a govt server and using a govt blackberry. Why? Because she didn't want an audit trail.
She didn't want to be questioned.
been her M.O. for 25+ years
and... she keeps getting promoted, and even occasionally voted for. damn are we dumb
I'm not quite up to speed on the facts about the Clinton e-mail situation.
Does she acknowledge that ALL her State Dept. e-mail communication went through her private server?
Does she claim zero of those e-mails contained or related to any secret, sensitive or confidential matters that foreign governments should not have been allowed to seef?
So, does that mean that during her entire time as U.S. Secretary of State there was not one confidential or secret matter that Clinton dealt with by e-mail?
If so, what the heck did she deal with in 50,000 e-mails and why do we need a Secretary of State is he or she is
not in the communication loop about secret, sensitive or confidential diplomatic activities?
Yes
Yes
...
Shut up you're just a misogynist Kochsucker continuing the rethuglikkkan war on womyn
Yup, that's the size of it. Essentially her defense at this point is that she's ignorant. She didn't know how that darn server thing actually works. She didn't know that mis-handling classified docs is a crime. She didn't know that some information is born classified. She didn't know that she might (probably) will get hacked. She didn't know that she might be putting confidential sources in mortal danger.
Problem here, "ignorance of the law is not an excuse of the law."
The scary part is that this isn't the worst thing she did as SOS.
...and besides, what difference,...at this point,...does it really make?
It's not like people died so she and her friends could get rich.
Standard Form 312 (which the author alludes to, but didn't provide a link)
Google "Standard Form 312"
1. Intending to be legally bound, I hereby accept the obligations contained in this Agreement in consideration of my being granted access to classified information. As used in this Agreement, classified information is marked or unmarked classified information, including oral communications, that is classified under the standards of Executive Order 13526, or under any other Executive order or statute that prohibits the unauthorized disclosure of information in the interest of national security; and unclassified information that meets the standards for classification and is in the process of a classification determination as provided in sections 1.1, 1.2, 1.3 and 1.4(e) of Executive Order 13526, or under any other Executive order or statute that requires protection for such information in the interest of national security. I understand and accept that by being granted access to classified information, special confidence and trust shall be placed in me by the United States Government
or, just do what's best for her personal convenience
Hey, how can she be expected to know what all that lawyer talk means ?!?!?
Yeah, no kidding, it's not like she has a law degree and has spent three decades at the highest levels of either a state or Federal government.
Oh, wait...
Don't forget 18 USC 793 (f) - she has clearly violated this and note the penalties in the last line.
(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer?
Shall be fined under this title or imprisoned not more than ten years, or both.
And she is right!
/hands creech a cloth to wipe case of 386
Yeah, that last one is the big one... how does she expect anyone to honestly believe that as secretary of state, handling classified information wasn't part of the daily job?
I don't think her supporters even believe that. They're happy to make excuses of course, but there cannot be anyone who looks objectively at the situation and buys it.
I'm assuming that there were a lot of cat pictures and e-mails from Nigerian's that just inherited a lot of money.
"s if transparency and truthfulness about her unorthodox illegal decision to conduct her State Department email business exclusively on a homebrew email server was unnecessary"
FTFY
And whether or not the emails were marked as classified is not the entire issue.
Its actually irrelevant, except for the additional offense of removing the markings.
at her direction no less. I really wonder what special system she set up for Huma to cut and paste classified info, sans markings, into an unclassified network. I mean, this wasn't a one-off thing, it was their standard MO. There's no way Hillary's surrogates were constantly sneaking hard copies or thumb drives out of a SCIF.
You sure about that ?
I wonder if the special system was code-named 'Butters'. After all, she only wanted to edit out the ones that made fun of her weight or said bad things about the Clinton Foundation. Is it a crime to need a safe space?
items, plans , emails etc do not become top secret after the fact. they either start out top secret or they are open because after the fact is like locking the gate after the chickens are gone.
read my comment above containing the text of the first paragraph of SF-312, the non-disclosure agreement
It is pretty pathetic on hillarys part. She broke the law any which way you slice it. Ignorance is ill relevant, except if you are running president it appears.
In once recently released email to Jake, she instructed him to strip off the markings and send a document unclassified. That's not ignorance - she gave him specific instructions on how to break the law and try to not get caught.
Oh, I agree, but her excuse is ignorance, which is still a violation of the law, so she is responsible either way.
her excuse is easily disproved
If her excuse is "ignorance" she couldn't be more right...
that along with arrogance.
Hillary Nixon--er Hillary Clinton, refuses to resign except as a last resort.
"We have to go after Bernie Sanders like, NOW"
That would be my advice to Clinton, if I was working for her.
"Bill tried to cheer Hillary up this morning by reminding her that Nelson Mandela wasn't elected president until after he served 27 years in prison."
- my awesome brother in law
The Clinton strategy is, in general, a winner:
"It's not news"
"It's not news"
"It's not news"
"It's old news"
indeed. by now it IS old news, except to people who honestly believed her, who likely are the ones crying "old news". weird.
Most of the time documents don't "become" classified, they are classified from the git-go. There are cocktail napkins locked up in the vaults at Los Alamos Labs.
I had a dispute with the DOE over something much more trivial than classified data and I am willing to give the Hilldebeast the same generous benefit of the doubt that they gave me. IOW, none whatsoever.
Burn in hell, bitch.

To whom??
I work with classified everyday and this is the part that baffles me. The emails couldn't have arrived in her inbox (they would have had to been copied over on some sort of media) since the server can't connect to classified networks, and if they were sent they would have been sent to unclas addresses since, again her server couldn't have connected to a network. And any recipient beyond her inner circle would have been like, "wtf is this?? Now I gotta call the security guy since I have classified on my machine"
I just don't get the utility of classified info on an unclass network, private or not.
her convenience (and evading oversight)
Exactly. I work with SIPR shit, the people protecting Hillary don't understand how this works. The law was broken the second any data from the secret side was moved onto an unsecured server, or duplicated onto another media device without following the proper protocols. Unless the State Dept's security is a total disaster.....which I'm betting it probably is, they should already know who took what and when, as the copying should have been logged.
My office does contract work for DoD in geospatial analysis. People could not take their cell phones into the secure room, they were in a bin on the wall outside the door. They could not bring a thumb drive out of the room. Any PC had to have their hard drives removed before coming out into the general production area. There are signs on the doors reminding us that carrying any classified material, electronic, paper, etc, out of the building is a felony.
That's because your doing it the correct way. If you didn't you would at the minimum lose your access and if it was egregious you could face criminal penalty.
Which only begs the question of how she has been permitted to destroy her server's logs.
Those logs providing evidence of all sorts of criminal involvement.
Much like the IRS/Lois Lerner "investigation" this has never really been about punishing the actual crimes.
Because once you've gotten high enough in the permanent ruling class you are effectively the new nobility and immune from petty laws.
How many hard drives under subpoena has the IRS accidentally wiped?
My guess is that the emails involve informal conversations about ongoing State Department programs. Rationally, even informal conversations might be "classified" if they pertain to classified subject matter, but they can certainly originate on, and be transmitted via, unsecured systems. You aren't supposed to do it, but I'm sure it happens.
So I doubt anyone explicitly copied classified data from a secure system to an unsecured one. It was probably more a matter of someone asking questions or carrying on a discussion about a classified subject via unsecured email.
So, enough of the obvious.
The question is no longer did Clinton violate NatSec?
The only real question is: So what peasants?
The thing is, these are the emails her staff passed through to be reviewed. These are the accidental leaks. Here's how this happens. Staff member attends a briefing, puts some of the contents in an email to SoS and staff. Oops, some of that information is classified. The email won't be marked as classified and it was likely an honest mistake. Oops, sorry, it won't happen again. Political tango. Illegal, yes, no intent though, so to a progressive mind that means they did nothing wrong.
The real problem lies in the emails they tried to hide. What is in there?
Nonsense that plays directly toward Clinton's game - ever erecting a new set of goalposts.
The known facts establish she committed acts that would already land anyone else in Federal criminal court.
Anyone else not supported by DNC.
I want to see more email data on the war she helped create to bring in Osprey Global.
Sometimes dude you jsut have to roll with it.

It's going to work this time! Did I say that first?
Wait a minute... this isn't... oh never mind.
why don't you tell the truth. the the white house spokes person said the Emails WERE NOT marked classified at the time they were sent out. were on a UNCLASSIFIED server when she sent them out they are going threw the process of classifying them now. they are not sure what agencies are calling for them to be classified. and there is some disagreement between agencies weather they should be classified or not. and I was watching the spokespersons full statement as he made his statements. So tell the truth instead of twisting the facts. LYERS!!!!!!!!!!!!
http://www.msnbc.com/kate-snow.....1738179525
Did you just cite MSNBC while calling us liars. Yes, that's the correct spelling.
The data, not the email is what is classified. Certain types of data is born classified. In her position as SoS she would have necessarily received training on this. Furthermore, the data does not have to be marked classified for the crime in question to take place. Read, the info is there if you get away from the propaganda sites.
OK, who's playing the prank on this one?
DON'T LIKE LYERS|1.29.16 @ 9:30PM|#
"why don't you tell the truth."
Uh, it is the truth, imbecile.
"the the white house spokes person said the Emails WERE NOT marked classified at the time they were sent out. were on a UNCLASSIFIED server when she sent them out they are going threw the process of classifying them now. and there is some disagreement between agencies weather they should be classified or not."
You (and that spokes person) are either lying or ignorant; see above, 6:59. Documents are not classified *after* they are generated, they are so from the start.
"and I was watching the spokespersons full statement as he made his statements. So tell the truth instead of twisting the facts."
Oh, well, if that lying piece of shit in the WH says so, you can automatically presume it's a blatant lie. That SOB has never said a word that *wasn't* a lie, but ass-lickers like you keep sucking it up.
"LYERS!!!!!!!!!!!!"

Not enough eleventies either.

that's pretty obviously a teenager, hence the orthographical excellence. i can't tell if it's pissed at it's conservative parents and thinks it's being rebellious (supporting someone who's been in government for 30 years is not terribly rebellious, by the way) or just passively accepting everything it's liberal parents say. smart either way
I lol
never dawned on her that using an unclassified server in the first place was a bad idea? She was only the SoS. The chance of a classified email being involved was the same as a rooster seeing a sunrise.
Eh, D+ troll, didn't even call anyone a misogynist.
the white house spokes person said the Emails WERE NOT marked classified at the time they were sent out.
From the SF 312 that every government employee with a clearance has to sign:
"As used in this Agreement, classified information is marked or unmarked classified information, including oral communications, that is classified under the standards of Executive Order 13526, or under any other Executive order or statute that prohibits the unauthorized disclosure of information in the interest of national security; and unclassified information that meets the standards for classification and is in the process of a classification determination as provided in sections 1.1, 1.2, 1.3 and 1.4(e) of Executive Order 13526, or under any other Executive order or statute that requires protection for such information in the interest of national security."
Checkmate, bitch.
Well, since Hillary already deleted an unknown number of E-mails before even handing over the data to authorities, it stands to reason that she deleted any E-mails that were explicitly marked as "classified". That's why we only see those not explicitly marked classified that contain classified material nonetheless.
Hillary would be guilty of mishandling classified E-mails even if all investigators found at this point were love letters to Huma.

"US declares 22 Clinton emails 'top secret'"
[...]
"The Obama administration confirmed for the first time Friday that Hillary Clinton's unsecured home server contained closely guarded government secrets, censoring 22 emails with material requiring one of the highest levels of classification."

I wonder where the FBI investigation is on exactly how the info made it from the isolated, air-gapped secure systems and into the non-secure systems. My understanding is that cannot happen accidentally, that somebody has to copy it and walk it out.
If they can crack that question, then they have a real, undeniable criminal conspiracy, and the leverage to roll the small fish to work up to the big fish.
Given that there is literally no legal way for the top secret stuff to get onto Hillary's system, and there had to have been a shitload of it, since that was her only way to review a lot of stuff that she had to have seen in order to even pretend to be SecState, I suspect that a fair number of people knew or participated in this. There should be a number of people who either go to jail, or turn state's evidence.
I suspect that's the gist of it. She was only pretending to be SoS. She had her aides doing all the work and only occasionally forwarding information to her while she globe-trotted around the world raising money for the Clinton Foundation. At least, that's the explanation that is the LEAST bad for her.
Reason: "She has displayed both a willful disregard for the truth and as a generalized resistance to public scrutiny and oversight."
Hillary wasn't using a private server to thwart future historians and curious Media, she was using a private server because she knew she couldn't run her ongong criminal enterprise, pay to play, soliciting bribes and kickbacks in return for favors and contracts from the State Department, and laundering the money through her phony charity using a government server.
No matter how careful she was never to give anyone more than a 'nudge, nudge, wink, wink' in writing someone was sure to email to say they'd made the donation to the Clinton Foundation, when could they expect to receive their contract, or they'd received the first payment on their contract and were donating the agreed upon 10% to the Foundation. Hillary needed to be able to clean up the record and she couldn't do that if some beadle at State was backing up her email files.
Personally, I think you're attributing far more sophistication to her thinking than is warranted.
I'm guessing it was simply 'I want control over this', with the added benes (to her) as coincidental gains. I do not believe that woman is nearly as smart as is often presumed; she's merely a petty, vindictive shit who hopes to control her entire public image.
The only plausible explanation for her keeping her own email server is that she was dealing with information she didn't want in the public record - ever. But, amazingly, she *could* have had two separate email accounts, used her State email for official business and nobody would have been the wiser. Nobody would have ever found out about her private email server. It's just mind boggling that she couldn't be bothered to separate her private business from her official state department business.
She is dumb.
The thing is, would it have killed her to have two separate email addresses? One for official business, and one for doing her dirty work?
This just shows that not only is she a criminal, but she's a lazy and incompetent one.
The old man in the grey shirt looks like he needs some rest.
So, why no recommendation to indict yet?
My conspiracy theory is that if they do that too early, Bernie wins, and the Democrats don't want that.
(He would lose the general.)
So, they need to wait until Hillary has won, before they can recommend to indict.
Then they will push Hillary to give up, and slip Biden into place.
If she refuses, then the DOJ indicts.
Obama promises a pardon if she does leave the race.

And by that I assume you mean "cankles"?
I considered that option, but went with cackles instead.
In reference to Hillary cackling dismissively to any questions raised about this topic.
She's the Secretary of State. Everything she emails should be presumed classified by default. What the hell kind of a security policy allows personell to speak insecurely about any subject until AFTER it's formally classified? That's makes no fucking sense whatsoever. If you don't know if it's classified or not, you treat it as classified until a determination is made. Jesus fuck, either she's terminally retarded, or she thinks the rest of us are.

Note the nuance of Clinton's statement: "I did not receive any material that was marked or designated classified." If her staff copied classified emails and scrubbed the header of the designation then she is telling the literal truth that it was not marked or designated classified. As her husband put it: "It depends on what the meaning of the word 'is' is"
